I am confused with below grade slab and daylight, sounds more on grade than anything else. I would not use a tarkett fiber floor. I am sure you want to float the vinyl and the only way to go is Congoleum's Air Step Plus or Air step evolution. It is not your typical fiberglass floor, can float entirely or be just perimeter fastened and is guaranteed by Congo not to buckle. There is no other floor like it and Air step plus is relatively inexpensive. Armstrong also makes one `kind of similar but not the same. No one else...period.I am sitting here racking my brain and this would be the choice for the specifications you indicate. I have a ton of info on why no other ones comes close. Scotchguard..silver treated for anti microbial properties..12 mil..decent cushion to it..20 year warranty..the real deal and its the only floater that the manufacturer does not give itself a ton of sniffle clauses on why it should be glued. And USA made entirely which is another good thing and very green product.

On one hand you have a construction manager/owner who is NOT a flooring professional telling you one of them best organisations in the flooring industry that their specs are too conservative. Who probably wants to use someone who makes them more money by cutting corners, and/or doesnt want to foot the bill/labor for removal and/or fixing. Ergo, they ahve some agenda, whether that be scheduling or money or a little of both. On the other hand you have a professional certified flooring inspector, a professional flooring industry association,and a professional flooring installation professional, all of whos' l;ives are flooring and doing ensuring things are done right, telling you the opposite. Use common sense in who to believe please. As professionals our job is to do it right. Others who say different have different agendas that alter their opinions. To answer your questions, the contract doesnt need to stipulate anything other than the work being done for the price charged to be performed to within Industry Standards as set forth by the NWFA. The installer has nothing to do with the manufacturers warrenty. The isntallation guarantee is on the installers crafsmanship to be fre from defects in crafsmanship. Check with your state as to minimum legal guarantee duration. In most states it is one year, while in others it is 2 years, while some companies offer longer guarantees that the legal requirement. The manufacturers warrenty you should read. They vary from manufacturer to manufacturer. The manufacturers warrenty is for the actual flooring product being free from factory defects for the stated time period(s). Go with the installer spouting he NWFA specs. When things go bad, the prices and time frames increase. If you corner cut to save some money you might be paying for it later.

Yes, you need a lawyer ASAP. You needed one to look at the contract in the beginning. I have to think that your issues are being exacerbated by your communication style. You need to take some time and clearly and concisely list exactly what the issues are. (Number that list to assist with clarity.) Then list what should have been done under the contract. Then list what changed needed to happen, and why. This will assist your lawyer and anyone else you wish to communicate your issues with. Right now, no one can make heads or tails of what you are trying to convey.

I'm going to play devil's advocate here and also try to fill some holes in your story. This whole thing could have certainly been handled better, for both parties. It was an unfortunate mistake on their part, but would you rather they'd gotten it done faster with the wrong wood? Everyone makes mistakes. If I was faced with a potential 4 week delay without a stove I'd go to a used appliance store the first day, buy a cheap stove, bring it home, use it, then donate it later. In a 3 to 4 week period it's not unreasonable to think the furniture situation could have been remedied to make your lot more palatable. You could have prevailed on the floor man to set up your rooms and he would have likely complied. Now let me address the 48 days vs. 7 to 10 days. Where did the 7 to 10 day timeframe originate? It sounds implausible, at least the way I do floors. When the proper floor arrived, how soon was it installed? How long did it take to install? Did they start sanding and finishing right away? How many square feet of flooring was there to sand and finish? What type of finish was used. Answers to these questions will determine how long it really should have taken. Most of this is really pointless at this point because as the tired saying goes, it is what it is. From a retailer's perspective, if you didn't pay me, I'd lien your house. Once I liened your house (which takes my time and costs money) I'd be far less willing to provide any price concession. I would suggest you be proactive to make a settlement. The time you lost is water under the bridge but the floor finish is a real issue. Ask the retailer how much he would charge you to sand and finish the floor and suggest he deduct that amount from the bill. Tell him that in the future, you'd expect him to do the job for that amount of money, to keep him honest. In fact, make him give you a written estimate with no expiration date. I've done that in the past when something didn't turn out well and there was no time to re-do the job. Contact another reputable finisher for a quote so you can compare. Or get the other quote and deduct it from the invoice. PLEASE, PLEASE don't burden another finisher with a long tale of woe. While I might derive a little schadenfreude from hearing of the shortcomings of one of my rivals, I don't want to get the impression that a potential customer will be difficult to work for. Someone who tells me that a 7 day job took 48 days doesn't come across as reasonable when I know that it's not a 7 day job. Keep it short and simple.
