Comments (10)We dealt with this (very common) situation, giving $4K back. Kirkhall is right... people think of this the wrong way. The money is coming from the buyer's loan, not the seller's proceeds (although yes, it cuts into the seller's proceeds, but without the deal being structured this way, the sale price would in all likelihood be lower, and so the seller's proceeds would be lower anyway.) It is not a gift. The buyer is basically saying, "I want to pay X for the house, but I need cash (for closing costs, furniture, whatever) so I am willing to finance more than X, and take cash back." This can get complicated for sellers, as they often (though not always) pay commission on the gross sale price (then it is their loss... but worth it to get the deal done) and the house has to appraise for the full financed amount, not just the amount paid for the house itself. I was just discussing this idea with someone, because I saw yet another listing where sellers advertise that they are offering cash back. That strikes me as kind of pointless unless they have naive buyers... this is something any buyer can ask for in their initial offer, as in, I agree to pay X plus $5K, and want $5K back at closing. When we sold a house we built we left a copy of the house plans. To give you an update, I haven't heard from the new owners in over two weeks, so I'm hoping I won't. I did talk to the man who did the inspection on their house, and they wrote him a letter asking for $4000 for repairs of things he didn't catch. I can't even imagine what they're talking about. The funniest (or saddest) part is that they never paid him for the inspection. The inspector said it's the most troubling thing that's ever happened in his 18 years of inspections....See MoreBuyer repair request
Comments (56)Juju, I'm glad you came to a good conclusion. Have they signed off on the repairs you have agreed to yet? If not, wait till they do before you do anything. When is closing? Personally, I think you got off easy, in that your buyers are being cheap and not hiring someone, who knows supposedly what they are doing, to nit-pick through the house. I just had buyers from hades that had a "professional" inspection, and came back with a list of 43 things they wanted repaired. It was mostly stuff like run a new bead of caulk between the bathroom floor trim and the floor, and stuff like that. But they went so far as to want all of the light bulbs and batteries changed out. Funny thing is that this so-called professional missed several bigger things that I was expecting him to list. The morning of closing, my Realtor called from the house at 7AM, and said that the buyers wanted me to dig up the hedges and gutter drainage at the front of the house and redo it. Um...NO! One thing that helped in me not having to do all of these silly repairs they had listed is something that my broker pulled out of the NAR sales contract. Inspection report repairs are only necessary if they are "in need of immediate repair". If something still has serviceable life, and is up to code, you are not required to fix it, per the contract. Having said that, it all depends on how much you want that house sold. Mine was an investment property, and I was ready to move on to the next one. Comments (22)Lilysmom...you need to look at the contracts used for your state. They all vary. Many use an inspection period/termination option period. They give an option to terminate, depending on which you have in your contract. I was in the car business for 12 yrs, in tx, nm, and fl...we often had people think there was a 3 day right of recision on cars. There wasn't for those states, or most if not all states. You can Google your state for more specific laws on the right of recision. In general, it's only on products bought thru door to door salespeople, or on Refis on a primary residence...not a vacation home/investment property....See MoreC Marlin
