Thank you all for the support with this drama. I need it. So this KD's list of changes say only this for the countertop: "MAKE ALL NECESSARY ADJUSTMENTS TO C/TOPS IN KITCHEN". So I wrote back, saying this leaves way too much open for interpretation. I would like specifics in writing, for both of our sakes and the builders'. Such as, the countertop overhang will be even throughout with up to 1/8th inch variance (now it's anywhere from 7/8ths to 1 3/8ths). And, the overhang will be a minimum of 1 1/4th inches, for example. Things we should have had in the first place, and what I wanted and requested, but they went ahead and did their own thing. Her response: "We will make adjustments as necessary. Please just let me take care of this, and I'm sure you'll be satisfied with the final results." What???!! I contacted the builder, who said, " I was assured they are addressing your concerns so we will move on to things we need to do at this time." The builder has been cc'd on the email exchange above, but has remained silent on whether they think it is a good idea for the countertop company to actually specify what they are going to do. kirkhall, countertops and cabinets are already paid for, unfortunately. If this wasn't through a builder, I never would have paid for work 100% in advance. Also, I asked for specs and design in advance, several times, and never got them. loves2read, we went through several of their houses early on, but none recently and I don't remember the countertops. I'm pretty sure if we asked now to go through a few houses, they'd know exactly what we were after. I've tried to find some pictures of laminate clipped corners online and was having some difficulties finding good pictures. So the way it is going is that the countertop people told the builder they would fix it, and the builder said "okay good", and that was that. I am the one asking for how exactly and specifically they plan to "fix" it. Autumn, I thought 1.5" was industry standard too, and I think it is for granite. Laminate though seems to vary, and some places really do 1", although that makes no sense to me and I don't think it looks very good w/ full overlay doors. I called Home Depot and they said usually they do 1" overhang-- 25 inch counters. So I fear I may be stuck with the 1" overhang if they do manage to make it even. I try to get everything in writing, but the agreement on 1.5" was verbal, and she is claiming she never said it now. Which is why I did request the design template, which she didn't give me. ANYWAY, I feel you Autumn all the way as I am very detail-oriented too. It is really hard for me as well to let go, and I am especially hard on myself when I think I picked the wrong thing or let something go that I wished I hadn't, ect. And you DO have a gorgeous house. :-) Isn't perfection the enemy of good? The pursuit of perfection is also the enemy of happiness, in my opinion. Though I do it anyway.... The builder has been really good about fixing other sub mistakes. It is this KD, who is in charge of cabinets and countertops, who I've had issues with since the beginning. The builder's manager, who is our primary contact point, seems to be pretty good friends with her. And there is the issue right there. And why my battle is probably a losing one. But just venting and having your empathetic "ears" has been so very helpful. Thank you so much.

When I worked as a personal financial advisor, I recommended that my clients have 3 - 6 months' worth of income available as an emergency fund, available in case of need. If they could survive for a year without any income ... so much the better. But ... I didn't have that, myself, and haven't for a number of years. And as my clients became more knowledgeable about how money works, I explained to some/most of them how I operate, with my reasons. For working people, they must continually be in sufficiently good physical, mental and emotionl health to go to their workplace and carry our their required tasks there ... or they don't qualify for that essential paycheque! Plus ... hope that their employer doesn't go broke, close the business, shift work offshore, or get amalgamated with another company, merging the employee's work into the other home office, etc. Now, as a senior, in receipt of two government pensions, one of them contributory, plus a private pension, plus a tax-deferred retirement account that requires an annual withdrawal amount of about 7% up to 10% or so, increasing with age to 20% at age 90), plus I can withdraw more, if I choose (but every dollar taxable) I do not have such a requirement. All that I need do to qualify to continue to receive my pensions ... ... is stay topside the grass! So - I have darn near a guaranteed income ... till the day of my death. Quite a comfortable position in which to operate, I figure. Sometimes I have some readily-available cash, sometimes not ... but that doesn't trouble me. I carry a credit card. If I have an emergency, I'll use the card to pay for whatever I need. I have a Line of Credit, fully secured by mutual fund and stock certificates, that sits unused, most of the time. There was no set-up fee, and there is no maintenance fee if I let it lie unused. Its main purpose is to use when it suits me to purchase investments, if I lack the cash at the time. If I were to use it for funds to be be used in an emergency, most of the uses being not deductible, I would set up a separate line of credit, having certificates issued as needed, to provide the security, so that I have one fund for deductible situations, one for non-deductible emergency use. When I receive my account next month from the credit card agency for the amount owing, I draw a sufficient amount from the non-deductible line of credit to pay that amount in full, thus avoiding interest cost re the credit card. Interest on the line of credit now is 5.25% ... and I'd try to pay it off from current income as quickly as possible. And leave the line of credit that I use for purchase of investments, making the interest cost deductible, uncontaminated by a loan used for non-deductible purposes. Also, I feel comfortable, as I approach age 80, at carrying 80% of my assets in equities. As you know, the stock markets are down, now. Suppose I have an emergency develop tomorrow that requires a substantial amount of expense. Would I sell some of my equities, probably at a lower price than they usually run? Sometimes some of the market is down and other parts are operating at approximately their usual levels. If there were some parts that I might consider to be not undervalued, I might liquidate some of them. But probably I would not. I might liquidate some mutual funds, as I have grown increasingly unhappy with them over recent years. If I sell some stocks, there's the commission to sell them. Then, if there's been a capital gain, I must pay the income tax people a portion of that gain, next year. Then, when I accumulate funds to purchase more stocks, there's commission to pay once more on my purchase. When one considers those costs, often its wiser just to initiate a temporary loan to deal with the emergency. Not only that ... it has been my experience that, after a period when stock markets were undervalued, when the recovery takes place, there is substantial increase in value within a year or two or three following that low market period. I would very likely make a loan, pay it off in part over the intervening period and liquidate some assets as needed after the recovery in order to discharge that loan. If I can make 25% more on an sale of an asset over a couple or three years ... I don't mind paying 5.25% annual interest. I don't have large worry over medical and hospital costs ... if I were a U.S. resident, with higher potential medical and hospital care costs, I might evaluate the situation differently: but possibly not much differently, even so. I started off something is changing or about to and then you answered that question later in your post -- the providers are outsourcing the towers. It is a cost saving measure -- not only do they put maintenance in the hands of specialists who can work on any provider's towers, they are moving to combining towers so the hardware cost, the land rents, the need for number of people and locations are all reduced as well. Why can you not do the deals directly? Economics. You have one tower. You are inexperienced and are going to be in over your head. They won't want to deal with you on solo terms, They either have to stop and explain everything or you will be run over. It will take them far more time to deal with you than it is worth to them. It is also likely to cost you more time than it is worth to you. A good attorney in a specialized area would be cheap at $500-600/hr and could be $1000/hr or more (top guy -- who probably has associates and paralegals at a lesser rate doing some of the work and also billing). Every time you talk to them, they talk to the tower lawyer, read documents or do any work, you get billed. You would likely burn up years of the rent you are currently getting and it may outweigh the increases they would be offering for years to come. And that's not only the original deal, but wth any questions or problems down the road. My DH was involved in some licensing deals 7 or 8 years ago and they are still dealing with disputes on those. Not using experienced, specialized lawyers who know what issues to spot and forsee would be against your interests. Stupid in laymans terms. But again, it would cost them more money to deal with you as someone outside the game and they might not even talk to you. They have likely set up a system to have all their contracts the same and want to keep it that way for simplicity and efficiency. My guess is that you would get nowhere. They will wait for you to give up and come to them or find another spot and leave you out of the deal. What I would look at is whether you are willing to have the tower on your property for as many years as they need it? Does it limit your use, interfere with anything? Would it prevent you from leasing or selling the property down the road (a buyer might like the income, but depending on their purpose, the tower could get in the way and nix the deal -- but the income might also lessen the interest you have in selling the property). I get the frustration -- you don't seem to know enough to understand what is happening and what it should be worth to you. You want to make sure you get a fair deal. Your negotiation position is limited. I just entered cell tower lease in google and the first hit is for a group that says it works with property owners, government agencies, etc in negotiating leases (steelintheair - I know nothing about them, so proceed with some caution). I'm sure the will want to sign you up and claim a fee or possibly a percentage of the rents you would recieve. You could start with talking to someone there or a similar group. I would expect a strong sell and some pressure to sign up -- not unlike the personal injury lawyers on TV. But stand your ground and get questions answered first and make sure you understand what the will and won't do for you. Read carefully any contract they offer and consider having another attorney look it over to make sure you don't sign away something without realizing it. Know exactly what it is going to cost you to have them represent you and why it would be a benefit over not using them. Perhaps this group or another had contacted you or your neighbor. Compare notes. Your taller tower is likely worth more, so don't focus on dollars so much as concepts and rights in the deal (how add-ons are treated, whether rents increase over the years or with inflation, etc.). Don't be rushed into signing anything. Make sure you understand everything before you sign. Sleep on it, get away from it and make sure you don't have any forgotten or unrealized questions (you probably will at some point -- the pros get into years of disputes because what they thought was clear isn't so clear years later, but you want to minimize those issues). The values aren't likely to decrease in the short term. There is sometimes a premium for the last folks who sign -- but you risk them finding a way to go around you and having nothing at the end of your current term (maybe sooner if there is an out under the current lease). I've just scratched the surface and this is long. Haven't seen or read anything -- can you see why it could cost a small fortune to try to go it alone? On the other hand, for no real time or effort on your part, you could wind up with a nice stream of income -- but it isn't likely to replace your day job. Enjoy it, don't be run over, but don't get thinking greedy if you want to stay in the game. And that's about all I can tell you -- keep in mind I know nothing about any particulars and my answers are intended to be common sense replies to general questions, not particular legal advise. As my mom always said, it may be worth exactly what you paid for it. But I hope it helps at least a bit.
