Replacing a tub without retiling surround

We are trying to get a standard size jetted tub replaced by a standard size non jetted tub. Our GC said that this could be done by just removing the bottom row of tile that goes over the tub flange and installing the new tub and retiling. However, either the new tub is slightly smaller than the old one, or maybe the wall studs are slightly uneven, but one one end of the shower/tub alcove the backer board is not flush with the tub flange (not in the same plane). On the right side of the photo the the backer board ends just above the flange, but on the left side not only is it 1/2 inch above the flange but also 1/2 inch behind. Is there a way to deal with this without removing all the tile and backer board and replacing the studs?

Also, is the tub secured to the studs correctly? I only see it nailed to one stud of the three...
