Does the buyer or the seller replace the windows?

My SIL is buying a house and after the inspection some( I don't think all of them) of the windows, on the outside, seem to have leaked or there is water damage to the trim surrounding the windows. My SIL and her agent are trying to get the seller to replace them and he doesn't want to. The inspector also found particle board in the bathroom and says that should be replaced too. What is the norm? Does the seller HAVE to replace these windows and particle board in the bathroom? Or, can the seller just say, " too bad; buy it 'as is'"?? My SIL feels as though she is already paying "top dollar" for the house and now this!!

Sounds like kind of a "gray area" to me :(
