Comments (26)I've been reading this post with interest, and have been tempted many times to chime in -- but thought I'd wait until my thoughts settled a bit first. So here goes: - This is a time while your entire identity is changing -- your whole self-image. I'm not sure how you thought of yourself before, but "the new you" will be at least somewhat different, possibly very different from "the old you." And the new you should live in a place that fits the new you, not the old one. - Staying in your current house seems like a "same life, but minus the husband" type of choice, sort of "less than before" -- even if it's actually a good change. Staying put seems like "hanging on" instead of grabbing something else, of being "divorced" rather than being "single" again. - Moving has the whole attitude of moving forward, of changing your life in the direction you want to go. What direction? Only you get to decide. You get to redefine your whole life -- a precious opportunity. Weed's point about financial flexibility is also a fabulous one. While money can't buy happiness, it *can* make all sorts of annoying problems go away. While I don't advocate "throwing money at" every problem, it at least makes almost every problem solveable, so you then have the choice for how you want to solve it. Comments (1)I don't know about indiana, but if I thought there was a divorce in the near future I would see a lawyer about getting the assets tied up if that can be done. That way the money couldn't be taken and hidden. My X brother in law took $200,000 from their savings and left my sis with the house and $5,000. Comments (10)I was just discussing this with someone else, but most lawyers I know would advise against filing for a legal seperation if a divorce it what you are really after. Why did she choose the separation route? It generally just costs more and just drags out the inevitable. I think the fact that she filed for a legal separation instead of an actual divorce may tell you something. There may be some good reason she wants to be apart from him but still remain legally married to him (inurance or religious reasons, etc). Still, that doesn't say why she didn't sign the separation papers.... But legal separation papers often don't really do much. Frankly, I would guess she may have hopes of a reconciliation and may have filed the papers as a kind of bluff. I'd just ask her....See MoreDivorcing seller
Comments (9)There are million war stories. We purchased a house from a divorcing couple. The husband had developed a drug issue and had spent every penny plus some. The wife didn't have a dime to her name and two out of control teenage sons. The inspection found termites. The agents contractor husband ended up having to do the tear out and basic fix. He got paid at the closing. We just had to be a little more patient about getting an answer when issues would come up. The most interesting part was the closing. There a was a restraining order in place. They had to get a waiver for that. The couple were originally Swedish. At the closing table, they kept saying nasty things to each other. None of us could understand what they were saying. We could understand the tone of voice. It wasn't nice. We kept waiting for them to go at one another across the table. While the house was emptied out, the attic was filled to the rafters with their stuff. They were supposed to have it out by closing. We inspected on the day of closing. They had dumped all of it on the curb out in front of the house. This was in an inner city setting. There would have been a riot on the street if that stuff was left out too long. Because they had been such dirt bags, we weren't going to close without that stuff being moved off the curb. We made them escrow some money to pay for removal. If they didn't remove the stuff in 24 hours, we could have it removed and sent to the dump. That night we drove past the house. The realtor's husband was loading all of their stuff into a truck. They were so angry at one another, they couldn't do anything together. That was the most exciting closing I have had to date. It required a lot extra patience to get it done....See Morebrickeyee
