Comments (37)you have gotten a lot of good advice already, my place would be what I want and my morals..personally. and also their attitudes..i guess. if they are demanding you fix it cause their dogs are no longer contained..that is not right. It is their dogs that they wish to contain, if your animals or livestock were roaming in to their yard and doing damage then they would have some right to complain, but if their tree damages a fence on the property line..why do they have a right to complain in the first place. are there survey markers..is the fence on the line or inside your side? when we had the property suveyed, we on purpose put our fence inside of the property line about 1/2" so that no portion of our fence was on the neighbor's property..thus it was OUR fence and we maintain it..if it is a shared fence then it should be equally shared by both properties, including expenses.. unfortunately people are responsible for the damage that their trees, or dogs, do to other people's property, however, the ICE may have been the damager not the tree..so it might have been the liable party. can't bill the ice or expect it to do repairs.. if the tree was dead or dying that is a different story..but if it was just storm damage, it was just that storm damage..either you or your ins are liable. if you don't trust someone else to fix it right or you want it done your way, then do it...make it clear to the neighbors it is not doable until the ground can be properly worked for the posts..that they can put up a temp restraint for their pets buy buying a few boards or some wire until it is fixed right....See MoreNeighbor buried his dog fence on neighbors property
Comments (32)For the life of me, I couldn't understand why anyone would even be motivated to move their wires so far in to adjoining properties, because that would allow their animals to be in somebody else's property and if those adjoining homes had any problems with the animals being there, it negates the reason to even install one. I Googled around about those underground fence systems, and found some manufacturers state the perimeter area has to be at least 500 feet, or they may not work properly. On a smaller city lot, I can see where some people who wish to use them don't have enough ground to do a proper installation. OK, so that's probably why they trespassed their system so far in several directions. If they got permission, that's one thing. If they didn't, I wouldn't trust them any further than I could throw an anvil. What else would they do, to make life more convenient for themselves? There are wireless systems they could have used, but those are more expensive. So, they save a few bucks by using somebody else's property? It's a danged shame when folk have to worry about what presumptive people like that think, or worry about feuds or retributions. You shouldn't have to pussy foot around and send anyone anonymous letters to inform anyone. If the folks who laid the line were forthright and honest, it wouldn't make a difference if you told the other property owners because they'd already know. Comments (49)An older thread, but I guess it's been a little slow as it wasn't that far down the list. Pinkpaula notes that the fence is built in accordance with her area's codes. These regs will vary by city and perhaps neighborhood. In some areas a fence wound need to adhere to a setback to allow for maintenance without trespass onto the neighbors property. In other areas there is a maintenance easement parallel to the property line to allow for this (unlikely in a neighborhood that old). From the description it sounds like the kind of neighborhood I grew up in. It wasn't uncommon for a driveway to run between two houses or for two drives to run parallel. Most wouldn't allow for opening the car door until you were past the house. Down the block, one neighbor A built a fence on the property line only to realize neighbor B's driveway was too narrow for his pickup truck. Neighbor A ended up taking out a section of the fence in the back, neighbor B would use neighbor A's driveway and cross over. Will it effect the resale? Since that's what most of the homes in the neighborhood will have to deal with than it shouldn't have a major impact. Your comparable isn't a house on a big lot and a big yard, it's the other houses in the neighborhood that are close together. The reality of this situation is that if you can't open your car door while in the driveway it's likely that you couldn't have gotten out of your car without trespassing on your neighbor's lot to some degree. With your backyard and garage it sounds like you're fine, but your guests aren't. I'm with Kaismom on this. If fences are allowed on the property line in that area there's no reason for him not to put it there. He didn't want to sell part of the land, that's his call. Comments (17)I told my neighbor that if he can wait to put up a fence until after I closed on my home I wouldn’t mind going half with him. Not put up the fence before I closed and not include me on the fence plans, type of wood, poles etc. After I moved in he didn’t approach me for money directly, we used to talk on the phone here and there and I offered to help pay some of it and asked him for a figure or an invoice. He never did that until this week when my new fence was put up. HIS back fence has been up since late 2017. His wife also complained to my fence guy that my top trim was on top of their top trim. I WENT AHEAD AND PAID MY NEIGHBOR $800 because it was never about the money for me. After I paid the money we had a long conversation and I told him if he had an issue he should’ve given me figure a long time ago. He thinks he’s being generous because he only asked for $800 and not more since the back side cost him $3300. Mind you he didn’t get the regular poles that most people get. His are black aluminum or material which I think costs more. It’s 150 feet of fence and $800 is a small price but IMO I’m being generous because I’m not lawfully obligated to pay anything when he decided to do the fence on his own. Could he tear it down one day? Sure. My only issue with this is why he waited so long to request money When I asked for a figure almost three years ago. He thinks I should’ve taken the initiative and brought It up to him again. If I ask someone to go half with me and they say they can’t right now and I go ahead and put up a fence I’m not going to ask for them to pitch in. It’s important to note that I recently bought a ”new” used car. Nothing fancy but it’s new to us. I’m not sure if that bothers them that I have money for a new car and a fence but never helped pay for the back fence that we share. Sorry for the long read....See MoreHALLETT & Co.
