Do you mind saying who the seller was? In reading through a lot of the feedback, are there hints of others getting 'small' shoes that did not fit? I wonder if maybe the seller is selling 'fake' stuff.

When in doubt, I just choose to leave 'no' feedback...or you could leave a neutral (or negative) , saying "The Chloe shoes were not even 'near' true to size." That would then give future buyers a sort of 'heads up'

According to Zappos a size 10 would be a 40.

You could always leave neutral feedback. That won't count against the seller, but warns other buyers that the shoes run small.

I would think this one is on you. As a buyer, you knew there were no returns. It was up to you to research that brand of shoe and know if they ran true to size before you ordered. Assuming the shoe is not counterfeit, then you got what was advertised.

I am a diehard Ebay buyer, but I learned the hard way - I don't buy anything I should be trying on.

I also think this one is on you. You bought it without trying them on, assuming any size 10 has the same fit. PLUS the seller told you upfront no returns.

Personally, I've been disappointed by a couple of things I purchased on Ebay, but the fault was really mine, not the seller's. It wasn't false advertising, I knew the conditions of purchase and the seller delivered. So I always left positive feedback because the seller did his part, I just should have been more careful.

You are not obligated to leave feedback. If you feel less than satisified, leave nothing and let it go.

Chemocurls post got me thinking--what if the shoes are fake. I searched and could not find the same shoe to compare it to, but I did find a ton of sites selling repros which scares me. So I emailed the seller asking for authentication that the shoes are genuine, like a receipt or at least info as to where they were purchased. I told her I would re-sell them on ebay and do not want to sell a replica. Her reply will most likely tell me what I need to know.

I agree, Sleeperblues, a few years ago I bought a Geiger jacket, I have many geiger pieces and know what size I wear. When it came it was at way too small, and from feeling the fabric I think someone had laundered it. Boiled wool doesn't wash. I was furious but gifted it to a friend who wears a size 2. I left no feedback.

There is no such thing as no return in ebay. If the seller takes Paypal, then they do take returns. What you will need to do is file a SNAD (Significantly not as described) claim and mail the shoes back to her using delivery confirmation. Once you can prove that they were received back, you will get your money back. Using paypal to claim rather than an ebay claim is the better way to go. Ebays claims are still in the growing process. That is assuming that you did pay with Paypal.

It could be that the factory mis-sized the shoes and that is why the seller was able to get them.

What was significantly not as described? Did the add say size 10 and the shoes are marked Size 8? I don't like to use Paypal to hound a seller just because I didn't get what I THOUGHT I was getting. Unless the seller didn't ship or the item was marked Mint and it was all beaten up, I wouldn't file a claim with Paypal. Yes, they might give you a return, but was it really honest? Brings to mind the photo processing thread.

As for counterfeit goods, that's a risk you always run with Ebay. Look at all the pirated DVDs that are sold, counterfeit Coach and Dooney bags. There's always a risk you are buying counterfeit if you don't buy it in the actual store.

I recently had a similar thing happen to me. I bought a pair of Not Your Daughter's Jeans (NYDJ). I already own five pair and know exactly what size and style I like (straight leg Marilyn style). When an eBay search came up with exactly what I wanted I did not hesitate to order them. It was my third such NYDJ purchase from eBay.

The NYDJ arrive and they fit perfectly but ... they were not Marilyn straight leg, they were flare legs and the denim material was significantly thinner than a real pair of NYDJ. I wrote and asked to return them for a refund as I dislike flare jeans.

The seller wrote back that it is stated "no returns". And I replied that she was not correct in her advertising. She replied that she needed the money for something important so would not consider refunding me.

I'm sorry, but please do not tell me that *your* money is more important than *my* money! Grrr.

After 12 years of buying on eBay, I left my first negative feedback for this transaction stating it was not as advertised and possibly not even genuine brand. I was contacted by eBay a few days later asking what the issue was and I told them. A few more days later, eBay wrote me on a Monday that I had until that Wednesday to mail the jeans back to the seller for a full refund. Due to projects and meetings at the office and such, I couldn't get to a post office until Saturday so there was no way for me to meet that short deadline. So I now have a pair of expensive flare leg jeans that I do housework in. :-)

Sellers are NOT allowed to put no returns if they take Paypal. If you report their listings for that reason it can be removed. There is no such thing as no returns. If you frequented the miscellaneous answer center like I do daily, you would know that.

A size shoe labelled as size 10 but is way too small is significantly not as described. They may say it is a size 10 but it actually is not. My guess is that it was mislabelled at the factory. Sleeperblues said that the shoes weren't just a little small but way too small. Often sellers get seconds and this is probably the case here.

Learn how to create a return policy. You can set the time limit etc. but the buyer has 45 days to start a claim regardless of what the seller says. The buyer has to return the item on their own dime unless the seller agrees to pay which some do if it was their mistake. They need to get delivery confirmation so that the seller can't say they never received it back.

Yes you can set up a return policy but what you set up doesn't mean squat to Paypal. 99% if the time the buyer will win.

Heather, I don't see anywhere on the US eBay site that says you must offer returns if you accept Paypal.. I've been selling on eBay for many years too (although not much lately) and have rarely chosen to accept returns.

Are you on CA eBay? Maybe their rules are different?

I was under the assumption that everyone needed a return policy but that "no returns" is a policy. I don't do enough business to know if that's right, but I wouldn't try to return something that noted no returns unless it was "grossly" misrepresented.

I believe PayPal offers protection if you don't get items or you get a grossly misrepresented item. If the shoes you have are marked with a 10, I would "not" think they are misrepresented.

Just because they fit your feet more like an 8 or 9 doesn't really mean anything. All 10's are not the same. Even within the same manufacturer, you may wear a different size for a different style. A seller can not and generally should not guess or state that a 10 shoe fits like an 8 because that may not be the case for everyone. If she says they fit small and they don't for someone, then she's out there too.. and she can't really win. The size on the shoe should be the one noted.

Bottom line, you are taking a risk buying shoes online and not being able to try them on. When I go shoe shopping, many shoes my size don't fit right. Just saying...

If you find out they are fakes, of course, that's a different situation and you should get all your money back.

"No returns accepted" is a return policy.

If these shoes were advertised as a size 10 and the OP received a pair marked size 10, then the shoes were as described in the listing, IMHO.

When buying items off eBay that depend on fit and size, it's a tricky thing and hit or miss unless the seller is being deliberately fraudulent and I don't see this in this case.

I'm sorry, but I believe you have bought, and now own, a pair of shoes that just don't fit you.

I say as monablair did, unless the shoes were not as escribed in the listing, you should just accept the responsibility. I would never buy shoes or a dress or something that you would normally buy and try on.

Could you go to a store and try on the same shoes and see if they fit? That would settle whether or not the shoes were actually a size 10.

I agree that if it was stated they are a size 10 and you received a size 10, they are your shoes. I try to be very precise when I list things on Ebay and when buying it's a risk you take that something will not fit. If it were me, I would just relist them and sell them on Ebay myself. No sense keeping a pair of shoes that don't fit. And I would not leave negative or neutral feedback. You got the item that was stated. If anything, don't leave any feedback. I have perfect feedback and would not want someone to leave me negative in retaliation for me leaving negative feedback.

On another note, I have had two non paying buyers in the last two months. What's up with that. I hate to put a disclaimer if you don't have at least a 10 feedback, don't bid. One of my buyers had zero and the other had six. I've seen auctions where people state if your feedback is less than 10 to contact them before bidding. Why? What can you do to guarantee payment?

I have perfect feedback and would not want someone to leave me negative in retaliation for me leaving negative feedback. Angela, sellers cannot leave negative feedback anymore... they can only leave positive feedback. They can leave a negative-positive though (a negative comment but showing as a positive). Ebay will delete those though if you bring it to their attention.

I don't think the newer feedback rules are fair to sellers. Someone that doesn't pay deserves a negative feedback IMO. The non-paying buyers can get strikes against them.. but they have to have I think three in a certain amount of time otherwise they can just go on bidding and winning and then not paying if they change their mind.

When I sold a few things several years ago, I always checked the record of the winning buyer, just so I could steal myself if some freaky business went on during one of his/her previous transactions. I never had a problem, but if I'd seen that, say, someone claimed the item never arrived, I would have encouraged the buyer to pay to insure the shipment.

Now to the shoes issue: Can you take the pair to a place that you know sells the real thing, compare the sizes (for that same exact shoe) and also compare the shoes to see if there's anything fishy with the eBay ones?

As has been said already, clothing even in the same collection can vary in fit, and shoes, too. Returns are so very important on these--whether on eBay, from catalogs, from websites.

Unless I am 150% sure on something, whenever I see "no returns," my antennae go up and I go someplace else.

I'm sorry, but I think you're stuck unless you can verify that either the size is mismarked on the shoe (and even then, the seller might not have been aware of that) or it's a fake that was advertised as the real thing.

I wouldn't resell it on eBay. Because how are you going to advertise it? How are you going to prevent making another buyer go through what you are feeling? Some people could live with passing along their bad luck. Hopefully you are not one of them.

But I would try to sell it through your local Craigslist--you could meet someone in a parking lot of a large store, someplace safe, and they can try the shoe on. And if the shoe doesn't fit, it's not a big deal. If it does, you've made a sale without being underhanded about it.
