HELOC & Deed question

knoxx66

After our divorce in 2011 ago my ex-husband purchased a home
of his own and got a small mortgage. A
couple years later he added my name to the title of the house with my consent,
but I’m not on the mortgage. Last year
he applied for and received a HELOC. I
was aware of the HELOC and am fine with it – it’s his house for all intents and
purposes. However now the credit union that did the HELOC is sending me papers to sign stating that because
my name is on the title I need to acknowledge that they’re using the house as
collateral for the HELOC. The problem is
that the “Open-End Mortgage” papers they’re sending me to sign are dated last
week – my ex got this HELOC over a year ago – and it names me in the papers as
if I’m responsible for the repayment of the HELOC (which has 0 balance at the moment). I
think they’re just trying to cover themselves because I don’t think they did
their homework when they approved the HELOC last year. I understand that the house will be used as
collateral and that’s fine, I have no worries of my ex defaulting, but I
also don’t want this HELOC to show up in my credit report. Any thoughts? Am I required to sign these and
if I don’t, does he lose the HELOC?
Shouldn’t this have been done when the original HELOC was approved? Will this show up on my credit?

Thanks!
