Neighbor cause water damage to my condo - help!
Comments (21)My husbnd is in same situation, more or less, as tarakari, which I'm pasting below. We haven't seen any response to tarakari's question. The tenant next to my husband's condo unit is angling to get him to replace her entire floor because we can't find laminate flooring to match the 4 ft x 4 ft area damaged 2 months ago by seepage from a bathtub drain leak in my husband's condo unit thru the common wall. Now the neighbor claims the damage is "spreading"--two months later?? Today, I got a call from the owner downstairs telling me i have to pay $12000 in damage to their floor. She told me that the damage is to a small area but her contractor said that they can't find a matching color for the flooring so they will have to redo the whole floor. Is that right? Do I have to pay for the entire flooring? or just the damage area regardless of whether it matches or not. I don't think it's my responsibility to pay for the whole flooring just becaue it doesn't match. Please help me on this. What do I do? I'm panicking here. I don't want to go through a lawyer. Comments (20)Small claims is the way to go. Your demeanor goes a long way with a judge, don't interrupt, talk to him not the person you are suing. I have sued 3 renters in small claims over 20 years and one future renter sued me. I won all but the one where I was sued. She backed out of renting the place after she put down a deposit of $200. I would have returned her deposit right away but she wrote me a threatening letter telling me if I didn't return her the deposit in 10 days she would sue me. Well, that did not set to well with me. A landlord has 30 days to return the deposit in this state. I waited 2 weeks and returned 3/4ths of it. I kept $50. for what she cost me. She won, but only $8. The judge was very pleased with me and told me so.....for giving part of the deposit back, he helped me with what she cost me. I owed her $8. and he may her pay the court costs which were $13. Comments (18)The storey and one half home I grew up in constantly had ice dams, some so bad there were dangerous icicles hanging down. Totally insulating above the soffits would not solve the problem as the soffits were vented thus cold air was constantly entering the home and you never want to plug the vented soffits. The permanent solution was to lay thermostatically controlled electrical heat tracing a foot above the eaves. Not exactly economical but less expensive than the deductible for insurance claims. and no ice dams for the last 20 years. Comments (4)Maybe someone else has, but I've never heard of a case in which the size of the house affects the cost of a leak repair. I suppose it's possible that some tradespeople might bid higher if you have an imposing chateau and they think that you can afford it! :) Without seeing the situation it's impossible for anyone here to guess what the cost might be. Even then, local costs vary widely, to say nothing of differences from country to country (GW is mostly US-focused). Tradespeople in rural areas and small towns seem to charge significantly less than those in big cities where the cost of living is much higher. In my very limited experience, that seems to be as true in Europe as in the States. Your inspector's estimate may have been unrealistic. I don't know about inspection practice in the UK, but here in the States, inspections are optional (not required by law) and are paid for by the home buyer. Often the inspector is hired at the suggestion of the buyer's estate agent handling the transaction, who has an incentive to recommend someone who won't discourage the sale. I suggest that, if you haven't already, you contact a few other tradespeople and have them submit their own bids. Good luck!...See MoreJoseph Corlett, LLC
