The Department, however, declines to state categorically that these types of allergies or sensitivities are disabilities, because the determination as to whether an impairment is a disability depends on whether, given the particular circumstances at issue, the impairment substantially limits one or more major life activities (or has a history of, or is regarded as having such an effect). Sometimes respiratory or neurological functioning is so severely affected that an individual will satisfy the requirements to be considered disabled under the regulation. Such an individual would be entitled to all of the protections afforded by the Act and this part. In other cases, individuals may be sensitive to environmental elements or to smoke but their sensitivity will not rise to the level needed to constitute a disability. For example, their major life activity of breathing may be somewhat, but not substantially, impaired. Allergies are only considered a disability if they result in substantial impairment of respiratory or neurological functioning. And you would need a doctor to verify this in writing and that would be subject to review. Personally I don't think anyone with an alleged dog allergy would qualify. I don't follow why we are discussing a person with allergies being deemed disabled. If a disabled person came into a restaurant and there was a person in the restaurant who was severely allergic to dogs...the restaurant can not kick out the disabled person with the dog. Comments (79)Interesting the impressions some have :-) There is a big difference between a department store......of which very few exist these days.....and large clothing stores. Nordstroms has never been a department store!! It started as a shoe store.....period! I remember shopping there in my late teenage years, as they were one of the few places around that sold Capezio shoes (which I loved and had a vast collection :-)) It wasn't until it combined with a woman's apparel store (Best's Apparel) that it became a clothing store, known as Nordstrom-Best and finally just Nordstroms. But it only sold shoes and clothes. That is NOT a department store!! Back in the day, Seattle had two, semi-upscale department stores - The Bon Marche and Frederick and Nelsons. The sold everything from soup to nuts....clothes, toys, furniture and antiques, appliances, kitchenware, fine china and crystal, linens, fine art, etc. And food.....both already prepared food, imported goods, a bakery and several restaurants. The Bon was acquired by Macy's in 2003 but still remains as the largest department store in the area. Frederick and Nelsons was even larger than The Bon and a step or two up in both quality and price. And F&N was where Frango's originated. F&N was acquired by Marshall Fields in 1929 but always operated under the F&N name. It was a huge store...12 storeys and occupied a full city block. It had multiple restaurants, a fantastic bakery, a candy kitchen (where Frangos and other candies were made), a post office, beauty salon, infirmary, a daycare facility and a reading room. It was known for its fabulous, animated Christmas windows and was where all the best Santa photos were taken :-) It was a Seattle institution! It closed with the demise of Marshall Fields in the early 90's. Comments (35)Both of us retired. We have a chuckle every time we decide to get a quick late lunch or early supper out as in "does that place fall within our five mile rule?" That would basically mean 1. is the choice within a five mile (+/-) radius as the crow flies from our driveway? 2. how many over crowded and pokey school zones are we going to have to traverse at that time of day? 3. if it's rush hour then we don't want to be anywhere near the freeway (there are three close by) 4. is the food 'there' just barely better than slowly starving to death or is it something we actually look forward to? We actually have a relatively large choice of restaurants but relatively small choice of types of food within a reasonable distance from our house... the typical chain restaurants with the same menu at any given location within that chain, at least three different bar-b-que spots or more if you count the small ones in locations you'd never find unless you were probably lost and wandering around aimlessly while trying to find your way back to the main road, three or four Mexican sit down type restaurants (two of which are owned by the same person), several sandwich type places all of which are chain owned, more fried chicken places than I care to count, a few pizza chains most of which are take out only, hamburger joints, and so on. Most if not all have pretty decent food even if not necessarily imaginative choices. My eating out problem mainly stems from the absence of more home style or "diner" type restaurants where the choices, both main dish and sides, aren't limited to mainly one type of fare be that Italian, Mexican, oriental buffet, fried catfish and so on. Although I've eaten at them off and on for years, I was never a huge cafeteria fan but at least you had multiple choices of what to choose from on any given visit and if you wanted to eat all meat, all vegetables, all desserts, or simply have a cup of coffee or glass of iced tea and a cookie, it was ok. Not the greatest cuisine but at least you had/have multiple choices. My other issue is that while I go out to eat a meal, my wife eats very little per meal and so is not usually interested in going somewhere that she can't get a kid's plate or something small. To that end, one price eat all you want type buffets are typically a last choice for us unless someone else has decided the location. She willingly goes with me just about anywhere but overall, a small bowl of salad or a cup of soup and a cracker would probably suffice. So... we go out to eat regularly but typically, it's not worth putting a sticky note on the frig door to say "we need to go "HERE" again!!!!!!"....See MoreHere in Michigan, all restaurant's and bar's are shut down
Comments (42)We go out to eat rarely, and only started doing so a bit in 2019. 2020 stopped that, but we did order carry out a few times. And delivery a couple times from the one place around that will deliver out here- glad it's Chinese :) But driving around local into our little town. 1 of the 2 bars is closed. The other seems to be closed too, but looks like it's being worked on while it's closed. The two taverns of food and drink are still open. The few local restaurants are still open. Except one- it was a new branch of an existing restaurant that was slated to be opened in June 2020. It's still sitting finished, shuttered and yet to be opened. A couple places that are more open during tourist season look like they might not try again this year. Another one that is usually closed was chugging out the smoke, so someone is there- it's a bbq place :) But still closed for the season :(. And one place that usually depends on the tourist season and some limited winter hours for the locals has expanded a bit and is doing fuller winter hours to accommodate more carry out orders....See Moreannie1992
