Now the left side of my car got hit today :o(

Big time, worse than the last one in Dec. and it was NOT MY FAULT AGAIN.

Backing out into parking lot and BAM, man backed into me hard!

He admitted it was his fault.

Police officer noted that and said it will be up to the insurance company to decide.

Man works for Mercedes, driving a clients convertible, kissed girlfriend goodbye, and guess he was too excited to look.

And it was my first adventure for REAL food, a full meal in almost a week.

    Glenda, what a shame. Did you get to eat?

    Parking lots are dangerous places, and not just for door dings. I had someone back into me in my new SUV in the grocery store parking lot one day, the policeman said rules of the road basically don't apply, its every man for himself. Usually each persons insurance pays their repairs less deductibles (in this state at least), unless someone steps forward and admits responsibility. It sounds like you rec'd an admission of guilt, if he will just continue to take responsibility hopefully you'll get your car repaired and be able to put this behind you with no cost to you. We'll keep our fingers crossed....

    Last time, lady admitted the guilt and I had a witness name and phone number.

    This time no witness, but he admitted the guilt.

    Last time didn't call police.

    I just don't feel good about the man who hit my car, today.

    Will pick up police report Monday afternoon and proceed from there.

    Yep, fingers crossed.

    Melissa- After reading your post, I immediately jumped in my car and flew to Gertens - and I live in Wisconsin. 'Empress Wu' is at the top of my wish list. However, when I got there she was priced at $39 (yikes!! - lol) That is a little rich for my blood, so I settled for a huge 'Big Daddy' ($9), four 'Mona Lisa' lilies (in one pot), two hakone grass, 3 Ajuga reptans, 'Burgundy Glow', a HUGE Datura and some Creeping Jenny. I had a $10 gift card so I got the whole thing for $49.00 I felt a little better getting so much more for the money. I guess I am just cheap/frugal (lol). 'Empress Wu' will have to wait. Gerten's, by the way, has more than quadtrupled their hosta inventory and had quite a few new varieties. Thanks for the heads up, Melissa.

    Chandra, I would like to send some mineral to the plant exchange. I am closer to being at the toxic level than I am of having too little. I feel I am walking a thin line, I want to build my soil with organic matter but I already have above optimum in Zn, P, and K, and if I don't keep the PH at the proper lever Fe can be a problem. I have been thinking about growing corn in that garden and feeding the stalks to the cattle, of shredding them and tilling them into my new garden. I have not tested it yet so I have no idea what the mineral count in it is. I only started the new garden last year and it has few amendments in it. Larry

    Ok, Grrrr. It seems not only did I exceed the bandwidth of my photo sharing site (until tomorrow when my month is over I think), but it appears that I may have crashed the Ft2Garden.com server bandwidth as well. I was posting about the photo site when it gave me an error when I tried posting. After checking Judy's blog and the Ft2Garden.com forum, they were all down. I can only assume the two are related. Who knew my 15 minutes of fame would have such unintended consequences. Oops!

    I think you have achieved a very good and interesting monotone look which one doesn't see in alot of kitchens. The inclusions in the slabs will add depth. It makes me want to re-do my kitchen but we just did a master bedroom/bath,hall bath renovation. I can't believe I'm even saying this as the job took twice as long due to the vanity troubles (Bertch). Anyway my husband says we have no money left so no fear there!!

    If you were both backing up and hit each other, it could be a draw as to who is responsible. I learned this the hard way. Whenever you're backing up and hit someone, you're liable. Even if the other person admits fault.

    The police officer said the insurance company will determine who is at fault.But he did make a note of the admission. And may be we both have to pay.

    Sorry Sephia, I don't agree with you. I was backing out of a parking spot when bam. I got hit by another car. After describing the incident to her insurance company, they paid for the damages. I was actually fully out and ready to go forward when we crashed, so it was obvious she started backing out after I did. So sorry to hear your woes, Glenda. I surely hope there's no problem with his insurance company. Even so, it's such an inconvenience.

    We were rear-ended in a grocery parking lot in the mountains. It was in the handicapped parking right in front of the store and the lady was driving a whoppin' big pick up truck. 30 seconds before she hit the back of our car, I'd been putting groceries back there. I have no doubt I would've been killed. She felt so bad that I ended up consoling her. No police but we traded insurance information and hers paid without any problem at all. This was in Georgia and I hope you get the same treatment in Alabama!

    Yes, I was backed up and ready to go, when that person hit me. I wasn't rear ended, I was hit on the rear side.

    Well he has big issues if he works for a dealership and was out driving a customers car on personal business, that is firing grounds.
    If you have any problems go directly to the dealership Owner, not manager, and tell him about it.

    My thoughts too, what the heck is a staff member doing kissing his girlfriend in a customers car.

    Glenda, I'm glad you're OK, I'm really glad your air bag wasn't triggered, you could be writing to us with a broken nose :)

    Rules vary depending on location. Where I live, privately owned parking lots are are considered just that: Private property and are not public roadways, therefore the police has no jurisdiction in assessing a crime and do not issue traffic tickets. Rules of the road generally apply. It'll be up to the insurnace companies to 'duke' it out on who pays for what.

    Several years ago, we experienced a similar incident. My wife had driven the family car with some friends to a burger joint. As they were backing out ot leave, another car also backing out collided with our car caving in the front door. The plolice was called. They witnessed the scene, but since they did not see it happen, their account would have been counted as hearsay. The other driver admitted guilt and was appologetic. Each driver traded insurance information. A couple of days later, we get a letter from the other driver's insurance carrier stating, "Sorry. We have no responsibility in the accident."

    Our insurnace company fixed the car and now having a bill in hand sued the other insurance company in small claims court and won. The amount was small. It was more about principles than money. Our insurance agent was irked about the behavior of the opponent's insurance carrier and agent.

    georgysmom - I don't care if you disagree with me. When I was backing up and got hit, it was my fault. Besides my situation, there are probably others. Good for you that it wasn't your fault when you got hit backing up.

    I am really curious if he gave you his personal insurance information or the insurance for the dealership? He has definitely cost his dealer alot in this because he has to deal with that customer too.

    So how would like a Mercedes? Lol

    You are probably right and he was showing off too. Told the woman he just bought it. Uh huh....

    Glenda, you sure do have your good days and bad ones.
    This flu now this. You will win the lottery - it's your turn. So sorry about this but I have said from the beginning of knowing you that you have a full life.

    Last Monday I was out shopping, Returned to my parked car to find both passenger side doors dented and scratched. Somebody either side-swiped it or backed into it. No one was around, I drove home then to the body shop. Because body shop thought it would cost about $3000, I decided to file a claim. I called insurance, they were very nice but told me I should have filed a police report. Well, it's too late now. But the insurance company will handle it, they say I won't be "charged" with the acciodent as I wasn't even in the car, it was legally parked, a hit-and-run, etc. But I miss my car so much-my Wheels are my freedom. Freedom to shop, go out for coffee, go to the park,etc. So I'll be stuck at home for a bit. But, in the balance, I'm very lucky this year. Got my kidney transplant Januaery 13 and I'm getting stronger and better each day.

    State law's vary so much. In ND anything over $1,000 must be reported. Our insurance agent says always a good idea to call the police and report it because a little ding can cost big bucks. Everyday Joe has no idea on body shop repair costs and this way if insurance company asks if there was a police report you are good!

    Hope it gets fixed soon for you Glenda. That really stinks!

    I hate backing out of parking spots.
    All ways look for a "pull thru" spot, then I just have to go forward.
    May have to walk a bit further, but oh so worth it!!!!

    Very sorry, Glenda and Jannie.

    I hate it when my car gets dinged up, which happens too often in the big city no matter how careful we try to be.

    Let's hope your damage is repaired quickly and things get back to normal.

    ravencajun, at first he only gave the dealership card.

    Then as I was writing info down, officer told me to save my time, that all the info would be on the incident report when I got it.

    I'm leary of this man.

    Driving a customers car for lunch, then backed into me. The Mercedes had a dent on the back right bender. I got the worst.

    Wondering what he told the dealership.

    Glad that it wasn't a bang on the driver's door, girl!

    Not long after I got this car, I thought that I went into an intersection on a green ... and a car that came through three lanes hit on the driver's side ... but back at the back tire area.

    I was ... substantially ... very substantially ... thankful!

    It seemed to be the general concensus that I'd run a red light ... but I figure that he ran a yellow, as when my car had been turned around about 180 degrees - there, staring at me through the windsheld, was a green light, in the same direction that I'd been travelling ... and if I'd run a red light, it should have been red!

    Anyway - I also like to pick spaces in parking lots where I can drive out (but must confess to being a bit too lazy/(mis-guided?) to back into empty spaces).

    I hear that a bit of a longer walk is good for one's constitution?

    By the way ... did you say that the grandkid is wanting a car?

    Hhm-mm-mm-m!

    I, too, value my wheels ... and one needs be extra careful around here, for if one in 70s or higher is in a fender-bender or two, one is liable to get a letter from the Ministry of Transportation to say that they are cancelling one's driving permit.

    We have a discussion session of about an hour and a half with about a dozen others, with a test of knowledge and signs, with some being selected for a driving test, every two years after age 80.

    P.S. As I was fairly sure that there were still quite a few good miles in that little 20-year-old Mazda that I'd bought only a few months earlier, after the accident I chose to repair it, at a cost larger than I'd paid for it ... partly for environmental reasons, as it costs a great deal of scarce and precious fuel to dig iron ore from the ground, smelt it, then carry it through all of the manufacturing operations ... plus add quite a lot of petroleum-based plastic, to build a new one, but repair is mainly a lot of work.

    In addition to the amount that's added to global warming ... and pollution.

    Glenda I would not wonder I would call the dealership, and speak to the general manager or preferably owner and let them know. Believe me they do want to know about this stuff, it is all affecting his own reputation. Plus now he has a damaged customer car to deal with and dare I say a p-o'ed customer! He may not be aware of your car too. You can always say you just wanted to confirm the mans information he gave you.

    Maybe not call the dealership, but have the insurance agent do it. The less you do, sometimes the better, that is what we pay insurance for. He might have had the customer's car fixed or will have and the agency not even know about it. Anyway, most states require the people to show their DL and Insurance card for any accident, not a business card. I would not have even touched the card, but asked for DL etc. Hope the police got the information. Be sure and get a report. Did you see the police ask for the information?

    Called the Mercedes place and the general manager, owners weren't in.
    She called the general manager at home, and he said he was aware of the incident, the employee did go take a drug test as requred by the company.

    I should hear from the GM by Monday morning, and if I don't I'll call him.

    Also left a msg for the lady who is in charge of all incidents, etc for the company and she should call me as well.

    This is why I always back INTO parking spaces. Variables are limited- you are unlikely to get someone driving or walking across your back end as you back IN as opposed to OUT, and you can see out of the parking space better from the entry end (where the driver's seat is if you've backed in) than from further down in the space. Much safer than backing out.

    And why I look for a spot where I can pull through and then pull out "head first" when I leave.

    A good day is when I can do that right next to a cart corral, so I can use the cart as I walk through the parking lot.
