Notice of claim of copyright infringement

I received a notice of claim of copyright infringement from my internet provider. I have absolutely no idea what I did. (I also have had company this week and my grands used the computer and possibly could have done something.) Can anyone tell me what I did and/or what type of file this is? I do not want to do this again and I have emailed the company and have not heard back from them about what type of file this is. They did say nothing would be done at this time but further infringments would cost me my internet provider. This is the info I received. TIA!

Gnutella was in my mind a brand of foods, a spread to go on bread.

However, I Googled gnutella minitab and found loads of peer to peer download sites. Perhaps you are downloading music from doubtful sources? The music industry might well be threatening your ISP who in turn is warning off it's customers who might be downloading this material.

Could that be it?

Gnutella is a file sharing network.
Although .mpg usually denotes a video file,
MINITAB 15.MPG could be a reference to software.

You mite want to keep a closer watch
on the usage of your computer.

I have never used the Gnutella network
so I can't advise you how to block it.

You cannot take vegetative cuttings from any patented plant variety without paying royalties. I take it you buy their material retail? If you were buying wholesale they'd have likely included this bit of information. I have been in the business so long that I remember when coleus was offered largely from seed grown strains instead of by the each from vegetatively selected lines. I believe you can find 'look alikes' for most of the expensive patented lines in seed grown stock. The industry is now trying to tighten their hold on the 'names' under which these sexually propagated lines are sold by using copyright, but as long as you don't use those 'names' I suspect you are ok to propagate them at will. I always contacted the company selling the stock I wished to propagate if tags or patent info wasn't included with an order and enquired if propagation was protected. It was an issue with me, because I grew and was granted propagation rights for some lines, and was open for inspection at any time from royalty administrators. They could and did count the product on my benches and could and did look at my records. I take it you don't have a business?

The topic of propagating patent protected plants comes up every season here in this forum so if you dig through the archives you should be able to learn all there is to know. In a nutshell, if you grow an 'Endless Summer' hydrangea and take cuttings from it you have broken the law since the plant is protected from propagation for any reason unless you get permission from the patent holder. But they aren't going to find out you did it until you offer your baby plants for sale. They do watch out for people illegally growing their product and they take action when they find out you are selling their plants. One way around it is to grow whatever you want and sell it as the original genus and species and NOT sell it as the patent protected name, in other words you can't sell them as 'Endless Summer' hydrangeas but you can sell 'John's favorite hydrangea'. Their marketing efforts do pay off, people always ask for the promoted version of the plant. You will have trouble selling all of your no-name versions of the plant but it all depends on your market. Some of the plants that have patents do deserve the protection, but only some of them. There are plenty of plants out there with PPAF and other protection attached to them that are no different than the original species - the patent holders just got greedy and make false claims that they've invested years of hard work to develop something special when they haven't. I have a lot of plants in my garden that were given to me by friends. I re-tag all my plants with genus and species names and toss any named cultivar tags. I propagate those that perform well in my area. If I ever sell them I never claim they are the patented plants, I make up my own names.

The fact that other houses might "look like this" is not necessarily the standard a court would use to determine if a copyright infringement had occurred. The usual test is if the building is "substantially similar". Courts have used the "ordinary observer" or "overall look and feel" test, under which two works will be substantially similar if a "reasonable, ordinary observer, upon examination of the two works, would 'conclude that the defendant unlawfully appropriated the plaintiff's protectable expression'." In this instance the contractor would need to show how he could have arrived at a virtually identical arrangement of unprotectable design elements without relying on the previously published work of Connor Homes. If the work was registered before the infringement occurred the author could collect statutory damages and attorney's fees instead of just an award of actual damages for lost profits and criminal penalties could apply if the infringement was willful.

No one has a copyright on leaves. No-one has a copyright on William Morris's "Willow Bough" either, as I hope I explained clearly enough the other day : ) . And I'd be interested to learn how many contemporary fabric and wallpaper designers go to the trouble of copyrighting their work... By the way, here's an interesting article from the V&A about wallpaper and the "ransacking of past styles" (below). From which, "The V&A' s collections were brought together with the specific aims of inspiring good design and offering the best of the past as well as the present to inspire and elevate the tastes of designers and manufacturers, and also of consumers. Morris himself adapted patterns from textiles which he saw in the V&A in the 1860s, and wallpaper designers have continued to use the Museum's historic papers and textiles as a resource, copying or modifying them to produce period collections." The article includes a detail from some Osborne & Little wallpaper, c1975, adapted from William Morris's Willow design for printed cotton (about 1895). The V&A's page for the 1970s fabric notes that Osborne & Little's "range of wallpapers and fabrics has always included adaptations of Victorian patterns, as well as their own original designs. An inherent problem with peer-to-peer networks is that YOUR computer is then made available to others around the world to connect to and download stuff (from your pc).

In other words, it's a huge security risk.

And, yes, folks often go to these sites to illegally download copyrighted material. Seems that's what your grandkids did.

If I were you, I'd never let them near my pc again - ever.

I searched the Gnutella Network for MINITAB 15.MPG
Turns out it is a short video advertisement.

The Statistical Software Minitab is not availiabe on peer to peer file sharing.
Minitab is for sale at the minitab store $1,195

Probably want to figure out if one of the Gnutella type sharing programs like limewire or whatever is running at each start up .... and turn it off!

Otherwise that progam piece and gosh knows what else may be sitting on your hard drive open to the world for sharing, and very well may be downloaded from your connection.

Why would a company complain about someone downloading
an advertisement? Seems like the point of advertising
is to get someone to view it. And they are complaining?

Anyway, MiniTab software is available
thru a bunch of file sharing methods.
