Management called to see how I was doing!

She gave me the claim number, the 1-800 number to call and the company that manages WM claims---CMI

I'm taking in all your responses and YES I am keeping a journal.

Am on anti inflammatory, iced for first day, now heating pad. Sliding off bed, being very gentle with myself.

Friend is going to WM to pick me up "stuff" to eat and will be here shortly to visit with my goodies.

Just thought you would like to know they DID call!

Wow, I guess they don't want a big lawsuit. You really need to watch every public area you go to, especially restaurants and hospitals. You don't know how many of us nurses and our patients have fallen from slipping on something in the floor. I did the splits once running down the hall to help a patient, slipped on a cleaning wipe someone left in the floor.

A friend/coworker, slipped a few weeks ago on a patient's urine in the hallway. He just decided to pee in the floor, she went to help him and down she went. Everyone thought she peed per pants when she fell. LOL! Funny now, but she could've really been hurt.

I've also had near falls in so many restaurants too. Haven't fallen yet.

I'm glad they called you. I hope everything goes smoothly and I'll watch out for aisle 7 when I go for groceries Wed. lol

When one WalMart is bad, do not blame all of the stores. Period! I work at a WalMart store in Oklahoma and its currently the largest Supercenter store in the state. Yes, thats right, I work in the Pets department overnight. This is a really tough decision on my work hours. I like working at nights, because it pays more, but I want to work during the day, because I want to be around more customers to teach them more about fishes. I stock the Pets department, but I do assist customers with fishes. Its a real challenge, because of right now, I am basically deaf without the use of my hearing aid and all my life, I've been wearing my hearing aid and was able to hear great as other people can, but there is a problem right now in my ear, so its tough. I can speak to people very clearly and I try to read their lips and when neccessary, I have them to write down on paper. All stores that sells fish are bound to have a dead fish here and there... thats perfectly normal. One night, this customer was an idiot, actually very rude somewhat. He wanted the entire tank of a specific fish that cost 5, 10, or 15 cents each (cant remember at the moment), so I went ahead to net out all of the fishes, but let one fish in the tank, because it had some kind of fungus. I told him that the one fish is bad. I went ahead to prepare the fishes into the bag and while I was doing that, he went ahead and netted the sick fish out and I tried to tell him, but he wouldnt listen and he put the sick fish in the bag. I went ahead to tie up the bag and note the price and amount of fishes, but I did not add the sick fish to the total price. While I was doing that, he went ahead to net up 4 dollars worth of goldfishes that costs 15 cents each and I told him that I will do that. He wouldnt listen and by the time he was finished, I prepared the fishes into the bag and then he went and got some more and put it in the bag. I tried to count the fishes in total and estimated it to be 50 fishes, which came to about $7.50. He wouldnt listen to me and he wanted things his way. There was this one night, I spent nearly an hour educating a lady on fishes and tank care. She ended up on picking two fancy goldfish and the alage eater that sticks to the tank glass. After everything was done, about an hour or so later, when I walked by the fish tanks, I noticed two bags in the sink. I was shocked, she changed her mind at the checkout. Made me furious. Its alot of stress a fishes to net them out and bag them. Another night, this guy wanted several fishes, which was divided up into two bags. After all was done, he came back about 15 minutes later, saying the prices on the bags came off, so I wrote it on the bags again. Later that night, my coworker brought the two bags back and dumped the fishes back into the tank. What is wrong with these customers?! Anywayz, I still work there and I still enjoy educating people on fishes and tank care. Just because there is a lazy associate at a store, the entire company should not be blamed. Its very simple to talk with the store manager about whatever. PetsMart is a good place and they have much more selections. WalMart is good, but not enough selections. Petsmart is generally more expensive but there are some fishes here and there thats cheaper than WalMart. There are PetCo stores in this state, but I have no clue where they are. I've seen commericals, but they failed to show the locations of the stores. So, I have no clue about PetCo. Anywayz, all of these stores sell good and healthy fishes with top technology fish tanks. It all comes down to the services of each associates for each stores.

Excessive popups from reputable sites is an indication you have malware on your computer. Do you have a firewall? Run an anti-malware program like Spybot Search & Destroy occasionally along with an antivirus program both with updated definitions and it'll go a long way to help stop that stuff. I use Opera and don't have issues with popup because they were the first to have an effective blocker built in and it's still the best browser IMO. Joyful, yes it was a real learning experience. Interesting to see the different parents too. Some admitted they didn't know what to do, others beligerant (how DARE you tell me how to raise my kids!!!) some got a kick out of it and more. And it really varied from area to area. *That* was a big surprise to me. Some small towns had a real snob attitude, surprisingly. Areas I thought I'd enjoy working were awful. Areas that I was nervous about were a joy. Even worked International Falls, where a lot of Canadians would sneak across the border to get my services! ;)

Jannie and Nicki, I also have to say thanks. I too am far from perfect in that I've said things that I've regreted. And often. And I love my children so much that I rushed out of the house yesterday with tears in my eyes because an ambulance was at the end of our block and my two older girls were playing next door. Thanks goodness they were okay (an older neighbour had been hit by a car on his bike-he's fine), but I was weak-kneed and shaky. I have ALWAYS wanted to be a mom and I LOVE, LOVE, LOVE them- but sometimes I crack. I experienced the single mom lifestyle for four months. It took ages to sell our house and Jason had to start his new job before it sold. During the week it was just me doing everything for my three girls (ages at that time were 7, 4, and 6 months). Helping with homework, nursing my baby every few hours, trying to play with my pre-schooler, making meals, walking to the bus-stop, EVERYTHING and all of it on only a few hours of disjointed sleep. It was winter and the second night we started doing this the furnace died. It was -27 C that night, none of the so-called 24 hour emergency repair places would answer, and I was frantic. I piled every blanket on the older girls and tried to sleep with Evelyn on the couch while both her and I wore toques. I needed to sleep on the couch because I had the oven on full blast with the oven door open for warmth. It was a crappy night. They fixed it at 1pm the next day. I also dealt with a toilet that wouldn't flush (and I'm not handy) and a four hour power outage which again was when it was -20 something C and freaking cold in the house. I had no breaks (except for the weekend when Jason would come back home) and no time to do anything that I wanted that was just for me. It was stressful and horrible and eroded most of my patience in the first month. I yelled at the kids and occasionally screamed at them. I explained to them that it was just me and they needed to try to help me out by getting along. Well, they are after all kids and they weren't helpful for that long. I would have been absolutely horrified if anyone had heard me and judged my parenting and love for my children at one of the worst times in my parenting life. We have been all together for four months now and I still yell. I'm working on it. My middle girl is exceptionally spirited and we clash. I'm working on being a better mother everyday. I just hope that the next time someone overhears someone else saying something mean that maybe they will stop and think about all of the background story that may be present. There is often much more to the story than you may think. I hope that by sharing my story and point of view that I won't become a KT outcast because coming here is such a bright spot to my day. Ditto on Joan's comment about the Shingle's vaccination. I'm surprised they have you on heat instead of ice, but regardless, I'd ask if it is OK to take an OC anti-inflammatory - like Advil or Alleve. You may not get much progress for a couple of weeks, so practice patience on this one. Since you are active with water aerobics, you are in a better situation for healing than someone who is sedentary. Can someone other than DS bring you supplies? Best thoughts!

Has anyone ever filed a claim against a large corporation such as WalMart?

Glad to hear they called- means they reviewed the security camera tapes & knew the fault was theirs & you were not some 'slip 'n fall' scam artist after big bucks. I'd caution you NOT to settle until you and your Dr. are certain you're FULLY recovered & without residual effects...once you cash their check you'll be liable for further medical bills. Business insurance carriers often settle in what are known as "Friendly" lawsuits...meaning they're accepting responsibility for the accident.

Successful suits against a company as huge as WalMart takes very, very high powered attorneys & years to get to Court-

Be careful of what you what you tell them.
Sorry to be cynical, but someone engaging you in "how your day was" or "what you did today" is not necessarily innocent.

susanjf, what compensation did your mother get from Dillards?
I'm not one to sue sue sue, but I do think I need compensation for my pain and still suffering!

Any advice? I sure need it!

The settlement should include: pain & suffering, any expense incurred due to injury - any medicine, prescription and non-prescription, aides as heating pad, ice packs or whatever including bandaides, any person's time or expense, including gas, to assist you, any limitations or inconvenience caused by the injury. Then how will this injury limit you and for how long? What future expenses? Will this injury in any way effect you permanently? IE arthritis will set in due to injury as s commonplace.
I'm sure you will be contacted and asked, "how are you doing"? You do not need to go into any detail but to just say you're in pain, have to take medicine and require the help of someone. All true but does not ope the door for them to sy on such and such date you gave the answer you were doing fine.
If they get pushy and offer a low amount to barely cover your expenses, tell them NO, you need to talk to your attorney. You didn't say you would, only felt the need.
Keep in mind what insurance has paid. They will subrogate Walmart insurance for anything they have paid. Usually, settlement is about 3 times your and the ins. companies expense combined for pain and suffering. Alabama does not have a cap so that is not a set rule. If any problems with them, call the state insurance department. They can't advise you legally but can assist if the insurance company is being a pain about a fair settlement.

They will most likely send you a check with something written on the back saying signing this will release any further claim.

Do not be quick to settle.
At this point, you really do not know what your full expenses will be. Walmart/Walmart's insurance company wants to make this go away as quickly as possible, so that the pay out will be less.
If you require PT for any length of time, the bills could really add up. Once you settle, you can't go back for more.

I currently have a claim against walmart. i slipped and fell and injured my back and i need spinal fusion surgery. It has been three years since my injury, and i have been in pain ever day since. Walmart said they were sorry they should of put warnings signs up that the floor was wet . And they are not paying for anything incurred from the injury. I filed a lawsuit 2 years ago and im still waiting for trial.
