How do I go about the adoption process for my son?

I live in Cherokee County, Ga and am getting married in a few days and my fiance wants to adopt my 2 year old son not to long after. My sons bio father is not there for my son at all really and has only seen him once since he was born, calls every other week, and does not even contribute any support at all. He left me a week before his own flesh and blood was born for my so called friend and moved to Idaho. I lived in Arizona at the time and he was not put on the birth certificate because he was not there to sign it cause we were not married. My fiance was there for the birth and has been taking care of my son as his own since. Do I have to have the father sign over right even if he does not even care about the adoption and is not on the birth certificate? I do not have a address for him and he moves to much to even send him anything. I do not know how to go about the adoption process. We are trying to do it as less expensive as possible. Does any one know how to even get it started and what should I expect? How long does it take? And do I have to file in the same county??

I think the first thing to do would be to call a lawyer.

My DH went through a court battle over his DS recently. I have a DD whose own father is non-existant. No child support, no contact in over 6 years, etc. My DH asked the GAL about adopting my DD and the GAL said to wait until he had been married for a YEAR.

I don't know what the reasoning behind that statement was? It may be that he just has seen too many step-parents adopt a child, only to wind up divorced from the bio-parent, and that he thinks it's wise to not rush into anything. OR it could be that a judge is more likely to grant an adoption if a couple has been married for at least a year.

If the father is not on the birth certificate, I'm not sure how that works. Have you ever gone to court? Has paternity been established? My DD's bio-father is not on her birth certificate, either, even though we did go to court and he is legally recoginzed as her father. He was court-ordered to sign it---but that costs $25 (GASP) and he, I guess, never felt like paying for it. Oh well. I could care less.

Anyway, I would consult an attorney.

There is a lot of reasoning behind waiting a year after you get married. First of all, sometimes non existent parents find out you are remarried and all of a sudden, they pop out of the woodwork and want to reclaim their family/child. It isn't about the child, it's about their insecurity and having some other man/woman raising 'their' child.

Then there is the issue of second marriages having a higher divorce rate than first marriages and adoption, unlike marriage, cannot be reversed. It is a legal obligation until the child reaches majority and you cannot divorce an adopted child.

angelnetta, you need to speak to an attorney about adoption, not seek advice from the internet. I'll share my honest opinion, it seems that there is a lot of instability in your situation. Now, I don't know it all from your short post but your ex ran off with your friend before your baby was born and you've all moved to different states and he moves around so much you can't track him and nobody has ever put a dad on the birth record. and now you are getting married to a guy that was there when your baby was born... after you say your ex left just a week prior? That's a lot going on in two years time.

This is just my opinion but an attorney would know for sure. You should establish the father with DNA testing and then proceed with terminating his rights and then proceed with adoption. If you shortcut it, saying you don't know who the dad is (and I don't know if you can even do that) then the real dad may someday pop up, ask for DNA test and toss any adoption out of the window. See an attorney.

In my opinion, step 1 is to go to the National Foundation for Credit Counseling website. It is the "real" organization, not one of the late night scammers. Click on the "Find A Counselor" option and make an appointment with someone in your area. It will either be free or just a nominal fee. Their website also has a section on bankruptcy if you want to learn some of the basics. However, if you haven't seen a counselor yet, you really don't know if that is an option for you. If it is, they have counseling for that too. However, before you even think of filing, you'll need to set up an overall financial plan that will keep you out of these type of messes in the future. Glad this is taking a better turn. I refrained from comment intially because I am both an adopter and a volunteer with rescue groups. Yep, we all have serious jobs and lives and fit this fostering and home visiting stuff into our evenings and week-ends. I don't think three weeks is excessive considering that in that time the application was reviewed, your references were likely checked, a home visit appt was scheduled and completed, and the application was approved. Two weeks would be ideal given that most of the visits happen on week-ends, but during busy times when volunteers are on vacation, three weeks doesn't sound like 'forever.' "It seems that in their eagerness to remind me that rescue dogs come with ''baggage'' and that I may want to adopt from a breeder if I'm concerned about health issues, they are less concerned about finding good homes for the dogs than their own agenda." I suspect that their 'agenda' is a permanent placement for the dog. Although you say that you would work with any dog with problems, your requests do raise red flags that would trigger any responsible volunteer to have the 'dogs change, dogs have issues' discussion with you or any applicant. It isn't 'personal'. What you probably ran into were experienced volunteers testing a bit (given your requests) to make sure that the dog wouldn't bounce again. Obviously, they found you sincere and a good potential home, so please forgive them for treating you like any other applicant. Many applicants are not experienced and many really do have unrealistic expectations that no dog can meet and see nothing wrong with returning animals if they don't magically and perfectly fit into the household. What strikes me oddly here is that they don't have photos of the dogs on a website. Maybe you could 'give back' (whether you do or do not adopt the pup you're interested in) by volunteering with the group and taking photos of the dogs for display on the groups website. How old is your son? Assuming he is in elementary school, I would keep a couple of things in mind when you tell him. First, take him somewhere neutral where he can't go running off to his room (make an ice-cream shoppe?). Your tone will be hugely important. You don't want to convey that you are 'discussing' this in the sense that you are looking for his input to make this decision. You have to walk that fine line of being confident and positive about your decision, but empathetic about his feelings of leaving the familiar, the potential loss of his friends, etc. Like all of us, children want to be *heard*, so really listen. And you don't have to have a solution to everything... "But I'll NEVER see my friends!!!" Clarify and empathize before you offer a fix for anything. "Are you worried that you won't see them every day? Or that you'll never see them again in your whole life?" "How would you feel about seeing friends at least twice a week after school?" If there are specific things about the school that will appeal to him (a computer club, a certain sports team...) bring those up AFTER you have won him over a little bit. Don't look for him to accept and rejoice in this decision quickly -give him empathy and time to adjust. But just don't waver or give him false hope that enough of a tantrum will change things. You are in a difficult situation indeed. I understand what you are going through. My husband and I have a son together. He also has a daughter from a previous marriage and I have a son from a previous marriage. The situation you describe sounds like mine in that my husband shows his biological son an enormous amount of love and my other son nothing. There is basically no interaction at this point between the two. He use to discipline my son, but I felt it was done unfairly so that has stopped. Now we are at the point where he nit picks about every little thing my son does, but not to him...to me. It is sooo annoying. It has weakened our relationship as husband and wife, but at least my son is not constantly hearing the complaints. I must say though that my husband's nit picking has made me more critical of my sons behavior. I feel like I am riding him harder over insignificant stuff so I don't have to listen to my husbands complaints...I keep telling myself I need to stop this. My husband, for the most part, is good to me and our son. My other son is 12 and very into school, friends, and basketball. I try to do extra stuff for him when I can to make up for the fact that he doesn't have a dad and his step-dad wants nothing to do with him. My dad (his grandpa) is also a wonderful role model and strong male figure in his life. He spends a lot of time with him. Is it possible for you to find your other son another strong male role model? Like a grandfather, a friend, or join a big brother big sister group? Maybe that would help him and allow you to stay with your husband. You also must consider your other children too. What effect will it have on them if you take them away from their father?

I'm with Ima on this one. Go slowly, and use a lawyer, crossing every T and dotting every I. Too much is at stake to allow sloppy paperwork to put the whole process at risk.

Imagine you try to short-circuit this and that someday the bio dad does show up and wants to start something. He could legally contest the adoption, and without any paperwork showing he was aware of his paternity, that he 'abandoned' his child, and that agreed to the adoption, he wouldn't have a hard time painting the picture that you 'hid' his child from him and then 'stole' it away by having new BF adopt.

You may also want to start a case for child support. Not only will it be helpful financially, you may also find it a great incentive in case 'Daddy' really doesn't want to be involved.

what seemed strange is that he is calling every other week. he never sees his kid and yet he calls quite often. is he calling to talk to you? and what is he talking about?

imamommy is right, parents pop up when their status is threatened, even if they are not involved. They want to know their parental door is still open even if they don't walk through.

Adopting so quickly after the wedding feels like a push. You don't need that kind of fight so early in the marriage. What's the rush anyway? Your new husband can be very fatherly to your 2 year old withough the formality and possible problems of an adoption.

You need to speak to an attorney. Adoptions have been nullified because a bio father wasn't notified, even though not listed on the birth certificate. This is no different.
