Rosa 'The Fairy': How can there be more than one?

After doing a search on GW (and not finding an answer here)

I'd love to know how the following "confusion" occurred...

Ordered two Rosa 'The Fairy' from a local nursery (highly reputable) specializing in shrubs. . .they're actually a

wholesale outfit who, for the last 12 years, have very

kindly accommodated my small, one-man design business.

When I went to pick them up, my immediate reaction was:

"Those aren't Rosa 'The Fairy' - the pink is wrong, the foliage is wrong, the flowers aren't small and doubled, etc." The part-owner, whom I've always dealt with,

replied: "Oh, this is Meidiland 'Fairy', you must mean the

old one. . ."

So: how did Meidiland get to duplicate the name? They

must have KNOWN how confusing it would be. . .and given

the longtime success and popularity of the original 'The

Fairy', it immediately looks like a calculated move to

capitalize on (and benefit from) confusion.

Hoping to hear some insights from you more knowledable

rosarians. . .
