Did I miss something in this auction?(Ebay)

I just bought this remote for a friend...shipping was fast...no complaints on that.BUT I was under the impression that the one I bid on was the one pictured.I see no where in the auction that states I would be getting a VERY used remote. The one I got has all the pictures worn completely off.I am so upset over this.I emailed and told him I wasn't happy.He told me that the auction is very detailed and I "apparently" didn't read it.I have scanned and scanned this auction,I am apparently missing it somewhere.he gave me the option of returning it(I pay for shipping) and he will send me a newer one for more money.WTH! I am not sending it back at my expense and paying him more for a newer one.I told him I'd chalk it up to lesson learned,he isn't an honest seller and I won't buy from him again nor will I recommend him to anyone..Geesh!

I bought remotes on ebay for our Frontier and my Sport Trac...both were the ones pictured in the auctions and work well.But they were from a different seller.Should have stuck with him,but this one was cheaper...

CR...I didn't see anything that said it was used...

I don't know what you are supposed to do but I think I'd complain to ebay. Let them read the listing. Show them a picture of what you recieved.

Under the heading "Shipping Insurance" I had a chuckle at this statement:

"We guarantee you will receive a tested, good working item, but if you do not buy insurance, the guarantee is void.

Does that mean in order to get a tested, good working item you have to pay an extra $1.25??? And if you don't pay the insurance, he will send you an untested, non-working item?

Wantonamara = Mara ? LOL...Yep. I am highly questionable. I am also very bad with remembering names in real life and not very organized like y'all with your list. Whoa , I am impressed . I usually callpeople by their handles because I never know who is sensitive about having their name displayed online. I have irritated a fiend by posting her by his name and he did not like it so I go by that rule usually unless it has been in common usage.

Yeah, Spike would literally "send" you to Disney! And a last name? Thank you Marg near Rapid City! I have been thinking fondly of the Spike days lately and wondering what Spike did after selling out to IVillage. Anybody know? THS is such a great place. Spike did a great thing in creating it for us. Did he create the whole Garden Web? I used to hang at Buying and Selling, but hope never to move again, so have not been back in a while. I just ventured back today, saw the mention of "shoes" and had to check it out. Gyr Falcon, back when Spike ran things, you would get a warning if you got out of line, then would find that you could not log on if Spike decided that you violated again. As said above, when you logged on, you would go to the Disney web site, instead. People referred to this as "riding the spinning cups" or "spinning with the cups," as in the teacup ride. Somebody on the forum would notice that one of the regulars had not posted in a while, and would ask about them. Had anyone heard from them? Another regular who was in touch through email would reply that the person was,"spinning with the cups," or "visiting Disney." You could try apologizing to Spike and maybe get back on THS. Sometimes, the ban was only temporary. Other times you could try to re-register as some other name (probably from a different computer, too), but then had to be careful about folks knowing it was you. At one point, the whole Building a Home regulars went off and started their own forum at a blog site because some regulars were banned. Does anyone know is that site still going?

sue36, you are looking at hours:minutes:seconds there, so the other bid was entered six seconds before the end, not 6/100ths of a second. When you are outbid and the winning bidder wins by a small amount, this is almost always one bid increment. He may have put in a bid that was much higher but he only has to win by one bid increment, so that's all that he has to pay. Ebay's bid proxy system works really well this way. Once in awhile someone will win by less than one bid increment but I think this is only when his bid was entered before yours. Maybe. It's happened to me on both ends many times in nine years of ebay buying and selling. Someday I'll look at this more closely and figure out the details! Ha. When you put in an amount, always add some change to foil those who bid in even dollar amounts. For example, if you are willing to pay $25.00 for something, make your bid amount something like $26.88. You'll beat anyone who is also thinking $25 is a good price, and you'll beat those who think that going a few cents more (like $25.01 or $25.50) is a smart tactic. Sometimes I go one odd-number notch up and then another just to be safe, and more than a few times this has been necessary to win! And usually if you're willing to pay $25, then another dollar plus change is not a big deal. Oh, and I've been using Auctionstealer for many years and am quite happy with it. I used the free snipes for a long time and then started paying by the year for their service. I think only once they failed to bid for me and I have not had any problems with security at all.

I can't see anywhere in the ad that states the item is used, and the impression given is that the item offered is the one in the picture. Looked at his feedback and it seems you're not the first person to be caught this way. Personally I'd ask him to point out EXACTLY where in the auction description it states that the actual item offered is a used unit and that the picture posted is for illustration only, and complain to ebay if he can't provide this information. About the only vague reference is in the "Terms and Conditions" where it says "We guarantee you will received a tested, good working item" but it's not exactly a disclaimer.
I'd also give negative feedback and if his comeback is "didn't read the detail" as seems to be his usual reply, respond with something like "detail not there" or similar. To be honest I thought the whole tone of the ad and his feedback was somewhat snotty.

The auction page does state something about clicking "here" to read their terms and conditions, and on that T & C page it says,

"Regarding part numbers: Depending on stock availability, we may occasionally substitute items to facilitate quick shipping. These items will be made by the same manufacturer as the item you ordered and will work the same in every wayÂwe guarantee it. The part number of the item may be different, which will not affect itÂs functioning. Please do not bid if this possibility bothers you."

This disclaimer allows them to ship something other than what it pictured or described. However, it doesn't say anywhere that the item (featured or substituted) may be used, but it also doesn't state that the item (featured or substituted) is brand new. Only that it is manufactured by the same manufacturer that made the automobile for which it is intended. It is "OEM" -- Original Equipment Manufacturer.

Having said that, this auction does tend to lead the average person to believe that the item will be new. As I stated in another thread about an eBay auction, the eBay headquarters are in California, and eBay sellers are thereby governed by the laws of this state. California Civil Code Section 1770 prohibits activities such as "bait and switch" and representing goods/services to be one thing when what you actually get is something else. This particular auction may very well fall into that, especially since the seller said that if you pay more money you will get a newer item. That's a classic bait and switch!

If you paid by credit card (even if was paid through PayPal but charged against a credit card), contact the company and dispute the charge. If you paid through PayPal either by credit card or by a debit to your checking account, file a claim with PayPal that the item received is not what you purchased. And notify the seller that you will be filing a complaint of fraud with the Office of the Attorney General for the State of California.

...As Colleen says, his feedback certainly isn't the best. He has 40 negatives in the last month, 149 negatives in the last 6 months, and 183 negatives in the last 12 months. I don't know what your feedback is, but I'm certain that you have a better eBay reputation than he does! That should work in your favor.

I never, ever buy anything from a Ebayer that has less than 99.7% positive feedback....honest!!! 99.7 is the lowest I'll go...........This account has WAY too many negatives and neutrals. Tell it like it is on their feedback...they CANNOT retaliate anymore. Warn the rest of us!!!

I would initiate a PayPal dispute, item received was not as pictured (whether new or not, what you received did not look like what you bid on).

Nowhere did it say the item was new or used. Since the packaging is shown, the implication is that it is new or in like new condition.
