eBay shipping help please

I sold and shipped a piece of Dept. 56, the first of this week, to a buyer in MI. I packed it securly with every piece of heavy styrofoam we had in this house. All total, it had 3" of foam surrounding it and it was packed tight. My buyer gets it and it's busted to pieces. GRRRR! Anyway, I've never had this problem before. The piece was insured but now what do I do? And, who eats the shipping charge? Me or the buyer? I'm just heart sick about this as is my buyer. Any advice would be appreciated. PS: She did send me pics of the damage and there was a sticker on the package when it arrived in her town's post office saying that it was "received possibly damaged". Well YEAH!

Your buyer has to take the package and all of the padding to the PO for determination it was packed securely.
The following is from a recent Packing and Shipping thread.

"It is the buyer's responsibility to take the damaged item along with all packing materials to the post office. Please remember to take a copy of your invoice showing payment. You will need to fill out a claim form. The post office will reimburse the buyer for the amount paid for the broken item. You will not be reimbursed for the shipping or insurance costs. The seller doesn't have the item to take to the post office in the first place. Once the item is in the hands of the post office or any shipper, the seller is no longer responsible for the item. They no longer own the item. There is no way the PO would reimburse someone that didn't own it. Postage will not be refunded by the PO."

Geez, what a nightmare. Why can't people just be honest and treat others like they'd like to be treated? I just don't get it, it's not that hard. I really wanted to bid on some beautiful RL bedding, a rare style, but I really had to read between the lines and push to get info. Apparently with the shams the seller mentioned although never used, she did launder one "by mistake", but it went right back in the package. Saw no logic in that whatsoever... Since it was cotton and lace (delicate), I wondered if she dried it (which would ruin it). I emailed her asking if the washed sham had been distorted or shrank as a result. No reply. I wait a few days, auction is nearing and end, and basically email her a 'hey, I'd really like to bid, but have not received a reply to my question so I'm giving it one more try here.' That generated a response from her, she admitted that the laundered sham was 'snug' and corners 'curled', but suggested ironing would make it fit properly again. Good grief. (She failed to include that significant detail in her description, even after I asked, she didn't post my question and her answer.) Very cat and mouse. I'm glad I took time to push it, because although it was a beautiful set I might well be out the $, and it would be worthless with only one good sham (and it garnered pretty high $$). I'm watching to see what kind of feedback occurs once the buyer receives it. Anyway, back to valinsv's guy. Clearly there are major issues with some items he sells. Is he too ignorant to realize that having integrity would only bolster his business that much more? That's the part I just don't get. Treat people right, they'll keep coming back. Treat them badly as a habit and sooner or later he's going to lose. Seems to me with the type of volume he does he'd be a lot further ahead if he'd just be honest. Just curious mona if you might know: if he does get kicked off, is his IP address banned, or just his ebay ID? He seems to have such a huge system set up and selling high volume, can't see him just walking away. Could he just come back under a new ID? (Although given his business and volume and listing style, it would be easy to recognize it might be him.)

Just wanted to add that where I suspect there was a scam (in fact I might even call it fraud) is in regard to Greyhound and insurance. He insurred each chair for $300 and from the sound of it, was assuming I'd make a claim through Greyhound and get reimbursed for the cost of the chair plus have one functional chair. He did not bet on my taking it to a antique furniture restoration store (which I might not have except that I needed to get my dining room chair fixed) and that person telling me that he saw these types of things all the time in insurance claims and said and put in writing that it was clearly not shipping related damage. When I spoke to Paypal they said this is the type of information they look for when handling a dispute. Now my other issue is if I send it back do I insure it (it's my understanding that Greyhound will insure for $300 for no additional cost). There is a page where the cost of the item is declared. For the damaged chair, I want to declare a cost of $0 since I want to prevent him from filing a Greyhound claim on return. FOr the other chair DH and I were discussing 1/2 the cost I paid--about $100.

another_linda - Both good points to consider. Thank you! ideefixe - I never said that I thought the print was an original. It was sold as VINTAGE (not an antique or "the real thing.") As I said, the print is probably from an older Temple of Flora book and was then framed in the 60's or 70's. While older prints from books can be worth a little money, the new reproduction poster prints (that are mass produced and sold these days,) are not worth the paper they are stamped on. I occasionally check eBay for Thornton listings. I bid on this print, because I liked the way it looked in the photos, and thought it would make a nice addition to our home. Plus, the price was reasonable! I really didn't expect it to have any more value than I paid for it. The reason that I am not happy, is simply because it is not in the shape that seller suggested. A Print is the correct word to use for a reproduction. The originals are called original paintings, oils,water color, engravings, plates, etc..) We had original plates. From the dictionary Print - A design or picture transferred from an engraved plate, wood block, lithographic stone, or other medium.

I had the same thing happen with the exception of the mark on the package saying it might be damaged. Seller contacted me and said one of two items was broken (she did not send photos) and that she would not have given me as much money for the item if she knew it was broken (she said she thought I shipped it that way, but she wanted to keep it) That was when I told her the item was insured I never heard any more. I think she was just looking for her money back.
I insure everything now but don't tell the buyer. Posted this so others would know to be careful.

I insure the item for the cost of the entire article and the shipping included...it's usually the same for the first 50.00 anyway...When I made a claim to the P.O. on a broken article I got from ebay in Jan...I got back the price of the article and the shipping costs!

Just instruct your buyer to take her entire box and a receipt if you gave her one to the post office...I'm not sure how long she has to make a claim but it's awhile...maybe 6 months!

Don't you wish you knew what the post office does to our boxes...they must play football with some of them...All in all they do a great job though...I shipped 93 boxes in Sept and only one thing got broke...and nothing has ever been lost!

Good luck with the post office. I once went to them with a broken delivery, a gl;ass pitcher that arrived in pieces. They said insurance is for actual delivery, not the condition of the object inside. I buy lots of items on Ebay. When shipping something fragile, most dealers will put it in a small box, then cushion it inside a larger box. Sorry to give you bad news. It may not have been adequately boxed in the first place.

And Summer, clearly state in your listings that shipping is non refundable in any situation. If you don't say that, the buyer can sometimes win their shipping fees back through Ebay's dispute resolution.
Too bad about your Dept 56 item.

PayPal's dispute resolution does not refund shipping fees unless your dispute is that you never received the item at all. If you received it, no matter what the condition, you have to return it and they make you do it with a tracking/tracing number -- at your expense -- and you only get back the cost of the item, without shipping charges. AND they don't even guarantee that they will be able to "recover" the full cost of the item for you.

In other words, the PayPal guarantee is pretty much worthless.

Thanks folks, I really appreciate they suggestions and advice. So far I've emailed the buyer and offered her back her shipping charges and I also scanned and mailed the Insured Mail Receipt that she needs it to take to the PO to make her claim. I'm just sick about this.
