Closing escrow in a week and still waiting. (Rant alert)

Talking about the duplex in escrow. The seller keeps going on vacations to remote areas where she is out of network. It's driving me crazy as we are waiting on her response to a few issues.

First, the appraisal came in $2,200. under the selling price. Not too surprising since real estate is just now starting to pick up. There are very few comps because like duplexes in our historical, gold rush town are few and far between. Currently there is another duplex (smaller, not as desirable of a neighborhood but newer) in escrow but has not yet closed so can't be used as a comp. It sold for $10K more than ours. I wish the buyers luck with finding comps. Wondering if our appraisal will bring theirs down.

We have asked the seller to reduce the price to reflect the appraisal but no word from her. She needs to strap the hot water heaters with one more strap. She is likely going to refuse to repair the oven in one of the kitchen stoves. That is fine. I have a preference for who works on it.

But here we are a week from closing and we are having a hard time keeping the seller in town long enough to complete the transaction. Hopefully today we will hear something. We were supposed to hear Friday.

We need escrow to close on time because we are going to the cabin on the lake three days after escrow closes. It will be a pain if it closes late.

Meanwhile, we decided to see if we can refinance our own home since we have done jack flips to get a mortgage for the duplex so may as well use the paperwork to lower our interest. We will find out about our house today.

Can't wait until its all over. I find all of this kind if thing stressful.

I wish you luck. We just refinanced our home for a much lower interest rate. 2.55 % can you believe it?

We were lucky in one respect. We have a lot of equity in our home. We were really taken by surprise by our appraisal, and not pleasantly! The appraisal came in $10K under what we paid, and that is after we built a 2-story $30K garage 4 yrs ago, new $10K roof, added central air, new concrete driveway, reinsulated attic, and refinished all wood floors! Reason given was there were just no comps anything like our house available. We couldn't believe the houses they did use.

Ugh-what a pain! When we bought our house, escrow went very easily, but a few weeks later we were closing escrow on the sale of our business. THAT was enough to cause my hair to fall out.

We had a full price cash sale, but it was contingent on a 6 month escrow. The seller gave us a very large non-refundable earnest money deposit, and he was taking over at the end of the busy season, so we didn't object to the terms (especially the full asking price!) But as the time got closer and closer we began sweating bullets-we REALLY needed that sale to close so we could get some liquidity again-we'd used all our cash to close on our home purchase.

The buyer was actually not the problem, it was our realtor-OMG-he was horrible!! HE kept putting off the signing of papers, missed meetings, etc. When we finally got the check in our hands I cried-I never thought we'd make it through that escrow. Sending you good wishes!

Does your local/nearby Botanical Garden(s) have plant sales? There are two near me, one at a local College that specializes in regional Native plants. They have frequent plant sales to fund expansion of the Native plant Gardens. Many of them are propagated in their greenhouses, by volunteers, under the guidance of a retired Botany Professor. Another source of natives are Native Plant Society's. Our local Native Plant Society has a very active plant rescue schedule for construction and development sites. It has been a source of numerous Natives that are in my garden. We had one site of about 100 acres, that produced about 75-80 different species of garden worthy native plants, including many species of trees, shrubs, vines & 10 species of Ferns. Amazingly, I did not find a single exotic invasive plant on the site! We have recently initiated a program to propagate native plants to repopulate a local State Park, while at the same time, remove the invasive plants that displaced the original natives. I am also a longtime customer of Arrowhead Alpines. They offer so many unusual and difficult to find plants, that I can't resist. When I look through the catalog, an order is usually on the way within hours! Received this year's order from them about a month ago and every item is healthy and growing. Everything was in pots, except some Medeola virginiana pips, which have since emerged and are about 4" tall. Agreed, some are pricey, but having propagated plants for many years and experiencing the sometimes difficult and frustrating tasks, I can understand the reason they must command a higher price. Title/escrow fees too high?

happy2bme: I honestly can't think of any scenario in which a $350 notary fee would be reasonable for a single sale! What does it take, like an hour or maybe two of mostly waiting around? Take a look at the link below to see the notary requirements for FL. The coursework is 3-hours and is offered free online! The notary application is only $39 and the other requirement is that you have to be 18 years old. So where are they getting those fees from? I don't know how much $350 matters to you, but maybe you should ask why you're getting charged that much. rrah: Yes, the fees are small in relation to the total price of the house. But it makes me feel worse when I have significant cash outlays EVERYWHERE else, too. Inspections, lender fees, realtor fees...all stuff that I'm never going to get back. I guess I mostly have a problem with the escrow companies not being very up-front with their charges. By the way - the fees I listed were for me as a buyer. The seller also got charged a wire fee (probably to pay off her lender), and my wiring the money into the title company's escrow shouldn't create a charge because I am separately paying my bank to do the wire. Like I said, I chickened out and didn't question it....that's my own fault. I think the escrow companies count on people not making a fuss. Especially because they are doing that nickel-and-dime thing where each charge is not that substantial in itself. I'm not saying all their charges are bogus, because of course the county does actually charge for recording and courier costs need to be paid to Fed-Ex/UPS. But I can bet you that, at least in my case, they have loaded some profit margin into both the recording and courier fees. I vote that escrow fees should be the only compensation for their services - any other charges should be strictly third-party charges with no padding. They could modify their escrow fee as needed if they somehow (I doubt it) haven't built enough profit margin into the current fees. I don't know how it works in all the other states, but in CO and CA, the title companies are the escrow providers, so keep in mind that they are already making a lot of money off the insurance premiums. I suspect that they would still do just fine if they provided escrow services free of charge with the purchase of title insurance. Nobody has said what they think about the title insurance premiums. Anyone know where the heck the money is going?

I would be attracted by the privacy of your lot, but put off that the house was not sited in the middle of the parcel so that I was buffered on all sides, now and in the future. In other words, what's the property behind your house (that you butt up against)? How close is your house to the property line? Who owns that property and how is it used? Any future plans for it? If I were looking at your house, I would be asking these questions, so you and your agent should have answers prepared. Are you in an area where forested tracts are rapidly becoming developed homesites? I live in the Northeast, and the next town over is basically forest and conservation land with multi-acre zoning... a few years ago, a very nice home that was barely (and charmingly) visible from the road, seemingly nestled in the woods, was suddenly exposed when a long driveway was cut through and another house built very close by --- the first house had been built backed up against its own property line. Those are the kinds of things I would be asking myself if I was considering your property. I know that you can't move the house :o), but maybe you need a "story" to explain why you sited the house where you did ("to take advantage of the lovely hillside view", etc.), rather than just to be as far away as possible from your neighbors. I feel for you - it's a beautiful house in its own unique way and I know it will really come alive again for the next owner --- I'm thinking wonderful "Martha Stewart"-style holiday parties and cozy quiet nights by the fire. That said, I am not a big fan of staged houses. I like to see a clean slate so I can let my imagination run wild. When I first looked at your pictures, I thought, "hardship house", as in divorce or bankruptcy, because it seemed so forlorn and emptied out. I would clear out the house out completely (but always keep it fresh and clean for showings), leaving one comfortable seating area with good lighting where people can sit to discuss, review your albums, etc. Maybe that area could have some mini-staging --- couch and comfy chairs, pillows, big coffee table, nice rug a la the Ralph Lauren/upscale ski McMansion look! I'm also impressed with your can-do and flexible attitude... you've been hit with some harsh (if well-meant and accurate) criticism here without getting defensive or hurt. I wish you the best of luck. You are getting some great advice here.

Our realtor said he wanted to put the house back on the market for 2 reasons: 1) to show the buyers that we didn't want to play games anymore and 2) so that we wouldn't lose a valuable weekend of possible showings. I don't know if he's playing straight with us or not. He's part of a large firm with who knows how many realtors under the broker. I do know I've been to their office twice and it's in a very pricey new building in a pricey part of the county with many many mail slots for realtors and a lot of front-counter people. Long marble-floored corridors with private offices for each realtor. I don't think it's the kind of place where the broker would sit down with our realtor and say, "Gee, are you being fair to these folks?" This realtor sold us our house 4.5 years ago and he's changed brokers twice in that time. I don't think he's as hungry for business as he used to be. I'll call an attorney on Monday just so I know where I stand.

Our house appraisal is running late. Maybe tomorrow... We have/had equity in our house too but California was hit hard by the housing crunch. I have no idea what is going on right now, other than housing has just started going up faster in value than we could possibly make from money in the bank. Finally an upturn. We locked in at 4%, a decent interest rate for investment property.

The good news is the seller came home and has agreed to split the difference with us on the duplex's low appraisal. That means around $700. more down for us (25% down). Much better than us eating the whole difference.

The hot water heaters have yet to be double strapped and she is to have a service man out to check and repair one oven. She agreed to do both.

We signed more papers and it's moving forward once again. Meanwhile, no one is watering anything at the duplex and it's turning brown fast. I left water running on the bush shown in the photo this afternoon and Rob will run past and turn it off on his way home. The red leaves are now crispy. The bush goes up the sidewalk toward the rear unit and is much larger than the photo shows.

Our realtor has worked her butt off for us. She is hungry! Most of the realtors and mortgage brokers around here have spent the past few years living off of their credit. Just a few years ago (2005), that duplex appraised at $500,000. Ouch!

Still, there have been lost papers and documents on the mortgage lenders end. Glad we have the originals.
