HERS certification failure in CA - consequences?

OK, we have a 1985-built house, and we know that HERS certification is part of the California requirement when the HVAC system is replaced.

It is unlikely that our system will pass HERS inspection, since the builders set the original system up to vent the conditioned air into cabinet toekicks in both bathrooms, the kitchen, and the laundry room.

The HVAC will have a new plenum and high-efficiency exhaust, but since all of the ducting is enclosed in sheetrock in the living area, we have no way of getting to the ducts and re-sealing them without ripping off sheetrock throughout the house.

So - if we fail the HERS test, are we REQUIRED to rip open walls and seal the ducting in inaccessible areas?
We've been unable to get a simple answer to this, even reading the Title 24 regs and FAQs on state websites...
