Closing delayed...SO annoyed right now!

Ok so our closing was supposed to happen today...and then literally late yesterday afternoon we found out that there are potential easement issues with our underground water lines. Apparently our lines that connect to the municipal source run through 2 other people's property, and the easements are not completely beyond scrutiny.

Isn't this type of easement something we should have been informed about at the time we agreed to purchase the house? I don't understand why this issue didn't come to light until literally the night before closing. We had NO idea our water lines touched anyone else's property.

And all of the utilities are to be transferred to our names today...but now we don't have a closing date and here we are paying for the electricity, etc. SUPER SUPER annoyed right now!!

I know these things rarely happen without some issue, but I am so disappointed right now.

So, who is making the stink right now? If it is the buyers, what are they asking for?

We are the buyers in this case. Our attorney says there is some issue with the easements that were granted by the property owners adjacent to ours (where our water pipes run). I don't know exactly what the deal is, but I just feel that we should have known there were easements when we bought the property so that our attorney could have figured all of this out before now.

It sounds like you've got a project on your hands. I'm remembering the first house I almost bought. Fifteen or so years ago, though it seems like yesterday, a coworker at my job in Ohio mentioned casually that his brother wanted to sell a house nearby. The brother lived in Texas, and had been renting out this urban house, with no supervision or maintenance whatsoever, for over 10 years. The place was a real pit -- roof leaking, plaster falling off the walls, backyard of oil-soaked gravel, but I was poor and hated my landlord. The thought of a place of my own was intoxicating. Somehow, my lack of tools or any substantial knowledge about houses are put together failed to quench my enthusiasm. I agreed to live in the house for free while the purchase arrangements were made. I had a crowbar, and began by bashing and prying all the plaster and lath off the walls of a second-floor bedroom... and there I got stuck. I had a room full of shockingly heavy, nail-riddled plaster chunks, no dumpster to put it in, no understanding of drywall and carpentry, no truck to transport materials and little money to buy either, very few tools and no internet to help me figure out what I didn't know. Ahh, those were the days. Looking back, it's amazing how clueless I was. The deal to buy the house fell through; it was bought, instead, by my co-worker, the seller's brother (who happened to have been a carpenter in a former life), to be rehabbed as a rental property. I lived there through a summer, working off my rent by helping the new owner with the rehab. The first thing we did was to build a plywood chute from the bedroom window, over the porch roof and into a dumpster we'd parked in the front yard. The broken plaster went out, new drywall came in and the transformation was magical. Then I learned to sweat copper, and proceeded to replumb whole house by myself. I learned quite a bit that summer. I realize this isn't the most uplifting story, but I do empathize with your feeling that you might be in over your head. You will learn more than you can imagine. A local friend who understands basic construction will be invaluable. Ask lots and lots of questions. Figure out what is and isn't worth doing to this house, and figure out the right sequence of events. Don't get wrapped up in fixing windowsills if there's a chance you'll be taking down plaster. Don't pretend you can make the sort of rapid progress a seasoned remodeller could; you'll learn more by doing a small job carefully and well than by trying to bite off too much and doing it badly. Accept your ignorance, and chip away at it. Take care of yourself and your family in the meantime.

I wouldn't say it's been recent. If you look at the mutual fund business 30 years ago, most funds were one-off operations, most focused in specific investment types, but always trying to produce better returns than competing funds. Investors came to realize (as you mention) that many rock-star managers produced returns no better than, and often worse than, broad indexes that could be used for comparisons. That was the start of index funds - no reason to try to beat the index, just buy the index. Index funds require minuscule management effort - incoming and outgoing shareholder money needs administration, fund holdings need to be rebalanced when the members of an index are changed, but otherwise, not much so that fees can be lower. At the same time, Vanguard decided to take a different course. They were formed as an investor-owned operation (like a mutual insurance company) so that there was no need for a profit element, fees only need to cover costs. Vanguard's performance among funds has been as good or better than many, and the low cost profile puts pressure on other funds to follow suit or risk becoming unattractive to potential investors. Vanguard started in 1975 but its popularity has been reached over the last 15-20 years.

Susanne I love the funky oroblanco bloom, it's adorable! And almost alienlike compared to other citrus blooms which I love Laura your trees are so beautiful and an inspiration! I saw how Mike has transitioned his trees into a room full of lamps. Soon enough you'll see all of our trees becoming as green as yours one day! I was at IKEA last week checking out lamps and bought the $15 Lersta yesterday. I was setting it up and belatedly realized this was the lamp you suggested us to use back when everyone talked about their overwintering plans! I'm so glad I found it, I love the way the lamp looks and how it's tall enough to fit a lot underneath. I had a different fluorescent lamp on my tree before I got the IKEA lamp and it really greened up my Meyer. Once it became October, my Meyers leaves weren't vivid green anymore and was dropping old leaves like no tomorrow. I should've brought it back in much earlier. I now have an LED grow light in the IKEA lamp and I'm pointing the fluorescent to the side of my tree :) it seems to be loving the light that disappeared outdoors 5 flowers bloomed indoors within a few days of each other! I caught one bloom half open today when it was fully closed last night. Great idea putting the light clamps on the lamp, I'll definitely be getting one to do the same

That Orchid Romance does look great, zz! How I wish I hadn’t returned mine when I discovered it wasn’t Sweet Mademoiselle! I have two Princess Charlene de Monaco‘s, and I absolutely love them. I was totally thinking Sweet Mademoiselle was going to be a pinker version of PCDM. All the Romantica roses have done incredibly well for me. I just never expected SM to be so bright and coral looking. I actually felt irrationally annoyed every time I saw her blooms last year. I had no one to help me remove it, and I felt like SM was taunting me with every fluorescent neon bloom. She was SO bright I couldn’t stand it, and not even 100F heat and full sun would fade her. It could be that she’s just that artificial color in my soil and climate. I’ve seen pictures of SM that looked great, and nothing like my gaudy beacon of a thing. If she looks like that again this year, I’ll have to call in some favors and have one of my sons come remove her. I too, prefer the softer colors of DA’s. I did purchase Boscobel last year, and that’s a stretch for me. Boscobel is a little brighter than I prefer, but it changes with the temps. Boscobel‘s color is more like what I thought Sweet Mademoiselle would be. Sweet Mademoiselle likes to grow super tall, too. It looks like Orchid Romance stays shorter. They may not have shown up until a title search was run.

The present owner may not even be aware of them.

It sounds like they are NOT easements on the property you are purchasing but on adjacent properties for your utilities.

Call your attorney and ask them to explain.

You are paying them.

How does a buyer find out if he has an easement on someone else's property since I don't think that would come up in a title search--you're not searching the neighbor's title, right? Or on the survey--you're not looking at their survey. I don't know. I never heard of this from this side of things.

I feel for you. This home selling and buying process is so stressful lately! Let us know what you find out!

It did come up in the title search. That's how we found out about it. When the lady who owns this house had it built, she had to seek easements from her neighbors in order to have community water lines dug to her home. So she had to know there were easements involved.

The concern was whether or not the property owners that granted the easements had lenders and if those lenders also signed off on the easements as well. From what we now believe, there are no deed of trust issues and everyone has agreed to sign the paperwork that is now more legit.

We will be delayed until early next week (or so they say) so it's not that bad, but we had an entire army of people lined up for this weekend to help with the move. I've boxed up most of my house and I feel like we're in limbo. But this isn't as bad as it could be so I'm trying to stay positive!

And LoveInTheHouse, you are soooo right...this process is so stressful!

Utility easements should be marked on her plat and the location shown.

I have seen numerous plats so marked for overhead wires and buried lines.

It sounds more like a CYA exercise by the attorney doing the title search.

What's a CYA exercise?

Well, if this makes you feel any better Valkyrie, I lost my buyer TWO DAYS before closing and we were moving our farm and business to another state. We closed our business. We scheduled movers. We were THIS CLOSE to shipping our horses up there! Whew. And now I wait again. Talk about limbo, lol.

I hope we'll see you on this board again after you close!

I know it's stressful but try to look on the bright side.

Be glad they found the problems BEFORE you went to settlement, and not years from now when one of your neighbors tries to sell.
