Comments (96)((((iyanini14)))). I feel for you and wish you luck. Some years ago we were building a home and had to run off our builder... fired him. Finished it ourselves hiring our own subs and learning along the way at 1/2 complete. Never again. Uhg. Hmmm. After well over a year since I started packing and we moved all furniture out, 8 months with a temporary kitchen, 6 months now with no kitchen, and living with no furniture except the bedroom, no flooring (Much is DIY)... we are finally seeing the light.. or I should say a glimmer! Flooring is in (and covered with Ram Board, which was a bummer as we loved looking at something complete!). The cabinet maker said they'd start putting cabinets in soon as we finished painting and installing our baseboard (week after next I hope!), but then we've got the vent to install and vent cabinet, a pass-through window to finish, and the glass people (for the cabs) are special ordering, so that's a while away. Still, we have much electrical, plumbing, and purchases to do. I'm still hoping for June. Ha! I hate all the purchases! First you have to figure out what you want, then you have to pay for it! Good heavens, I see now why faucets and pulls are called "kitchen jewelry"! My sanity has been pretty good despite set-backs. The two things I love are cooking and gardening. Without a kitchen, no cooking, but we simultaneously started working on our landscaping (older 20 year old home, dire need for re-do everywhere). Comments (63)Just to be clear, I don't see causation for the developer, it isn't that you and your attorney can't argue causation for the developer, feel free to sue him and roll those dice, but it is an expensive get. Your chances of winning are much less than they are against the builder, and you are unlikely to be awarded attorney fees on a negligence case with this many questions. You must show that the developer had a duty and but for neglect of that duty your house would not have these issues. There are many problems with this assertion, first, and hardest to overcome, is if you knew the approved builders before you bought the lot then you found them acceptable. You have to prove that the developer had a duty to the homeowner. Someone please tell me how selling a lot with certain covenants and restrictions creates a duty for him to fully insure the benefit of those covenants and restrictions that supersedes your acceptance of those covenants and restrictions. That is just one of the three things that you are going to have difficulty overcoming. Once you establish duty, you have to show that there was no reasonable action available that would negate the damage, noting that there are other builders available you would have to prove that they all have similar issues. Once you get past that, you have to prove that the developer actually neglected his duty, which since he has kicked the builder off the development is another tough get. It just seems like a tough win, that is going to cost more than you end up with. Sorry, but that is my opinion. ---------------- Along with my father I have developed several mixed use developments (homes, apartments and shopping), and I am currently a member of an LLC developing a small shopping/condo warehouse district development. I am not saying the developer will not want to help, I am saying as a developer, access is the leverage I have (the money that builders can make from me). Once the builder is removed he is going to tell me to go pound sand. I will happily testify on your behalf if need be, however, if I start paying for things to get done I am opening myself up to an argument that I accepted responsibility. As much as I want financing and publicity to be positive, that has to happen on the front end. Comments (97)@lyfia It will not impact us moving in or anything, but it is an issue if the lien claimant(s) decide to file to enforce the lien, which they have 6 months to do. If we're not able to convince the lien claimant(s) that we've already paid. Then this thing would go to trial. The courts would decide who, if anybody, we have to pay and how much. At least that's how I understand it. I do hope that we can successfully get the liens off without going to trial. We will see.. Today we received another lien notice...for $26K for cabinets and countertops. I guess I should probably shut up now. Comments (37)You don't necessarily need humidifiers and dehumidifiers to maintain consistent humidity levels in Hillsborough. What you need is a tight house and the sealed crawlspace helps for sure. I had a humidifier in my last house and my current house does not. There has been zero difference in humidity fluctuations. Beach and mountains - different story. Right now is a particularly high humidity in my house at 55% - mostly because no HVAC at all. But not sure I would want a dehumidifier running now since the humidity will fall once the sun comes out I suspect. The absolute only time humidity gets above 55% is when we cook a bunch and run the venthood for a while. Just making the point that infiltration drives humidity. Similarly in the winter, running the venthood will drive it down. But I haven't seen below 40% and that is a pretty typical setting for a humidifier. So if we had one, it would never run. I would personally wait on the humidifier and see what happens. Presumably in Hillsborough, your house is built fairly tight but no guarantees. Work in Raleigh? or at least used to?...See MoreIzzy Mn
