Stain doesn't look like anything that we thought, what are my options

We bought an older house and decided to sand the light oak floors and stain them darker color. Our contractor used Old master's spanish oak but it was never in stock so we decided to mix jacobean and ebony from Minwax. When he applied it out bathroom, we could still see the yellow of the oak floors below it and some of the lines in-between (where two tiles connect) showed through. Some places it was terribly dark and some light like a child had painted it. When we asked him, he said its coz the wood is uneven and he's been doing this for 22 years. I'm confused it it the stain or workmanship. What are my options? Should I get a second opinion. It's so much work and money involved, besides the fact that we can't move into the house till its done, everything is getting delayed. Any advice would be greatly helpful!
