Engineered Hardwood Flooring Problem- New Construction- Advice needed!

We bought a new construction house about three months ago. Throughout the home building process, we have tried so hard to work amicably with the developer (seller) and GC. There have been so many problems leading up to this point.


At this time, the most pressing issue is the engineered hardwood flooring on all levels of the house as you can see from the descriptions and pictures below. The seller's own flooring contractors, as well as two independent companies identified the same issues and offered similar solutions. There are areas where the floor dips between beams, there is bubbling, squeaking, etc... The GC is adamant in saying that our flooring was installed correctly, despite what the flooring professionals say. His solution is to nail into the floor. However, the flooring companies/contractors have informed us that this is not a permanent solution and that the subfloor needs to be examined and repaired (i.e., sanded down, beams leveled, planks replaced, etc.). This could be a $10,000 endeavor. Nonetheless, we have been consistent in setting our expectations..


On the second floor, the edge of the floor by the stairs is higher than the middle of the floor. This has resulted in an abnormal gap between planks.




Also, the floors in the two guest bedrooms were installed incorrectly. There are empty nail holes and planks installed groove to groove, as opposed to tongue-and-groove. The empty nail holes can also be seen on the first and third floors. The GC assures us that this is no issue and that the holes just need to be filled in.




We have asked the GC to explain the areas of the house where the bubbling and squeaking have gotten progressively worse since we moved in. If the floors were installed correctly then why are there dips in the floor between beams? Why are there abnormal gaps between planks and empty nail holes noticeable throughout the entire house? Is it a moisture problem? Is it due to space between the wood floor and subfloor? Is the subfloor not flat? Was the process rushed?


If the GC and seller refuse to fix/replace our floors, what options do we have left? We have consulted with a lawyer, who advised us to speak with our home insurance or settle the dispute in small claims court... Does anyone have additional advice? Do we let the GC "fix" it his way and then go to small claims court if/when it doesn't work? We just want to move on from the punchlist and building nightmares and make this house our HOME...
