Seller won't sign release, when can we buy another home?

Hi all, to make a long story short, we had to sign the release and back out of the house we were under contract with...we couldn't get financing. The seller is not willing to sign the release at this point. I am not really worried about the earnest money but the seller is threatening lawsuit and everything else (on what grounds I have no idea). It's explicit in the contract that if we couldn't get financing deal is null and void.
My question is, when can we safely move on to buy another property? Are we technically out of the deal since we signed the release? Thanks for any help you can offer.

I would think that if financing was one of your contingencies, you're legally free of the contract whether the seller signs the release or not. What does your realtor advise?

You said could couldn't get financing but you want to move on to buy another house. Can you negotiate on house number 1 to get it into what you can buy? I would ask your atty since this really is a legal question.

"Today, the seller offered to put on a new roof himself. Not hire somebody, but himself. He said I would not be able to choose the color or the shingle, but it would pass inspection although I would not like it." I would have walked too. If the roof leaked, who knows what type of water damage/mold you might have in the attic/walls. I also wouldn't like to be told I have to use a color/shingle that someone else chooses for MY house. As for shopping for a house in December, thats what we did. Our house had been on the market since July. We weren't willing to pay the original asking price so we were watching it to see if the price would go down. It did. By making our offer in crappy weather (Jan), we got it for $50k off. I'm glad we didn't wait until spring to purchase because I knew all the greenery and flowers would bring more buyers.

"our offer was apparently 90% of appraised value." Appraised value for what purpose? Taxes? Tax assessments always lag behind sales. An actual loan appraisal? Based on what? Similar is not the same. Location, location, location. How similar? Same schools? Same Âside of the highwayÂ? We think, although unsure that the sellers are looking to make $100,000 on the year (which would be about a 12% increase when the market has dropped about 5% in this area)." The only thing that has anything to do with process is the "the market has dropped about 5% in this area." And ÂareaÂ can be a vague thing. In the Washington, DC metro market sales are dead in some areas and flat in some. Some areas will probably end up going down but the latest overall market assessment in the news is ~10% increase. Is this market up or down? Location, location,, location. "Just think the $100K profit in one year is a bit over the top" This has nothing to do with value and is your personal opinion (and may not even be warranted). I have purchased some pretty cruddy places and sold them in 3-4 months for more than $200,000 over acquisition cost. I hit the major problems and left the minor ones to the buyers. If I fixed them all the price would go up another $100,000 and be too high for the location. Was I "over the top" for taking on the risk? The house may indeed be overpriced, but in an area with very few sales it can get very hard to tell. Are you looking for a quick profit or a long term residence? No one wants to overpay, but I have not seen any hard evidence the price is excessive yet. CMAs get very fuzzy without recent comps. I have purchased in places way over the previous sales if they are dated. I have also been caught a few times and had to hold longer than anticipated (most of the time from unforeseen problems). It is seldom simple or cut-and-dried without good comps.

We live in a town that has "soil" that's called sugar sand. If you look at it, it's a gray sand with a little dirt. Growing grass is hard, but after being here 7 years, I've managed to. We've actually sunk a lot of money into real soil over the years; but will people realize it? Probably not since people come here from town with real soil.. There's an agent that likes to photo shop grass. I always know when one of her listings come through my email.. it's that photo shop colored grass. Deceptive? To me it is, especially since I worked my butt off growing grass. One said "highway barely visible" that would only be the case if you never looked out your window or into the back yard, AKA the highway. You could not avoid seeing the highway unless you drive up and enter the house with your eyes shut. In fact if someone from the highway tossed their gum it would hit the roof. Are you looking in NJ at some of the new communities we've walked? Orleans has a really nice community in South Jersey, very pricey for the area.. guess what you can not only see but hear? I have no clue how they sell them.. well, yeah, I do. They're nice houses but come on. Does the highway not matter?

Lucky buyer! ** Another twist. As a seller, I left removing a fridge until late the night before closing. When I came to the door, there was a group of people who had replaced my front door lock with their own and were moving in household goods. None spoke English. A bi-lingual young woman finally appeared and I explained they didn't own the home until money changed hands the next day; and that if they didn't take their stuff out and put back my lock, there would be no sale. (Bluffing, I know.) Fortunately, they did as requested and closed the next day. After that, I made sure that the buyer's solicitor did not get the keys until money changed hands!

As was said above, ask your attorney.

I know this really doesn't matter, but why couldn't you get financing? I always thought that the financing contingency was mainly just a technicality because a buyer really should understand how much they'd be approved for before looking for a house.
Or did the house appraisal fall way short of the selling price?

My contracts have said that if the transaction fell through for any purpose that both parties accepted the earnest monies as the sum of liquid damages --or some such terminology--but what it meant was that the seller could not sue the buyer for any damages if the sale fell through. Check your paperwork for something of the sort. Also your realtor should be able to answer this question directly.

How will you qualify for a loan for a different house if you couldn't qualify for one for this one? A lower price bracket? Be careful! That may still be more house than you can really handle by the time you add in all the associated costs of home ownership.

If you cant get financing then you might want to wait a bit until your credit is better or until you have saved more money.

Somebody's threatening to sue you but won't tell you why?

This doesn't make sense to me. If you cannot buy the property, it seems like the seller would want to be quick to sign the release so they can start actively marketing the property again.

How many lenders did you approach to seek financing? Is it possible that paying a higher interest rate would have enabled you to obtain a mortgage?

It's usually not a good idea to sue someone who can't get financing. If you can't get money to buy their house, where do they think you'll get money to pay their judgement?

I wouldn't worry about it.

Here in NC, if the buyer is terminating the contract due to a contingency, all they have to do is send an email to the listing agent, or fill out the Termination Form. There needs to be no response from the seller.
IF you are due your deposit back, and the seller refuses, have your attorney threaten them with filing a Liz Pendens, which will prevent them from being able to market or sell the place.

Here, the seller doesn't have possession of the deposit, it's in escrow through the real estate company (?). When I had a contingency offer expire, the earnest money was returned to me by my own agent, I think.

In my area the deposit is sent directly to the escrow company, recently agents have told me they don' want a deposit with an offer, they don't want any responsibility for the money.

Those agents are doing their buyers a disservice by advising their clients to submit an inferior offer just because they do not want to take on more responsibility. In a multiple offer situation, with all else being equal, this agent's advice probably just lost the buyer the deal.
