House remodel gone wrong

Well, we messed up. We hired a man to do some pretty hefty work in our house. He came highly recommended by two friends and I trusted their judgement.

Unfortunately, the job in my house was a much larger job than he had done in theirs and he was not capable of doing a good job. Anytime we pointed out mistakes he would say, "Oh, yeah, I'm gonna fix that, I know." But he wouldn't finish that before moving on, saying he was in the middle of the next phase and would go back to it.

After 13 weeks in our house for a supposed 3 week job, we asked him to leave our house and never come back. He has ruined too many things and his "fixes" were no better than his original work.

He is now sending us the bill for the remainder of the work done. I am sick about paying him more. But I don't want to have a lien on my house either.

Does anyone know what my rights are in this situation? I keep reading that people don't get far for bad jobs done and have to pay anyway because the contracts don't list quality of work.

His new contract states that we owe him another $9K. Originally we owed him an additional $7K, but my guess is that we will need to pay someone at least $3K-$5K to fix his mistakes.

I am reading that since he DID the work, just did a bad job of it, we don't have legal recourse.

Has anyone been through this?

I'd love to give you some free legal advice here but I'm not a lawyer, don't know your state laws, don't know all the details, two sides to every story, don't know your tolerance for the fight, what you can afford, etc. etc. etc.

You hired someone incompetent to do work on your home based on what some friends recommended. Please don't get incompetent legal advice based on what some total strangers recommend.

Find a good attorney and pay them to advise you and send the notices to the contractor. It will save you money and aggravation in the long run.

Is he a licensed contractor? If so, notify your state contractor's license board and file a complaint. They may also be able to advise you about how to proceed to resolve this. Personally, I would explore my options there, as well as getting the advice of an attorney before I paid another penny. Regardless of whether or not your contract lists "quality of work," there are standards of workmanship that all contractors have to follow. You cannot just go into someone's home and do whatever you want and then hide behind lien laws. Lien laws protect contractors from non-payment, but there are laws to protect consumers as well.

Oh linelle, I burst out laughing. Isn't that always the way!? I had someone outside on the porch (notice the not-letting-anyone-in-the-stinky-house theme?) and after a quick walk to show her a plant, we turned back to see Waylon drinking her margarita out of her glass. If he triggers it, it comes on so hard, in full force, it scares the poop outta him and all I have is softly falling clouds of fur. I want to find a faucet I can set to come on in a dribble. Oh, Dawn_t! My Bentley wants to sit on the arm of a chair and lay his head on every one's shoulder. Kharma lies on their feet and turns her tummy up. I find it horribly rude if people don't pet Bentley's ears and rub Kharma's soft tummy. After all. They're making "love me, new friend!" overtures. Your brood is gorgeous! I've figured out another benefit of inset cabinet doors. On a few where I actually have overlay doors, the cats jumping on top of the cabinets has let (years of) fur sift down onto the contents between the cabinet and door. On my inset cabinets, fur and dust do not blow sideways, so the contents remain cleaner. MUCH cleaner. Score point for inset doors! :) I'd take as many cats as I could, but vet care and food are an issue. I'm staying at 5 right now unless there's a cat-astrophe and I must take in another. Like another 4-claw declaw being dumped in my yard in the middle of the night (Hank) or a post-delivery Kharma taking up residence on my porch. Hmmm... the beautiful Pits at Christmas did that, too. Must be something about the porch. But anyway. No more at the moment.

She lectured me that they should have waited on her to grout the tub area and now the backsplash would have to be acid etched and grout lightened and it would take time and a cost of $600. I asked if we could leave the 2 sections with different grout as the area us slightly broken up but she said no it would have to be done this way. acid etch? glass tiles? (or is that marble?) either way, bad idea. Didn't her crew realize what would happen? let me just say this about the tiling job,,,last pic, right corner. a good tiler will line up the design so that there is no break. A good tiler knows there is no way you're going to 'etch' the grout out of this mosaic. the only way to remove grout is with a hand tool or dremel and grind it out. what did it look like before this debacle? why wasn't a sample tile grouted to see if you liked it? why wasn't the designer there on site and why did you have to go to the store to get new grout? where is project manager or GC on this job? I just redid my neighbors bathroom. I was designer, project manager and GC along w/my tile guy, who is also a GC. we both collaborated before starting any task. tile layout, design, grout, color, etc. then we went to the customer and showed them exactly what it was going to look like. if they approved it, we did it. So I really don't get where your designer is coming off lecturing you. Do not pay. If you material is damaged, then she and her crew are responsible for fixing it or replacing it. Period. I would not accept, nor pay for, any damaged, etched, scratched or otherwise blemished material that was caused by their doing. you do not 'etch' grout to lighten it. never heard of such a thing. the damage was caused by her telling her crew to do that. I can't believe they did it. your tile guys are bozos. She owes you new tile and a new install. (I'd hire someone else that knows how to install a difficult water jet mosaic. cuz the guys that did yours do not)

Two completely different colors. Who sourced the paint? What isn't clear in your post is the path that got you here. Did your designer help you choose the color, but had no other involvement in the cabinetry finish process? I.e. did you tell the cabinet company what paint color you wanted? Or is this the shop the designer works with for kitchen cabinetry and she managed the process? Is this from a custom cabinetry shop, and your designer told them what color to paint the cabinets? Or did someone else buy the paint? What does the paperwork say, that is what is important. The answers to these questions will determine the person who has to pay for the fix.

Need to get a good lawyer on your behalf! They will end up either negotiating a lesser amount or they will tell you to take it to court!

Thanks, right now he has just sent us an outrageous bill for work he hasn't finished, has ruined, or has otherwise not fulfilled.

We are planning to counter-offer with what we feel is equitable, but we have a feeling he won't go away quietly.

We have spoken to a lawyer but haven't fully hired him yet as he is $200/hour. He has said that it sounds like we have done our due diligence and given him ample opportunity to "cure" the mess ups, but we will have to go further to know the details of all involved.

What a mess.

Take lots and lots of pictures before having anyone else fix something. Make sure the pictures are very clear. Keep ALL communications.

And use a lawyer. Good luck.

Talk to an attorney. However, be aware courts frown upon wrongful/fraudulent liens. In many states, contractors can serve jail time for filing a false lien. You probably want to look this up for _your_ State.

Hopefully you documented with pictures the work in question. And, documents proving what it will cost to resolve the work in question. Guessing does not count in court.
