Bamboo Threatened by Neighbor! (long VENT)

We have bad neighbors on all sides of us, luckily there is some space (we're in the boonies, but you still get bad neighbors who burn plastic and let it smolder all day and the wind blows the stench into your house). I planted A LOT of bamboo, mostly to hide the ugly view of the one neighbors property that we can see in winter (and see all the garbage they have piled everywhere, along with the 30 dogs he has (he runs a puppymill, and do the authorities care? NO.). Destruction of property is a bad thing. Maybe you can get some form of mediation involved? I think that is cheaper than a lawyer. Sorry to hear about your neighbors, ours are really bad. One we have property bordering with tries to steal our land by putting up goat fencing on our side, he's built tree stands (with boards and lots of nails)in our real nice oak trees, their one son was in it and when my husband went up to the kid, he pointed a bb gun at him! The little jerk never even apologized (neither did his parents, no surprise), the kid started ARGUING with my DH about where the property line is (Sorry, but my DH knows how to read a topo map, as well as survey maps too, and WE know where the line is). Comments (26)I hope you get everything worked out and can survive for 10 months. We're 2nd floor dwellers ourselves (thank goodness, only for one more month...then we're moving to a house). We try to be considerate of those below us - we only have one person below us. He tends to do his laundry from midnight to 3am, but he leaves for work between 3:30 and 4am. I work out at home usually around 5am, but he's long gone. We've never had a problem with him complaining or us complaining, but we do try to be respectful and not make a lot of noise when he's at home. And I definitely know that cats can be loud - ours love to run around every once in a while and they do sound like elephants. Perhaps you can do as someone above mentioned and make note that her dog barks, but you understand they bark. Cats jump from place to place. Comments (16)I don't think a lienholder can demand foreclosure on the property unless the amount owed meets or exceeds the value of the property itself. I'd imagine your property is worth much more than what you owe the guy. If its installed and you accept it, then you should pay for it. To do otherwise is akin to theft in my mind. No one should ever hire a contractor who is willing to work without a contract. Doing such is a mandate for a disaster, either for the contractor, the homeowner or both. Here in my state there is a limit on the amount of claim that can go to small claims court, above that the matter is taken to higher court which oftentimes requires an attorney to represent you. Every contract should have a very clear change order procedure and it should be followed. Every time I've had a customer not want to honor my change order procedure, they've been someone out to put the screws to us. Not to say that you are, but I am amazed that any experienced contractor would not give you an accounting of the change requested and have a signed agreement on it prior to proceeding. Also, $50 an hour is cheap. We bill at $65 for Time and Materials work, plus an upcharge for management or other fixed costs. Change orders are always Time and Materials and I will charge an additional fee for the cost of extra work, compiling quotes from subs, extra design work, engineering or if the customer needs an incentive to cool their heels and get back on earth. Also, you talk of delays the project, but did you consider the extra time involved in the changes and how they would effect the overall project schedule? The contractor's cavalier 'oh not much' response sounds like you two didn't do a sit down and really hash each portion of the project out, including changes. If the guy is willing to give you a clear accounting of the costs and labor, you are happy with the work (which apparently you are as you haven't complained), then pay up and take it as a lesson learned....See Moredeniseandspike
