How long should it take to get earnest money back?

I canceled a contract on 5/24 due to several major issues found in the inspection. The mutual release was not signed by the seller until 6/8, and then not until 6/11 by the seller's broker. Now my agent has to have it signed by HIS broker, and it has to be sent to the title company, who will call me 'when a check is ready'.

I am not hurting by not having the money back, but this seems wrong on principle, and is possibly violating the law.

What law?

Paperwork takes time, and each party must ensure they are performing their due diligence before signing.

Is there a time in the contract?
30-60 days is pretty standard to move money around.

Well, it *could* have been handled better;
the title company could have emailed or faxed the document to each party for signature at the same time.

but once your broker has signed it, the title company should issue your check the same day if you request it.

Actually there is merit to their answer, You need to have at least 3-4 gallons of water in the refrigerator side in jugs and at least 2 gallons in the freezer if nothing else such as perishables. If you have a completely empty unit, what is there to remove heat from? or be cold ? besides the air which falls out as soon as your door opens. Unless you have a unit with a lid on top as in the market, cold falls and falls fast. The room temperature air immediately replaces the cold air you had and the unit will not read a cold temperature unless you stick it to the wall, but box temps will not ever be cold empty with an open door. Google this yourself, I have 40 yrs doing this and many times I am not believed like when I tell them my $85 call was to set the dial to the middle setting, as they pegged both to coldest, which if you really check it out, gives you a colder freezer and starves the refrigerator side, all its cooling is from the freezer box, there is no separate coil or system, the way the air circulates into the reefer is by a tiny trap door, the other dial is the thermostat which controls the compressor.

Depends on what he committed to and how detailed the plans are and if there is anything he may need factory approval or pricing for. Everything may seem basic and easy from your perspective but it may not actually be so. Let him be thorough, if you rush him he may make mistakes. Kolbe quotes are the ones that take forever, slow system and a ton of questions,("Do you want jambs to be exact?") nooo, send me whatever you got... Regarding the lines you are looking at, I am a big fan of Jeld-Wen Siteline EX, but when it comes to double hungs you will be MUCH happier with Kolbe. Trust me spend the extra 10% +/-.

Again, thanks for the responses. I think it is a small company, but not just a one-man-show - at least a few employees not including the actual installers who do the work. I actually don't recall how long it took to get the first quote, maybe a few days, maybe a week. That first one was supposed to be tailored to us a little, but it was mostly just base options for one series of window. Then, at the installer's suggestion, we considered changing to a different series, and it took almost 3 weeks to get that quote back. Meanwhile, a third series option has become perhaps even more attractive to us after doing our own research (that's what happens when you're waiting 3 weeks I guess), and I'm almost afraid to ask again after my first specific request for a quote met a "about 10-20% more" response with no offer to actually quote it. That's primarily why I wanted to know if it was a 10 minutes or 3 hour type of task (actual work by the installer) that I am requesting of him; he seems so reluctant to work up a quote. We still wanted a more tailored quote for the original series, one with glazing options etc that we've specified after doing our homework. We also wanted to price out different types of windows in the same location in a one area, upgraded wood/stains, and grilles types, but we haven't even mentioned these thoughts because we already feel pressured to just make up our mind on what we want not knowing specific prices differences. The errors I mentioned for this installer were in the fact that he omitted options we specified meaning we still won't be able to compare costs with the series he recommended when we get the new estimate. Meanwhile, the 2nd installer I contacted said on a Friday we would have a couple quotes (two series) by Monday, but it wasn't until the following Friday that we had them. This installer made a lot of gross errors or typos in measurements that will have to be corrected. I expected a corrected version last Thursday; still don't have it. Anyway, that's where things stand. I just didn't know how big of a deal it was to ask one of these installers to work up multiple quotes, and I don't want to come across as unreasonable or annoy them, because I certainly don't want someone who personally dislikes me working on our house...

Salti, I think it's great that you had an experience with an agency that you felt did not get their responsibilities confused. I can also see why it might be more reasonable for the process to take as long as it did with the breed and situation you chose to adopt under, but not everyone is having a similar experience. Granted fosters have lives and scheduling can be an issue, but part of the responsibility of fostering is making the animals you're fostering available. This was actually said to me a few years back when I thanked a foster for her quick response while we were looking to adopt. As with the OP, if a potential family goes through the process of filling out paperwork, a home inspection and a LONG wait period because they want to bring a dog into their home, I'm more inclined to believe that they are probably a positive placement for a dog and the problem is the agency. Granted, placement is not black and white; finding the right forever home does have a lot of grey areas to consider like the animals history, breed compatibility, family dynamics and yes, environmental situations too but it should be a joint effort to figure that out, not the fosters alone. The OP says they only got to see one dog and never got a chance to see if other dogs would be a better fit for them. If you do the research and read some of the articles on this subject, you'll see there is a negative trend in the adoption world. Too many dogs go unadopted and left in less desirable situations because the "agency" trying to adopt them out is over zealous in their placement requirements. Look at how many people posting here have said they were rejected for one reason or another and subsequently had to find a dog elsewhere. All the dogs that they eventually paired up with are absolutely loved and have thrived in good homes. If a family really wants a dog they will get one in spite of the challenges poised by an agency. The family ends up with a dog but what about the dogs that are left behind? Also whether a rejection is for a good reason or not, it just seems like there are a lot of agencies who don't seem to have much regard or concern for the adopting family. If a family, especially one with kids shows an interest in an animal but doesn't qualify for whatever reason, the agency should at least reach out and communicate their concerns. What if the concern is a minor misunderstanding or there is a simple fix that can make things right? The dog could still have a chance at a good home. Follow up regardless of the decision is just common decency and the families deserve that. Lastly, I wouldn't just assume that a pet adoption agency was right just because placing dogs is what they do. As far as I know there are no requirements when it comes to credentials or certifications for the fosters. Obviously, some are pretty confused about what really matters and what doesn't matter at all.

Now you get into issues about not having a sole document bearing all the signatures.

And they still have to be send paper back.

The legality of faxed signatures is still all over the place.

When I was in this situation, my agent immediately faxed my papers & got the seller's signature. I had my check back in a week.

I had no trouble with faxed documents in several transactions I've been involved with. I think that your agent should be doing his job and getting this money back to you immediately. Does he/she expect to be involved in the next transaction? I would consider this warning that the agent is not on the ball here.

It depends on the state and the level of risk folks are wiling to assume.

A faxed signature on a deed is not going to go far in many places.

A faxed signature for a few thousand dollars of earnest money might be within folks risk tolerance.

A faxed signature for $50,000 might make a lot of folks squirm.

Faxed documents have been held valid in some places, but only between dedicated fax machines, as opposed to PC scanners that then create a fax.

There are also federal laws pushing 'electronic signatures' as being acceptable but it has yet to roll down to the state/county/city level in many places.

A huge amount is going to depend on the amount of money involved.

A small amount is more tolerable than tens of thousands, hundred of thousands, or even millions of dollars.

As far as I know, faxed signatures have not been found invalid;
if the title company has no problem with it (the title companies I have used never have had a problem), faxed signatures for the release of earnest money are perfectly fine.

I don't think a county clerk's office would accept a faxed or electronic signature on a deed, as that transfers ownership, but earnest money is generally easy.

They have to have been found VALID.

And non-certified copies of documents have repeatedly been held invalid.

Practices are invalid only after they've been challenged in court.

surprised your wife the lawyer hasn't told you that.

& while certain documents need to be notarized, the release of earnest money never has been one of them.
