what would be an acceptable reason to coancel a contract with a realtor? Does it vary state to state?

It varies company to company. Most agents will not try to stop you from cancelling. Their broker is another story. I have heard of cases where both the agent and seller agreed to cancel but the broker would not allow it. Brokers will even try to give you another agent from their company. Have you talked to your agent about this?

Also, look on Realtor.com for that area and make a note of the listings that stand out; better photos, better language, etc. Not that means everything, but it can mean that the realtor is willing to go the extra mile. Also, you can go to www.city-data.com and go to the Florida board. You will get the good, the bad, and the truly awful there. Mostly, you will get a ton of information about the area you are interested in. As a realtor, I often post on my own state board when people are looking for information on my area. Good luck. Jo

I realize the original thread is a year old. But as someone who has sold and bought a house in the last year, I have really been struck about how real estate selling/buying has changed over the recent years but how agents are compensated really hasn't. When I first bought a 30 years or so ago, things really were different. For example, in buying a house I used to expect the agent to find houses for me and send me information on houses for me to choose to look at. Nowadays I just never do that. At most the agent will set up a search to my specifications, but, really that search didn't find anything I didn't find through the searches I made through MLS. I am bemused at times when I see people talking about agents not showing flat fee listings, etc. From my standpoint, I don't quite see how that would work since I'm the one (as buyer) who tells the agent which house I want to see... I also think that with all the computerization in my instances the buyer's agent spends more time helping the buyer find a house than the seller spends selling the house. It doesn't bother me that the selling agent usually doesn't show the house -- there is no particularly reason to expect them to personally find the buyer. Still when I think back to the last couple of houses that I sold and the last couple of houses that I bought the buyer's agent spent more time than the listing agent spent. I understand the concept of the 6% fee. Those who sell compensate for all those who don't sell and the more expensive houses compensate for the less expensive houses. It is not too dissimilar to the contingency fee that an attorney might get for an auto accident case where that fee compensates not just for the one case but really for all the cases where there was no recovery or only a small recovery. It does seem strange though that -- unlike other fields -- in real estate the model for how agents are compensated and the amount of the fee hasn't changed.

I have to say, I love my real estate agent. Our house is still for sale, but we found our dream house before we put ours on the market. She went out of her way to find us the best agent in the new house area to represent us who we immediately took a liking to and has worked herself to death to make the new house deal go through and be ready. Our agent locally even goes so far as to secure a domain name for every clients house and create the house its own website that goes to the new owners. She markets everywhere on the Internet, we have her cell phone that she answers personally anytime of the day. If she can't talk, she'll tell you that and calls you back soon after. She came out initially and we asked for an honest appraisal of what needed doing before going up for sale and we did almost everything she brought up. We didn't sign a thing till the day the house went on the market and she never asked us to. She's special and I wish every agent was as professional, warm and delightful. We've had the rudest agents come through showing the house that didn't even have the courtesy to leave a card, give any feedback, give even a 20 minute notice so we could get out of the house but just knock on the door and ask us if they could show the house. Those are the people that shouldn't be in the business. So, like any other industry, you have the good the bad and the just plain ugly. Here's the website she made for our simple suburban house. bec - they wanted $10K in light fixtures allowance? WOW! Sounds like you had a bad realtor. The 2nd offer could have easily been countered rather than flat out rejected. Response: Yes, it was countered and we couldn't reach an agreement. She wanted 50K under the asking or 40K + 10K in a lighting allowance. I think we countered with 25K (meeting her half-way) under asking and she wouldn't budge. Hope the price drop works for you. Before you drop the price, counter back to this offer without the selling contingency to see what happens. If they don't accept, then reduce your price. You may want to reduce your price in the counter, remove the selling contingency and make it firm and final. Don't flat out reject this one - try to make it work. Response: Yes--we countered with 20K off the asking price, no-contingencies, 2 month close, which should give them time to sell their property. Agent has been instructed to lower the price on Friday if the counter is not accepted. Where I am, the earnest money check accompanies the offer to purchase and is deposited into an escrow account upon acceptance of the contract by all parties, if that is not the case where you are (i.e. NY etc.), you do have a problem. Response: Same where we live. We attribute the oversight to the buyer/seller agent. Somehow, he didn't put down escrow money even though it was in the contract and the agent wasn't able to contact him during the 2 week contingency period. At the end of the 2 weeks when the contingency period ended and he still hadn't put down escrow money and wasn't returning calls from the buyer/seller agent, we knew the offer wasn't going to go through. We blame our agent for allowing this situation to occur. Earnest money should be refundable, if through no fault of the buyer the buyer canÂt purchase the house, or, it becomes non-refundable after an acceptable appraisal, inspection, removal of financing contingency etc. Response: Yes, I agree. We have bought and sold several properties and homes so I am familiar with how escrow money works. We've always put down escrow money at the signing of the contract and had a refundable period. It becomes non-refundable after a certain time period when all the inspections, etc. are done. We weren't about to get burned twice by the same buyer, though, which is why we requested that the escrow money be non-refundable. He previously took the house off the market for 2 weeks only to disappear and not go through with the purchase. I think we were entirely reasonable in our request for non-refundable ernest money.

Why cancel the contract? Fire the agent! There are proper proceedures for this. I don't know what they are, but a competitor agent could help you if you want to change agencys or check with a RE lawyer.

We fired our agent. We were in a 6 month contract with her and after 3 months and 2 sour (almost very costly) experiences we called her agency first and spoke with the manager and then we called her to let her know we no longer needed her service and our contract was null and void.

it isn't really the agent but the broker I could care less for. they don't seem to be doing anything my agent is asking them as far as advertising and such. I spoke with another agency and they said it could be done but I was just curious as to what ways I could do it without adding to the migraine I already have. They wouldn't do a 3 month when i asked them and we have 4 months of a six month left. What would happen if I went out and did my own advertising and got someone who was interested?

Im2oc4u, depending on the type of listing you have, you could still have to pay the commission. Look on your contract, if it says "Exclusive Right to Sell" you would have to pay even if you found your own buyer. If it says "Exclusive Agency", you would not need to pay a commission if you found your own buyer. I'm really not sure if its called the same thing in every state, but it will definitely have an explanation and which you have on your contract.

I would check the contract, call the agent, and then call the broker.

Im2oc4u. Your agent might not know that she can take out her own advertising. She doesnt have to wait for the "rotating schedule" of office listings to be advertised. Agents are independent contractors. Her broker can't tell her she can't do something.

If you really want to cancel, tell the Broker that you want the house off the market, wait 3 months and relist. You can change your mind if you don't want to move. But, realize you cannot sell to anyone else during that 3 mo period. Also, they cannot refuse a 3 mo listing, they cannot force you into a 6 mo listing--and do I wish I knew that when I sold in CA.

Talk to the agent. They will usually find a way around the contract (there are always holes).

Is this the same house that the realtor was taking a reduced commission to get the two deals together? What happened to the buyers?

Linda- yes it is the same house and i'd like to know what happened to the buyers too... they failed to show up for the contract signing and were never heard from again. we have had 2 OH's this weekend and last but they weren't advertised and i'm a little P'd off. Everyone that comes to my house loves it, you can't find a fault. It's just that if you don't market it properly we won't get people in here, correct? I'm just venting this is frustrating.
