I've had several bad experiences with sellers-items that never showed up, received a glass pitcher broken in shards. Tried to deal with the sellers. Some are nice, some not. You are basically at their mercy. One told me "It's your fault because you didn't buy insurance!" If he's not returning phone calls, give up and find another gift. And don't try Ebay Resolution center. They have so many "rules" you'll never get satisfaction from them! Is it possible to contact your bank/credit card company and get your money back thru them? Sorry if I sound cruel. I consider Ebay a total gamble. I never expect anything will be as perfect as it sounds.

If you used paypal - open a complaint for investigation. 99.9% of the time paypal chooses in favour of the customer. You should get a full refund to your account.

I've had this happen to me, unless the seller can prove his shipping with a signed postal receipt, it is the sellers responsibility, irregardless, to prove that he mailed it to you.

I know from first hand experience.

Contact ebay immediately from your purchase site (where you can see what you've paid for) and start from there to lodge a non-receipt complaint.

Yes if you paid with paypal and the seller can not show that the item was delivered with delivery confirmation then file an item not received claim. Unfortunately unless you added the address that you wanted it delivered to in your paypal account, you may be out of luck. File with paypal rather than ebay as ebay is slower and not as reliable as they are still in the learning stages.

I consider Ebay a total gamble. I'd done well over a 1000 transactions on ebay and only have had a few issues.. some with buyers not paying and that sort of thing.. but only 2 issues with things I purchased. One item I lost my money on, the other I thought I did too.. but 6 months later the guy mailed me my items with a letter about how all these bad things had happened to him (a car drove into his house, etc.) and that he couldn't find the things he had sold. If eBay is a gamble, it's a winning one IMO.

I'd file a dispute with Palpal. They are VERY fair!

Well I looked and the seller has over 67,800 transactions. he has an almost flawless 5 star rating except for shipping charges which most buyers complain about everywhere. Has 6 negatives over the past 12 months and only two of them weren't resolved to everyone's satisfaction. One "neg" said "fast shipping" so I assume that was a buyer who hit the negative button by mistake.

At this time of the year I don't think a power seller will be returning phone calls in a too timely manner. Email might get you a better response.

I'm going through a similar issue. I bought something I need by Xmas from a seller who had excellent feedback until
right after I purchased an item. Suddenly they have 27 negs from a bunch of irate customers during the last 3 weeks. I emailed and the seller has been very responsive. Doesn't know if he can get the item out but is doing his best. If he doesn't succeed we've already agreed to cancel. Stuff happens. I'm for doing everything one can to resolve an issue before filing a dispute. It's a busy time of year. Everyone makes mistakes.

Kind of cold to slam him on a forum because something went wrong with your order and they aren't by the phone at your convenience. Email. Nicely. It might get better results.

When did their terms of shipment state the item would go out by? Since you ordered the item on Thanksgiving Day, I would think it probably didn't get mailed until the week after --Maybe even into December. Unless it went out priority or first class, it may take several business days for the item to get to you during the Holidays/and snow.

How many business days did it say it would take?

I would wait a full three calandar weeks starting the Monday after Thansgiving until I filed a claim. Just give it a little time.

Since the seller has a score of over 67,000 and looks like he tries to resolve any problems, I wouldn't worry; this isn't some first time seller.

I got $225 back using PayPal's dispute center for an item that wasn't as described. And I got to keep the item as well since the seller never got back to me.

Always use PayPal.

Heads up: I said a posting on Craigslist asking to take over someone's established Ebay seller's account as long as it has a 100% rating with XXXX number of feedbacks. I thought that was quite odd that someone would do this and it made me wonder how often this happens.

So sorry this happen to you, Sharon. I have not had an ebay seller jilt me, but the odds say are my day is coming. The suggestions above are good ones. Hope you can get this resolved expediently. Good Luck!!!

Thanks for all of your comments & suggestions. There is NO 'contact the seller' via email (where it usually says- "ask the seller a question")-was not on the item's page. I linked to his store & got his phone number and called him. The item I bought stated it would be shipped from 12/01 to 12/07. Well...as of right now-that's yet another 6 days from the time he said it would be received.
We had a nice talk the only time he answered the phone-as he's in PA-and that's where it was to be shipped to-to my son's home. Whatever-thank goodness it wasn't alot of $$-under $20.

Hmmm.... does't eBay now require folks to pay by PayPal? And aren't sellers only supposed to ship to addresses that are verified by PayPal? So, if you purchased something and asked for it to be shipped to some other address, I don't know if a dispute filed with PayPal would end up being decided in your favor.

I made the mistake of filing a complaint with Paypal. Their rules require you to wait until your rights to contest are over. I should have known better. Then of course they backed the seller. No way will I make that mistake again. Now if there's a problem, I'll work with the seller first of course, but Paypal gets one chance, then I cancel the charge. Paypal of course wants to hold the money. However, only one bad transaction and others are smooth and with the exception of their flaky resolution policies Paypal is a good way to go for the most part.

Didn't the seller give a tracking number? Ask for it. I agree that slamming someone in a forum is tacky and it's non-productive in reality anyway. Millions of people doing business, the odds of knowing this one are nil. Plus if I have a good transaction with him I'd likely do business with him again.

BTW, do I understand that you didn't have it shipped to you? That you shipped to a third party? That can open up a different issue or two also...

I sincerely doubt eBay or PayPal will side with you on this because sellers are only supposed to ship to verified PayPal addresses.

And if the total amount is under $20, there comes a time when you're losing money by spending too much time on this. For me, $20 is half an hour's pay, so if I were in this situation, once I'd spent 30 minutes haggling with the seller over this, I'd write it off as a lost cause.

I don't buy a lot on ebay but I've always had very good luck with my purchases. File a complaint and put honest feedback on the persons page.
