Need legal advice, in regards to my late father's business. Help!
Comments (20)missingtheobvious is correct. In New York, the supreme court is the court of general jurisdiction that hears cases. It is the opposite of most states and the opposite of the federal court system. I have a law degree but don't practice law and am not well versed in estate law. THIS IS NOT LEGAL ADVICE. However, as far as I know, she can't come after you personally. She can only make a claim on the estate. I believe if the estate is probated already and sufficient time has passed without her making a claim on the estate, she is out of luck. See e.g. http://codes.lp.findlaw.com/nycode/SCP/18 § 1802. Effect of failure to present claim If any claim is not presented on or before the day fixed in the notice published pursuant to the preceding section or if no notice is so published, within 7 months from the date of issue of letters, the fiduciary shall not be chargeable for any assets or moneys that he may have paid in good faith in satisfaction of any lawful claims or of any legacies or distributions to the legatees or distributees of the decedent before such claim was presented. Such 7 month period shall begin on the date letters were first issued to any fiduciary, including a temporary administrator or a preliminary executor, and shall not be interrupted by any subsequent issue of letters, except that the time during which there is no fiduciary in office shall not be counted as part of such period. and § 1803: Every claim against the estate of a decedent other than claims for expenses of administration and claims of the United States or the state of New York must be in writing, contain a statement of the facts upon which it is based and the amount thereof. In addition the fiduciary may require the claimant to present proof by affidavit that the amount of the claim is justly due, that all payments thereon, if any, have been credited, that the claimant knows of no offsets and no evidence of indebtedness and holds no security, except as specifically described in the affidavit....See MoreHelp Please! Comments (22)The 14’ is kitchen only. The counter that is there with the curtain is temporary. It will be removed and I have a pantry that matches the cabinets that will go there. The pantry goes all the way to the ceiling The fridge is a moved from the wall to hang sheet rock. My husband plans to put a cabinet around it and I have another cabinet/coffee bar that will go to the left of the fridge. I guess I should have waited to post the pictures when that was all in place. The door to the right of the fridge lead to a walk-in pantry. We are changing that door to a sliding barn door. My husband is an experienced DIY’er and can make the tops to the cabinets as you all are describing....See MoreHelp please...Need advice on Kitchen deco after water damage
Comments (14)Hi HU- I don't know anything about refinishing granite to give it a totally different appearance. The person to ask about everything countertops is Joseph Corlett, LLC here on Houzz. Why not invite him onto this thread? I personally don't like that speckly type of granite, it reminds me of "work" because it is present in so many office buildings. But if you like your granite, keep it. It's your house! And it's a fortune of money to replace it, besides! If you were going to replace it anyway, you could think about using a stone with swirls or some sort of movement, but one that is lighter overall. Or go the other way, and use a very dark counter such as a soapstone, or a soapstone look-alike (and you could decide how much veining you want) and paint the walls a very very light gray in the kitchen. (Soapstone even comes in green!) Or you could even think about Corian. Which now comes in a dazzling array of colors and a very affordable price point. Joe is a Pro, and really sings the praises of Corian which is versatile and lasts forever and can be repaired in ways natural stone can't. As for the flooring, I would have the kitchen match the rest of your house. What you already have down looks just perfect. If you are really wanting to spend money on something, I would eliminate the space at the top of your upper cabinets. Either make simple cabinets for things like trays, etc. or put up a crown molding to the ceiling. The space looks odd and is a huge dust catcher. I would not paint the island, the wood is too perfect. You can add color to the kitchen with a floor mat, dishcloths, accessories, etc....See Morekbear_15
