How old is SD?

My step daughter is 7, 8 in October.

So she has a had a tough time -- parents split up when she was very young.

her mother began an affair when she was 18 months old with a work collegue. My hubby did try to make it work but she continued the affair. Told my husband of it on fathers day.He had her back 3 x but she continued with the deceipt. Ex eventually left when sd was 3. I came along about 6/7 months later. Things were great to begin, then about 1 year on, the fun and games began. I have been writing a diary if you are interested.

Hubby needs to say well its my time with her and I'll be by at _____o'clock to get her make sure she is ready.

If she was to be going back to mom's and he didn't bring her because she was upstairs playing would that be ok? No she would get ready to go.

I agree with cawfecup... and so would the courts. If a valid child custody agreement is in place then his time is his time... She has no say in the matter. It doesn't matter whether she is sick or just not wanting to come. Many court are over-turning current custody orders where the non-custodial parent can prove that the custodial parent is trying to damage the parental band between NCP and child. In several cases that I know of personally they went back and turned custody over to NCP! The fact that she wouldn't allow him to speak with his daughter is proof enough that she is obviously lying about her not wanting to come. Also courts have been known to lower child support immensely if the NCP is denied access repeatedly to their child. Your Hubby just needs to make it clear and say "The court order states that I am to pick her up at ___ o'clock on Friday and return her by ___ o'clock on Sun" and then document each time he is denied by BM.
