Comments (16)Re: Pernetianas vs HTs I would guess that for an idea of the 1924 comparison, we would want to compare grafted or budded specimens. My own root Pernetianas so far seem more delicate and twiggy, and not as long-stemmed as what one would think of as a Hybrid Tea, but it might be a different story if they were grafted or budded (or grown in a friendlier climate like California, Southern France, or Catalonia)....See MoreCamille Pisarro for mike_in_new_orleans
Comments (2)Mike, China Doll is growing right in front of Camille and it gets sprayed, so I'm sure there is overspray. Camille has never missed a step and I did spray her a couple of times, though. Maybe Henri was just sulking and didn't like the spray, or it got too hot when I sprayed that day. These roses are on the southside of the house in direct sun most of the day, and it can get pretty toasty. Now that Camille is aging in the vase, the yellow is definitely showing. If you want to order Camille, I was very happy with the size and health of the roses I received from Amity. Just get your order in early because this rose sells out fast. BTW, Amity carries Henri. He is finally blooming and his one big fat bloom is ladeda beautiful! I can't wait until next year to see how these two bloom all summer long. I do so adore the Delbards. -terry...See MoreMike Murphy, England - and some of his conifers.
Comments (28)"Apparently GardenWeb have the right to use any photos posted on this site, and sell them on for profit for example." Well I wouldn't worry too much about that. As a practical matter I don't think they ever will. I can imagine a lot of different ways that could get them in big trouble. For example, just becuase some anonymous person on the internet posts a picture on this website, doesn't mean they have the right to do so (even if, under the terms of the website they say they do). And if they don't have the right they cannot assign that right to gardenweb. If gardenweb subsequent uses or conveys the property they are subject to the claims of the rightful copyright owner for infringement. They don't have a defense againt him or her because they are not 'in privity' with him or her, meaning they have no contractual arrangement with them. All they can do is ask the anonymous internet poster who wrongfully posted the pictures in the first place to make them whole, and good luck with that - That's a useless worthless remedy. You probably couldn't find them if that person was smart enough to register anonymously. Just sign up and post anonymously, if they use your pictures say they don't have your permission, if they claim to have that permission ask them to prove it. How can they respond? "Well Joe Smith, screen name "treelover" said it was his and he assigned us his rights". To which you would say "I don't know who joe smith is - stop using my property or I'll sue you." that's just one scenario. Lawyers are smart and draft things in such a way to confer every possible advantage to their clients, but ultimately it would be foolish to try and profit from using member's pictures, or excuse me, pictures that allegedly belong to the member that posts them ;)...See MoreRichard Owens Nursery/ExcitingGardens.com
Comments (13)I had an awful time with them too. Maybe my situation was a fluke, but after looking at other people's similar reports, I don't think it is. Here's what happened: I ordered $134 worth of plants and seeds in early September, 2012 and my credit card was immediately charged on the 11th of September. Two weeks later, I emailed asking for a status as I had heard nothing. They emailed back stating that the orders were about to go out and I should have mine soon. I still had nothing by 10/18/12 and so emailed again to cancel the order. (these are garden plants and it was starting to frost, so I didnt want to try and get them in the ground) They told me on 10/23/12 that I couldnt cancel as the order had gone to the shipping department and was irreversibly scheduled to ship. I said that was fine and would return the package. When I received the package on 11/7/12, I immediately returned it that day, unopened to the Post Office and refused the package. I emailed the company that very day and told them it was refused and would be coming back. They acknowledged that and said to please allow 2-4 weeks for a refund. As of 12/30/12, I still had no refund, 8 weeks later. So I emailed again. They told me that they had received the return but there was "no correspondence" in the package (which of course was unopened as it had been refused) to tell them what to do with the return. I replied that there was indeed email correspondence with customer service and that I wanted my refund. On 1/4/13, they replied that they would issue a refund in 1-2 weeks. That never happened. So, I finally filed a dispute with my credit card company (go Capital One!!) and they got my money back for me. Richard Owens tried to issue only a partial credit of $120 and Capital One had to get the rest of it from them. At least they issued a credit and this is resolved, but what a hassle. I feel I was more than patient with Richard Owens Nursery, worked with them as much as I could and finally had to solve it by disputing it. I'm filing this report after searching the internet and seeing dozens of other people have had the same problems as me with this company. I don't like seeing this sort of thing going on and feel that by reporting it to the public, the company will perhaps improve whatever problems with their internal systems have created this situation....See MoreElmer J Fudd
