What does test results were skewed against little people mean? Did they not make him explain?

I don't see how the jury can decide without proof of his blood alcohol level. If he's lying, it's a pretty good excuse he came up with. I knew a guy who was arrested for littering. The police said he threw a piece of paper out the window while driving. He said he was trying to catch the paper as it blew out the window. He was lying, but who could prove differently?

Based on his size alone, it would seem like 1 beer would put him over the limit. I thought if you refused a breathalyzer, you had to take a blood test. (One or the other), for some kind of BAC measurement. And he is shorter then his wife, so the pedal thing might be correct?

Also, I'm surprised a year of jail might be the sentence. My DH's friend was driving drunk, and hit an unmarked police car. He went through a bunch of stuff like losing license for a time, then ONLY driving to work and back for 6 months or so, going to court etc, but I don't think Jail was ever an option (aside from the night of the accident.) I liked this guy, but he has a serious problem and needed a BIG wake-up call!

Teresa, the year in jail is probably the maxium for whatever specifics he's charged with.
However, it can be reduced to negligent driving..which is a few months of probabtion, maybe a fine, maybe a visit to a MAD meeting..Likely it'll get reduced.

It may be a MAD meeting, DUI school and AA meetings for X amount of months. I doubt first time out he would get jail.

I don't know if anyone remembers that last season he was diagnosed with Diabetes and was very adamant about not doing what the doctor told him to do as for changing his diet etc.Could he have possibly been having a "sugar"episode? That can affect balance and ones driving ability.Since he refused the breathaliser test were they going simply on the field sobriety test,and if so how could they tell for certain that his alcohol level was above the legal amount? Even though I am really getting tired of his arrogant attitude and the show,I'd give him the benefit of the doubt!LOL

I thought about that too Lilliepad....could have been diabetes related? I love the show...can't wait until the new season starts!
