Builder demanding 9 th draw

Our contract specifies that the builder is to be paid 4 draws during construction. 1st when foundation is poured, 2nd when roof is up, 3rd when drywall is complete and last when house is complete. However the builder has demanded draws 8 times and each time has stopped work unless draw is paid. So far he has been paid 75% of the contract amount plus approximately 45,000 extra. None of his allowances have been realistic and we have had to pay extra just to get average stuff for the house. Although he promised us his allowances would cover options as in model home, we are now paying thousands extra to get cheaper than that. In addition there have been design flaws which we had to improve upon and paid $5000 to structural engineer for all issues he found. The builder insisted that structural engineer was just milking us and all his points were bogus. Submitted the reports to the City inspector who said that on rough inspection that everything looks ok to him. We don't know who to believe. Building process is taking so long as we had a tough time resolving design issues. We started the building in Nov 2009. Our contract specified that he would start paying interest if it goes over 1 year. But we are paying interest so far as he is blaming us for the delay.

Once again now Builder has stopped work till we sign 9 th draw. This will leave very little money left over and we are afraid then he will have no incentive to complete work.

He had included landscaping including seeding of lawn, front shrubs, driveway, and a retaining wall. Now we have been told by him that we will need lot more retaining walls and we will have to pay for it. We are talking about 50 to 100 thousand extra. His allowance was $2000. The allowance for the driveway won't even cover for 1/3rd of the actual cost.

Had we known that this lot would require so many retaining walls then we would not have bought this lot. The builder who is also the developer of the subdivision assured us that the retaining wall he has priced out would be sufficient and he would be easily able to slope the rest.

We contacted a lawyer a while ago, and he wants just $5000 retainer to look at paperwork. Lawyers are super expensive. So far we are just hemorrhaging money and don't know how to afford a lawyer.

Do we have any recourse? The home prices in our area has dropped 30% and if we were to sell this house then we would take $200,000 loss atleast.

It shouldn't be this way. Builders need to be held accountable and not be allowed to get away with bait and switch tactics.

Would love to hear any ideas. Do I have to pay this 9th draw or should he complete construction to get paid the remainder of 25%?
