Damaged bath tub in new construction

Hello all,


We are having a new construction home built by local builder.


Noticed that the second floor bath tub ( there is plywood and wood between the floors) has been damaged. Please see pictures. There appears to be a hole in the base and multiple scratches and deep pits through out. The tiler could have damaged it while doing repairs. We have initial walkthrough coming soon. I want the tub to be replaced. But am not sure if it will available before closing. Can it be repaired with epoxy etc.? I am also worried about the long term damage to the floor if there is some on going leak.


Also the kitchen stainless steel sink has a circular scratch in it. Should I ask that to be replaced?


Please please advise.
