Bad neighbor dilema...need advice
Comments (24)My idiot neighbors never controlled, watched, or interacted with their idiot 10 year old son (unless you consider their screaming-his-name-at-the-top-of-their-lungs-in-the-middle-of-the street-as-a-method-for-calling-for-his-attention "interaction"). So, given the appropriate tools of destruction...fireworks and lighter, free time and no supervision...he proceeded to shoot fireworks at my house and light the accumulation of dried up materials in my gutter on fire. He's lucky he could run faster than me. I'm lucky he could run faster than me. I would have pulled a "my mother" on him and he would have never touched a firework or lighter or come anywhere near my yard again. Of course, I'd be in jail and not telling you this story right now, so maybe it was a win-win that he took off running. I digress. I stormed over to his house and, in my pent up fury and naturally occurring Irish-temper, let his pitiful excuse for a mother have a verbal lashing that would have shamed my own mother, whilst searing through her skin with my maniacal blazing eyes of fury. Never had that problem again and shortly thereafter they moved. Sometimes it pays to be nice and sometimes it doesn't. Only you will know what works best with this person you've had time and experience with. I wish you the best of luck. And, if needed, I'd be happy to come over and out-crazy her anytime. Comments (9)Hi: I moved into a duplex almost 4 months ago. The house is old and the walls are thin. When I rented the apartment the other side was vacant. I am 55 years old, single and work days. The landlord then decided to rent to a pair of 20 something females who work nights at a bar. The first month I lived there I thought I was living in a frat house. I complained to my landlord about the noise in the middle of the night as they bring friends home with them. She spoke to them and they didn't see a problem. The noise has gotten better until last week. I was home around 5PM and the music was on next door. It wasn't that loud even though I hear it. Then it got louder where I had to keep turning the volume up on my TV. I finally pounded on the wall and complained. I was told to get a grip it was only 5:00 - my landlord told them they could make noise until 10PM. I said the music was drowning out my TV. My landlord arrived later on to pick up their rent check and told her about my banging on the wall and yelling. She asked for the music to be turned on at the volume I complained about - of course I didn't hear the music as they lied about the volume. She then proceeded to tell them if I yelled or banged on the walls they should call the police. When I got her e-mail I then told her about being woked up several nights a week when they come home with friends between the hours of 2 & 4 AM. And 2 weeks prior I was woken up at 3:30 as it sounded like there was a fight going on. I have realized that they don't go to bed until 5AM and sleep until 5PM. They told her they are afraid to hang anything on the walls for fear of my complaining amd the walk around on tip toes. I said if that was the case then I wouldn't be woken up in the middle of the night. They want to hammer nails at 12:30 AM. I told my landlord I was sorry for having to sleep at night so I could go to work during the day. Seems it is now my fault. I also don't allow my guests to park on the front lawn. I even find myself trying not to make too much noise in the mornings when I get up and the weekends when they are sleeping for fear of retaliation when I'm trying to sleep at night. And for those who suggest moving as an option. That isn't always possible. I lived at my last place for 9 years and when I took a job further from there I decided to move. Moving is not cheap. Comments (16)I had a full boundary survey. It cost me 700.00 dollars. They gave me a detailed map of the property lines & they put new stakes in the ground on all sides. Everything was fine & the old markers were fine, except on the side of the nutty neighbors. The dog stays in the house until we take him out. He's rarely left out alone & if so, only if I have to run in the house for something. He's a large breed dog & a bully breed--a doberman, so I would not want anyone to get hurt. He also doens't like these neighbors. That's why I don't risk leaving him alone now. As for the title, the title company did not report any kind of encroachment. They relied on the existing stakes that were in the yard. If you looked at the stakes in the yard, everything made sense... if it were not for that gate & that fence--. I got a survey only because I needed to know about the gate & fence & needed one to get a permit for the fence. It was also something that needed to be done. Anyway, the neighbors finally told me that the stakes were moved. I asked my "neighbors" & they said they added stakes, because the old ones were under their new concerete driveway & that the original stakes were in the wrong place anyway. So, they said they were just "correcting them". If you looked at the stakes they put down on their side, nothing was encroaching. I did tell the city about them moving the stakes & I have witnesses in the community that know about it. The surveyor also made a note about stakes of "unknown origin" behing present during the survey. They removed them... they were not set very deep into the ground, but looked like the real thing. Their addition doesn't predate existing codes. A permit has been required since the 70's for the area I live in. You can clearly see that the building & fence are no more than 3 or 4 years old. The fence looks so bad because they pull into their yard speeding & have bumped it a few times. Like I said, it's not an easy situation. Comments (37)you have gotten a lot of good advice already, my place would be what I want and my morals..personally. and also their attitudes..i guess. if they are demanding you fix it cause their dogs are no longer contained..that is not right. It is their dogs that they wish to contain, if your animals or livestock were roaming in to their yard and doing damage then they would have some right to complain, but if their tree damages a fence on the property line..why do they have a right to complain in the first place. are there survey markers..is the fence on the line or inside your side? when we had the property suveyed, we on purpose put our fence inside of the property line about 1/2" so that no portion of our fence was on the neighbor's property..thus it was OUR fence and we maintain it..if it is a shared fence then it should be equally shared by both properties, including expenses.. unfortunately people are responsible for the damage that their trees, or dogs, do to other people's property, however, the ICE may have been the damager not the tree..so it might have been the liable party. can't bill the ice or expect it to do repairs.. if the tree was dead or dying that is a different story..but if it was just storm damage, it was just that storm damage..either you or your ins are liable. if you don't trust someone else to fix it right or you want it done your way, then do it...make it clear to the neighbors it is not doable until the ground can be properly worked for the posts..that they can put up a temp restraint for their pets buy buying a few boards or some wire until it is fixed right....See Morepixie_lou
