Dispute between contractor and subcontractor

Hi, I am looking for an advice from Contractors preferably familiar with CA requirements.


Here is a situation:

Kitchen cabinets were damaged by the electrical burn during installation of the backsplash. Below is the sequence of the events:

1) The site was prepared for the installation (including electrical wiring) by the contractor and passed rough inspection.

2) Video camera was plugged into the incorrect outlet (on the kitchen site) and supposedly activated previously dead line (by owner).

3) The hood might have been plugged into incorrect outlet and could have activated previously dead line (by appliance installer).

4) Hanging electrical wires (now live) were placed inside the cabinet (so not to interfere with the installation of the backsplash)( by subcontractor)

5) The hood (over the backsplash) was disconnected (by subcontractor);

6) backsplash was installed (by subcontractor);

7) The hood was plugged back into the incorrect outlet (by subcontractor),

8) Electrical wires burned the cabinet.


The contractor was not onsite when this happen. Who is responsible for the damaged cabinet?
