Builder says he cannot fix warped baseboard during final punchlist wal

I signed a purchase contract for a new construction home that was already built. During the private home inspection I noticed there was a warped/bent baseboard in the kitchen. I brought it up to the builder during the final punchlist walkthrough and he said he could not fix it because there is misplaced pipe causing the wall to bow to accommodate the pipe. I am ready to lose $3000 in earnest money if they dont fix the eyesore and just walk away from closing. Am I being unreasonable? I think it is ridiculous that at no part of the process did they try to correct the issue by adjusting the dry wall/pipe/stud etc. Plus the builder wouldn't even acknowledge it was an obvious, glaring, cosmetic defect. I know I have two options 1) close and accept the bent board or 2) lose earnest money and start all over. I'm just looking for different perspectives...
