This is a tree in our front yard (we bought our house last year and I new to gardening, photo was taken late Oct). Wanted to know if this is a persimmon tree?
No, it's a Crape Myrtle. For future reference it is really helpful to have a scale in a picture or an indication of the size of leaves, pods etc.
And the geographic location where the plant in question is growing!!

Persimmon tree question?
Are these American persimmon trees still alive?
That is one bizarre looking tree. I have 6 crept myrtles and your tree does have some upper spent flower clusters that resemble a CM. But the leaves also resemble my persimmon tree leaves (larger and more leathery than a CM). The lower larger "fruits" do not look like typical persimmons (green unripe/orange when ripe). Maybe another pic with a reference object for size of both the leaves and "fruits" would help as Floral asks.
Looking at that pic again, if it were turned upside down with a close-up of its "fruit" I'd say that it's an eggplant tree..... but there's no such thing :-)
That’s where a scale would help. They’d be very tiny eggplants 😉
Thanks for the replies. Hopefully the above 2 photos help identify it.
It’s a Crape Myrtle. That was never in doubt imo. The comments about scale and location were intended for future reference. btw still no scale in the new pix.
