should we ask for compensation?
Comments (15)I think you should post the name of your KD and their shop. They sound wonderful. I am doing Omega Custom throughout the house. There have been a few dings, a couple broken doors, and a couple pieces received that just weren't what we designed/ordered. In every instance Omega with the proding of my KD of course, has put the replacements on their top priorty list (since it's all built for me it's all custom and not line stuff) and they've put them on a plane so they don't hold the job up. I paid through the nose for this service after having a HORRIBlE Karmen cabinet order come that had dings and dents on EVERY cabinet. I'd paid credit card, and received it all back, but it was a bit of an issue and the KD there...she was useless. I would keep the water smooth. No remodel is easy, yours included, but they're trying....See MoreLONG! Builder possibly bankrupt
Comments (39)We are in Iowa. I will look into that contractor recovery fund. That would make us feel better about all this. If we walk away, we will lose our 15k. Actually we've pretty much already lost our 15k. It went to the builder (who's now bankrupt) and the bank says it went towards the build. So we're already getting a 'credit' because otherwise the banks investment would have been $340k. Gee thanks bank. But still, walking away may be our best option unfortunately. I'm trying to take emotions out of it, but the lot is in a secluded neighborhood surrounded by 13 acres of woods. The lot itself is 1.5 acres and most of it will remain timber. It's very unique and not something we will find elsewhere. I know someone will finish the house and live there even if it's not us. That would sting a bit. But also trying to be rationale that I don't want a lemon of a house and definitely don't want to be broke to do it. The excavator only has about 50k into the project. Not sure how it would make financial sense for him to buy it and try to make back his money and a profit. I guess we'll go about getting the numbers to see what it will cost to finish. But I'm afraid to make it viable, we would have to offer the back around 220k or so for the house. A huge loss to the bank, however if they build it themselves with no prospect of a buyer (it's in a small town, over an hour from large cities), they may lose even more....See MoreHelp! DELAY AFTER DELAY on Lowe's kitchen - Final payment due on CC!
Comments (10)Well, here we sit again....cabinets delayed another week. Have e-mailed Lowe's store manager on 2 weeks ago, again 3 days later re-forwarded the e-mail saying I thought he may have missed it over the 4th holiday and then again one week ago. ZERO RESPONSE. Z-E-R-O! Can't believe how unprofessional this is! I get it people are busy but to just not respond to a customer who has spent $30,000 in your store! And my contract said all work would be done by early April! It is now mid-July and this part of the installation MAYBE will be complete next week, then after countertops are installed (another company) there has to be more measuring for some decorative panels that they suggested we don't measure for until after countertops are in. After a call to Lowe's corporate in which they "escalate" the situation and said the store manager will get this "Urgent Customer Care" email and he must respond within 24 hours....still NO response! UNBELIEVABLE! So have put in another call to Customer Service and now they escalate to the District Manager and I am supposed to hear from him within 24 hours. And by the way, Lowe's Credit Card (Synchrony) said that it just takes a call from a Store Manager and they can push this final payment out and extend the promo (6 months same as cash) on out beyond the original 6 months. I have pretty much done EVERYTHING else myself since I placed the order with no communication from their "install manager" or kitchen designer. I communicate with the installer directly now since the install manager also can't seem to return a phone call or place or follow up on the incorrect orders that keep getting placed. I communicate directly with Schuler (their Customer Service has been phenomenal!) to correct orders that are placed incorrectly---even after going over it several times and putting it in e-mails. Cabinets ordered the wrong size by and inch (at least 5 times), finished ends ordered on the wrong side of the cabinet, etc. Hopefully there is a district manager who can straighten this out and get these people to get this project finished!...See MoreNew Home Build - Help!
Comments (18)Why not assume that the builder bought the plan with a license for multiple usages? They do sell those. Or, assume that the owner purchased a plan sold on line for their one-time personal use. I bought one of those, used it and modified it significantly. I doubt the designer ever intended their design to be built unmodified once they sold it on the internet. The license is for one use and unless it specifies no modifications, it is subject to modification without need of permission or additional fees. I think the original poster did due diligence, made contact, requested modifications and the original designer failed to respond or provide a solution after multiple attempts. This license owner could not use the design in it's original state and their purchase was useless to them without modifications. The designer certainly wasn't offering to refund the fee for the design. The failure to respond freed the purchaser of the design to proceed with modifications as they deemed reasonable in order to utilize their purchase. I hope they enjoy their new home once they get the framing issues resolved with their builder....See Morebudge1
