I don't know about the papers, but you should DEFINITELY put a credit freeze on your accounts w/ the 3 credit bureaus. If they got all that info on you it's wway too easy for them to steal your identity.

I'd also make the banks change all my account numbers.

I don't think I'd bother w/ the preapproval letter, but you probably should have a copy of your mortgage agreement. I'm surprised the bank isn't being more cooperative.

Also, make sure there's a police report, and send a copy to the bank.

you have the copy of the deed--that's the most important part.

I'd only pursue two other things: the mortgage agreement, and the title company.

Mortgage documents, loan agreement--did the second loan officer get you copies of these? Go to his desk and demand them. All you really need is a copy of the document that you actually *signed*. Probably you'll be OK w/o them--I know I never looked at mine in the 13 years our mortgage was around, but I suppose if the bank had resold my loan or something I might have needed it.

Credit reports--these are out of date now anyway.

I would bet that nothing else is important. What stuff is it? House inspection--well, you've lived there 2 years, if nothing has gone wrong, then you don't need the inspection now.

Only the deed and the mortgage agreement are important. Maybe the title agency, since if an ownership dispute arose, you'd want proof of what they told you. But even then--once you are sure the title is clear, and you've made the purchase, you probably will never need it again.

You could have tossed the preapproval letters and credit reports after you closed on the house; they were out of date by then anyway.

Keep a notebook/journal with pockets and write down: when (date and time) and who you call, who you spoke to (employee name + ID #, and what the call was about. Put your requests for records in writing and keep a copy for yourself. This will let places like your bank, title agency and realtor know that your serious about making sure they follow through, instead of ignoring you.

I'd be sure and get that police report filed right away. If you live in a state that allows it, freeze your credit report so it won't make a difference who has your SS, DOB (It won't do them any good without a password from you).

A Title Search is the New Credit Report

ATLANTA, Jan. 8 /PRNewswire/ -- Consumer advocates have always recommended that credit reports be reviewed, to discover possible identity theft or fraud. Identity thieves and fraudsters are now turning to a more lucrative target; property records and titles. For this reason, running a property title search is becoming more popular, to prevent financial loss.

Not only are property records easier to break into, incorrect results are also harder to change back. Unlike credit reports, there is no guaranteed "dispute" process, as there is with credit bureaus.

According to David Pelligrinelli, of TitleSearch.com, the increase in fraudulent and incorrect property title records is dramatic. "Especially in the past 18 months, we have seen a troubling rise in the number of errant records on the property titles we look at," he says. "We are seeing large numbers of unreleased mortgages, which were long since paid off," he adds.

This is expected, given the volume of mortgage refinancing in recent years. When the prior mortgage is left on the property title, there is now a double mortgage. If caught early, it is fairly easy to obtain the appropriate release from the original lender, for recording on the title. With lenders merging, selling out, or closing, it becomes harder to track down the release as time passes.

More serious than title errors are fraudulent recordings. "Most people are not aware that if anyone presents a lien, mortgage, or transfer deed for your home the county clerk, it will be recorded on your property title," Pelligrinelli says. "The clerk does not verify that the signatures are legitimate; their role is record keeping only. While there are some requirements, such as using the correct form, and notarization, these are easily bypassed.

"It is easier to steal your house by using a fake deed, than it is to steal your credit card number. At TitleSearch.com, we hear of fake deeds regularly. Attorneys and consumer advocates are now recommending that property owners run a title search to verify that their property is titled correctly, with no liens."

In 2006, there were numerous accounts of properties being unknowingly transferred away from the owners. In one case, a man presented a fake transfer deed for a $76 million New York hotel. His only mistake was using an outdated form, otherwise, the transfer may have gone through. Also, most counties do not send any notice to the property owner when a transfer or lien is recorded against their title.

Pelligrinelli agrees that running your title search with a reputable company is recommended. "Doing this every year might be overkill. However, running a title search once initially, and then every two years is suggested. Other key times are a few months after a refinancing, or prior to putting a property on the market. Divorces and deaths in the family are often good reasons to check property titles, as well."

The deed should have been recorded at the courthouse. The original is not required for anything.
The deed of trust should also have been recorded, and unless you paid it off it is a copy anyway. The mortgage holder has the original and will only return it when the note is paid off.
The rest is more of an annoyance, with the possibility of identity theft hanging around.
The courthouse should be able to suply certified replacement copies if you want to have them, but recording eliminates the need for the original documents.

I agree, you need to put a fraud alert out to all credit bureaus. You don't want your identity stolen. I would call your agents broker and tell her you need these copies. They may be able to help you get a copy of your deed.

Any copy that is not certified by the recording clerk is not even worth the trouble to get.

I wouldn't think many (if ANY) of the things you need will be free. When we were selling our condo in August, we were asked by the buyer's title company for the title insurance policy from when we had bought four years ago. Not having a clue where it was - or even if I had EVER been given such a paper - I had to pay the title company $40 to research it from their archives. I agree that many of those items are useless, but they COULD provide information about you to a crook that could easily cause you grief.

Your deed and your mortgage and in some or most states the note you signed with the mortgage are all recorded. You can get certified copies of everything from the same place you got your certified copy of your warranty deed. You have to pay the clerk a few extra bucks to certify the copy - but if you want it certified you can certainly pay for it and get it.

When you sell your house though - the mortage company will require a title search and an abstract of your property (big fancy term for a full history of your property title deed transfers and any liens on it through out its inception - I don't know why you would need certified copies, but whatever makes you feel comfortable - it's relatively cheap. Now recreating the complete title history of your property is very expensive and labor intensive for a title company. I wouldn't recommend it. Unless you are selling then the title company or the real estate closing attorney will arrange for all that to be done. The most important papers to you are your deed, your mortgage and your note. Just so you can have them so you know all the terms of your loan, if you ever have questions. The company that closed your loan will also have complete copies of your closing papers - if it was an attorney most are required to keep their files for at least 7 seven years or more so you should be able to call them and pay for copies of anything you need.

Then follow the advise of all the other smart people here on protecting your credit.

You might live in a place (like I do) (Florida) where you can get all this information on line. Recorded copies of my mortgage and deed are on line at the county clerk's web site (not the note - thank goodness). So much for privacy when you are "in the sunshine".

I don't know that this could happen here in the states, but if it were me (and I had this much paperwork stolen) I'd be sure to send a copy of the police report (certified mail) to the appropriate parties so I would at least have a paper trail of proof, in the event that someone tries to transfer ownership out of my name.

I was going to say something along the lines of dreamgarden - there was just a story in our paper about a guy who forged the deed to a huge NYC hotel owned by a big corporate conglomerate. He made it look like the deed was signed over to him (he bought the hotel) and filed it at the courthouse. The courthouse was backed up and it took them a while to record it so he kept calling the courthouse and asking why it hadn't been recorded yet. Finally, one of the clerks got suspicious that this guy was so antsy about the deed recording and checked into it, and the guy was caught and arrested. If it had been recorded, he would have been the legal owner of a hotel worth millions of dollars. Crazy....

I would definitely tell someone at the deed recording office what happened - maybe they have a procedure in place to watch for fraud like this.

I tried getting a copy of my both my property deed and mortgage but it turned out to be a real bureaucratic hassle. I finally was able to get both on line from www.getincnow.com/Property-Deed-Online.php . The staff was very helpful and I got a copy of my deed the next day. I would use their service again if the need arose.
