All through your post I thought out loud, "Get an attorney!" Then I saw that you had a call in... But that's not a cure-all either. They are busy, too, and sometimes getting them in gear is difficult. *sigh*

Honestly, I don't know what to tell you, but I'll send up a little prayer (OK, I'll send up a HUGE prayer) that things start falling into place soon for you and this dreaded knee situation. Makes ya wanna kick some butt, huh?? (If only it didn't hurt to do it!)

I've been wondering about you Lori!
I *think* your car insurance can pay it and then will turn around and file a claim against the guy that caused the accident. At least thats what happened to me, oh boy in 1996 when I was rear ended. ND is a No Fault state tho. All I wanted was my car and the medical bills paid though.
I hope you get this resolved ASAP.
Meantime, I am sending lots of hugs and caring wishes to hold you for awhile.

I'd just try and take it as easy as I can for awhile. I KNOW that is going to be the pits, because your lifestyle is a busy one!

Lori, the most important thing in all of this is "GET YOUR KNEE FIXED" no matter who has to pay. And it sounds like somehow or another, someone's insurance is going to pay, so get yourself back into the doctor's office and insist on sooner than May for a fix. I'm so glad he called you and is now more informed, but gee whiz, it shouldn't be so hard for a patient to talk to her doctor.

I'm all for raisin therapy, but sometimes you just have to cut out the raisins and go for the gusto- pour yourself a shot!

I sure hope this resolves for you in a positive way. It makes my leg ache just thinking about yours.

I'd get the knee fixed ASAP so there isn't any more damage/injury done to it. I'd be pissed the DR wasn't anymore up on your case. At this point you probably have him sweating over the condition your in and him not knowing about it.

Please, push on, go to the DR! and see about getting this taken care off before it ends up being to late.

Continue seeing your Doctor and get that knee taken care of. Hospital's are accustomed to people making payments. I know the insurance is a hassle.

Turn this all over to a Lawyer. But, these things take time, and time you haven't got with that knee.

Lori, I hope you get fixed soon! It doesn't sound like you need to be putting it off. The insurance companies are going to try to put it off on each other. Let the lawyer handle them and you worry about getting the knee better.

I wouldn't have cancelled your doctor's appointment. If the insurance company finds out it might give them more ammunition that your knee isn't really that bad that you can't put up with it. Get your knee fixed, and let the lawyers and insurance companies deal with it. Insurance companies sure do love taking your money but are a pain in the you know where when they have to pay out. You only have two knees and you don't want a lifetime of pain!

Lori, you need to continue seeing your doctor and get that knee taken care of. At any age knee problems are bad, but as young as you are and the kind of life style you lead you reaslly need those knees.

I'm sorry you are having such a hassle with the insurance. I hope the attorney can do something for you.

I talked to the lawyer today; the same attorney who handled our problems with the power company last year.

He set my mind at ease immensely.

He, like all of you, thinks the most important thing is to get the knee problem taken care of. The doctor yesterday didn't come right out and say 'this was caused by the accident' but noted I was doing great with my knee until the accident then started having problems. The attorney says this is doctorese talk for 'yes the accident hurt her leg'.

He said to keep going to the doctor and schedule the surgery. He advised me to stop talking to any insurance agent except my own.

I'm to go to the doctor next week, see what his prognosis is and we'll go from there. I'm hesitant about incurring more expenses until I know they will be paid. He said we'd cross that bridge when we got to it.

Then he brought up pain and suffering to which I said 'Huh?'
I had not thought that far ahead.

With the exception of two years, I've dragged my left leg since I was fifteen years old. All I wanted was to be able to walk without pain again.

Lori, I am so glad you talked to your attorney and reset your doctor's appointment. You need to take care of your leg.

The insurance companies are just doing what they do best ~ passing the buck to see who will back down first. Don't flinch. Listen to your lawyer and let him/her handle it.

You already have lots of good advise...don't let the other guys' insurance company get away with this!!!! FORCE the doctor to make a ruling (in your favor :^) I work for a herd of attorneys...you wanna' borrow one????

It is so disheartening when insurance companies make it seem like our lives are worth nothing to them, and it is all about who will pay which bill.

Sigh. Days like that I miss drinking AND smoking ROFLMAO.

Have you been logging and documenting all of the stuff that's been going on since the accident?

Including all of the phone calls, the actions ... and your reaction to all of them at the time.

Including the funny business with your doc's office. It wouldn't hurt for you to refer to how many times his office had called in such and such a period ... or hadn't (when maybe they should have) when in coversation with him.

To have him aware that you're keepng track of his office's shortcomings will likely make him pay more attention to the way in which the situation is developing.

I think that you should make as clear records as you can of the ongoing situation with your knee (and other physical situations that might become involved) prior to the accident, as well.

Insurance companies pay better attention if you can refer to specific circumstances in such a situation, for they know that you've been recording everything ... which is of interest to not only attornies ... but judges, as well.

That makes them less inclined to push you around, if they know that you've recorded everything, I think.

And keep the necessary evaluations and treatments going - sooner or later, almost certainly one of the insurance companies is going to have to pony up.

Good wishes for pushing to get the evaluations and treatments that you need - as soon as possible.

Lori, just get your poor knee taken care of & let the bills pile up; somebody else is going to have to pay- there's no way they can get out of it.
Put on your battle gear & tell the other fella's insurance company they'll have to talk to your Attorney about anything in the future and tell your lawyer it's all been well documented. Strange how once they learn you won't be pushed around they seem to have an attitude change.

Knowing you have an attorney in your corner to get bills paid will take a huge load off your shoulders and allow you to focus on getting that knee well.
