Backyard/Pool Design Dilemma

Hi All,


Our backyard and pool design (new construction) is in jeopardy as we just discovered an ordinance dictating that our backyard must get down to existing grade as quickly as possible or reasonable. Currently our backyard slopes down to the east and south about 7.5 feet from 854.5 to 847. We had planned to regrade to 853.5 and use a retaining wall that maxed out at around 5 feet around the backyard near the property line. Our building official says our retaining wall can be no higher than three feet and he wants us to get to 850 or below more quickly, although he hasn't defined for us exactly how quickly is necessary to meet the ordinance.


Our space is tight and the pool already touches the pool setbacks, which are fixed. In the attached photo the right side of the pool runs along the east/west pool setback and the far side of the hot tub touches the north/south setback. Currently, we have four access points from the house to the pool, including from left to right 1) garage/basement 2) family entry 3) lanai/3 seasons room 4) master bedroom. The house sits at 855.6 and when you currently step out you are at 854.5. How do we get down to 850 "quickly" or "reasonably" and still have enough room for the pool and spa? I thought maybe this group would have some creative ideas beyond what are the obvious ones (eliminate the hot tub, make the pool smaller, 8 steps immediate down from the house, etc.). We are also looking at maybe flipping the hot tub and pool, and putting the hot tub on a higher level with some steps down to the pool level. Obviously anything hinges on the subjective judgment of our building official, who seems reasonable and wants to work with us, but clearly won't approve what we have now.


We also have to eliminate our gazebo over the outdoor kitchen/bar as it puts us over our lot coverage, so that will likely become a pergola but we plan to keep the kitchen and bar (though the location could change). I appreciate any thoughts/suggestions.
