Hi Pixie, When you posted about Little House on the Prairie I looked some things up and was planning to post but just haven't found the time! I'm glad you explained why you wanted to do the plains! At least now it makes sense! After you posted I looked up DeSmet on google Earth--to get the "lay of the land," and I think your daughter would be really disappointed with the "plains" we have out here compared to the terrain you'll find in eastern SD. The link I posted to a pic of "our" plains up above really is pretty accurate--there is simply nothing out there! If you do DeSmet I doubt that she'll actually be looking at "the land" very much when you do it, and she'll have all the Little House things, which is what she actually thinks of when she's reading the books. (Love it when kids are reading books!) So rather than taking her for a hot, dry, flat drive, and destroying her mental image of Little House, I now very definitely think you should skip the plains and enjoy the extra time in the hills! A couple things about the fishing if you're gonna stick that in. Wherever you do it you'll need a Colorado fishing license, so be sure you plan ahead for that so you're not disappointed. And if you do decide to go to the Poma Ranch near Pagosa Springs, you'd really need to stay there two nites to have time for fishing. Checkin is at 3:00, so that wouldn't leave much time on the day you arrive, and checkout is at 10:00, so there wouldn't be time on the day you were leaving. The Weminuche River that runs thru the ranch flows very gently and it could easily be fished wading or from the bank. Check out their Fishing page at the link below, and there's more fishing info on their FAQs page, including that they rent "basic" and "kids" fishing gear at the ranch. I don't really know anything about fishing so I'm not sure what all that would include, but if you're seriously considering it and have any questions, call the ranch and ask for Karen! Also, since the river flows gently--and is shallow (a "river" out here is not the same as a "river" in the midwest or east!) your daughter might enjoy wading around in it (probably with a pair of cotton tennis shoes or at least flip flops since the bottom will be "rocky")! But she probably wouldn't stay in too long since water in the mountains is COLD--it's melted snow--and the ranch is at 8,000'! Also, if you're seriously considering staying there, PM me and I'd be glad to send you some more pictures of the inside (and outside) of the Hideaway cabin! I've stayed there three times now so I have pics of the outsides of the other cabins too. This is a favorite pic! I couldn't help but smile the first time I drove in there and saw the Welcome Home sign! I immediately knew I was gonna love the place! (The sign is on the back side of the "bathhouse" building that has the "waterfall showers!") And before I got to the welcome home sign (on the small building on the right) I ran into this roadblock on the drive in! (If it looks gloomy, that's because it was raining on and off on the drive from Pagosa to the ranch the first year I stayed there! Then, right after I got there, the sun came out just in time for sunset!) This was a view heading out of Pagosa toward the ranch that year! The ranch is in them thar hills! I also highly recommend the "Cozy House" at Dolores for the Cortez part of your trip, and would be glad to send you a bunch of pics of that place too to help you decide if you're interested. One more thing since Zinnia brought up Dinosaur Ridge! Just a little further down the road, in Morrison, is a place called Tiny Town! Perhaps in lieu of Little House your daughter would like to see some "little houses"---and other buildings! I don't have time to live link these pages, but here's a copy/paste link to their site, and if you google for images of Tiny Town you'll come up with lots of pics of the buildings with people standing by them so you can get the scale. I haven't been out to this place since the late 70's when it was a run down (tiny) ghost town all overgrown with weeds, but it's been all spiffied up and is back in business, and this could be a real fun Kid Thing! You could plan your whole last day to do Red Rocks, the dinosaurs, and Tiny Town, and then head to the airport for your last nite's lodging! http://tinytownrailroad.com/ Out of time for tonite! Upon further investigation I think I solved the mystery. This evening I took a flashlight and watched the area carefully. There are some small holes/gaps in the wood frame between it and the fireplace wall. I saw a medium reddish ant emerge just long enough to deposit something and then go back inside. So then I googled carpenter ants and saw this description of the signs to look for their presence and it sounded like what I pictured above: "ÂFrass, which is made up of wood shavings, bits of soil, dead ants and parts of insects. This material is often piled up outside of nest openings and found in spider webs and window sills." I'm guessing that some moisture may be getting in there which is probably what attracted the ants. Anyway, I'll have a pest control guy come and investigate to be certain.

"Upon examining our lease....it was discovered that I did not initial half of the places that required it on our lease. I also did not sign the very important section regarding DEFAULT BY RESIDENT. My roomate DID initial all of these places and did sign. The only portion my SIGNATURE is on....is the deal page where it talks about rent and deposit calculations. Is there any legal way for us to break this lease without having to pay?" NOPE! Contracts cover "reasonable interpretation", and minor omissions don't make up for your signing the big spots. I had a tenant try to weasel out of a lease: a typo made it for a negative one year (started in 1996 and ended in 1995) ... and they decided the lease was invalid a couple of months into the term and moved out. I sued them for the rent they owed, they said "the dates are wrong, the lease is invalid" and the judge said "Typos don't count, pay the nice landlord!". What you can do: whenever the music runs past 9 or 10PM, call the cops about a loud party. Whenever the upstairs kids are stomping and yelling, call the manager and ask him to shut them up.

I started off something is changing or about to and then you answered that question later in your post -- the providers are outsourcing the towers. It is a cost saving measure -- not only do they put maintenance in the hands of specialists who can work on any provider's towers, they are moving to combining towers so the hardware cost, the land rents, the need for number of people and locations are all reduced as well. Why can you not do the deals directly? Economics. You have one tower. You are inexperienced and are going to be in over your head. They won't want to deal with you on solo terms, They either have to stop and explain everything or you will be run over. It will take them far more time to deal with you than it is worth to them. It is also likely to cost you more time than it is worth to you. A good attorney in a specialized area would be cheap at $500-600/hr and could be $1000/hr or more (top guy -- who probably has associates and paralegals at a lesser rate doing some of the work and also billing). Every time you talk to them, they talk to the tower lawyer, read documents or do any work, you get billed. You would likely burn up years of the rent you are currently getting and it may outweigh the increases they would be offering for years to come. And that's not only the original deal, but wth any questions or problems down the road. My DH was involved in some licensing deals 7 or 8 years ago and they are still dealing with disputes on those. Not using experienced, specialized lawyers who know what issues to spot and forsee would be against your interests. Stupid in laymans terms. But again, it would cost them more money to deal with you as someone outside the game and they might not even talk to you. They have likely set up a system to have all their contracts the same and want to keep it that way for simplicity and efficiency. My guess is that you would get nowhere. They will wait for you to give up and come to them or find another spot and leave you out of the deal. What I would look at is whether you are willing to have the tower on your property for as many years as they need it? Does it limit your use, interfere with anything? Would it prevent you from leasing or selling the property down the road (a buyer might like the income, but depending on their purpose, the tower could get in the way and nix the deal -- but the income might also lessen the interest you have in selling the property). I get the frustration -- you don't seem to know enough to understand what is happening and what it should be worth to you. You want to make sure you get a fair deal. Your negotiation position is limited. I just entered cell tower lease in google and the first hit is for a group that says it works with property owners, government agencies, etc in negotiating leases (steelintheair - I know nothing about them, so proceed with some caution). I'm sure the will want to sign you up and claim a fee or possibly a percentage of the rents you would recieve. You could start with talking to someone there or a similar group. I would expect a strong sell and some pressure to sign up -- not unlike the personal injury lawyers on TV. But stand your ground and get questions answered first and make sure you understand what the will and won't do for you. Read carefully any contract they offer and consider having another attorney look it over to make sure you don't sign away something without realizing it. Know exactly what it is going to cost you to have them represent you and why it would be a benefit over not using them. Perhaps this group or another had contacted you or your neighbor. Compare notes. Your taller tower is likely worth more, so don't focus on dollars so much as concepts and rights in the deal (how add-ons are treated, whether rents increase over the years or with inflation, etc.). Don't be rushed into signing anything. Make sure you understand everything before you sign. Sleep on it, get away from it and make sure you don't have any forgotten or unrealized questions (you probably will at some point -- the pros get into years of disputes because what they thought was clear isn't so clear years later, but you want to minimize those issues). The values aren't likely to decrease in the short term. There is sometimes a premium for the last folks who sign -- but you risk them finding a way to go around you and having nothing at the end of your current term (maybe sooner if there is an out under the current lease). I've just scratched the surface and this is long. Haven't seen or read anything -- can you see why it could cost a small fortune to try to go it alone? On the other hand, for no real time or effort on your part, you could wind up with a nice stream of income -- but it isn't likely to replace your day job. Enjoy it, don't be run over, but don't get thinking greedy if you want to stay in the game. And that's about all I can tell you -- keep in mind I know nothing about any particulars and my answers are intended to be common sense replies to general questions, not particular legal advise. As my mom always said, it may be worth exactly what you paid for it. But I hope it helps at least a bit.
