Can I break my lease due to false advertising?
Comments (5)I doubt you could break your lease for them calling it "quiet" but maybe. If you were going to pursue that you should probably consult with a lawyer and check up on the local housing rules (especially those that allow for "quiet enjoyment") that apply to you. I'd be afraid the judge would point out that you should have checked to see where the complex was situated before entering into a legal contract to live there. It's probably easier to just move when the lease is up. Also - this is probably not the sort of thing you want to hear, but you can get used to living in that sort of location. It sounded like you were describing my complex. The building i live in is right next to a busy rail line (in fact there is a switching station right on the other side of the parking lot which means traincars banging into each other among other loud noises and vibrations). In addition, our complex is under one of the approaches used to get to Tampa International a few blocks away. Low flying planes are very noisy, and the air corridor above us is high traffic. You do have to occasionally pause a conversation or program when it's especially noisy, but for the most part it fades into the background after you live with it for awhile. And as noises go, i'd much rather have this type of impersonal, environmental noise than the sort of noise i've always had before from other people's bass, arguments, banging, stomping etc that always bleeds through from other apartments. Of course, the neighbors here aren't any quieter than my old neighbors, but the airport and train traffic mean that there is a lot of white noise to disguise the neighbor noise. Comments (6)I'm pretty sure she knows that it's way too loud. She doesn't actually believe the maintenance guy is racist, if she does then she needs her head examined. I think she's stalling because she doesn't want to kick out paying tenants. I've actually tried to arrange something with the manager, because my neighbors usually start up around 6:30pm, half-an-hour after the office closes and all-day on Sundays when the office isn't open at all. The problem is, the office is usually closed by the time I get home from work. Tuesdays are the only days I'm home before 6pm and I think they've caught onto my pattern because she's always busy now when I show up and she's off on Saturdays. I've left messages with her assistants but she's totally dodging me. I sent an email to the regional manager last night, I don't have their phone number and can't find it for the life of me. It'll probably be a week or so before I hear anything back. As for my neighbors, they're friends with the people who live next door to them. The guy who lives above them is deaf (I'm not joking he's actually deaf). The woman who lives directly across from them works evenings and doesn't get home until midnight, but she actually told me that she can sometimes hear their television in her living room during the day, but she doesn't want to get involved. I think I can work on her and she might be willing to talk to the manager, if I can ever get a hold of her, but I still don't think my manager will do anything. I had a one bedroom apartment in another group of buildings owned by the same complex, but the problem with that unit was not so much students, my neighbors in fact were all working people, but the fact that it was so close to the expressway that runs near here. The traffic noise, especially trucks, was constant. I have been on a list to move to apartments that are rented only to professionals. I finally got in and moved in a week ago. I took a two bedroom, which has a washer/drier in the unit and it gives me more room to set up my office in the second bedroom. I really love the place. The only noise I get now is hearing some foot traffic from upstairs, because these apartments are stick built. But compared to the traffic noise, I will take that any day! Most of the time it is very quiet. This is a university town, and most of the apartments in the area rent to students. In this unit, I have a very nice patio and even a little area where I can put in a small garden. The unit does face the parking lot, but it also is bright since it faces south. I have met most of my immediate neighbors. Nearly all of them I have met work at the university, or are retired. So we have both working people and retirees here. Nice and quiet. What traffic comes by on the avenue through here is a tiny fraction of the expressway and no big rigs! I love this place and I am happy. Anyway, I am glad that your move worked out. Comments (5)I am assuming you have propane tanks that are filled by a company who leaves the bill on your door or has the management do so if the lp guys cannot get in your building. It is possible that someone got access into the building either by talking their way in with one of the tenants or sneaking in as someone was going out, and left the flyers on all the doors. Or maybe someone who lives there did it without knowledge of the management. Or maybe they did do it..... I would just toss the flyer and be glad that you were informed about this particular political candidate's campaign platform so that you did not accidentally vote for him come election time. If you do wish to bring it up to the management company, first ask if they did leave the flyer. Then thank them for informing you about the candidate's views and let them know that you will use the info from the flyer when you vote.
