New construction issue - mold & cost

We are closing on a newly built home in the coming weeks. Approx. 4-6 weeks ago, we happened to be there for a meeting and saw cleaning crew guys in hazmat suits and the contractor's response when questioned was "Oh, there's a little mold in the crawlspace and they're cleaning it up.' A couple weeks later, all the crawlspace insulation had to be removed, structure cleaned, and all the insulation had to be replaced. My wife happened to stop by while the cleanup guys were there and their response was "The insulation was installed before the crawlspace dried out and it molded."


We have a construction loan and receive invoices each month as it progresses. The contractor billed us $2900 for the cleanup and $450 for new insulation and said it falls under miscellaneous expenses. We argue that if he as the contractor in charge had the insulation installed before it should have, he's responsible for the mistake. Anyone with experience in this type of situation who can weigh in on who is financially responsible?
