What a nightmare!

We had court Friday and it did not go as well and we were hoping.

She showed up with no lawyer, she choose to represent herself and needless to say the judge was not amused.

After everyone got seated he asked her where her lawyer was and she stated she would represent herself the judge asked her if she had any idea how serious this was and she shrugged her shoulders like this was really no big deal.

After about 10 minutes of her ex-husbands lawyer tearing her to shreds the judge stopped and said he felt everyone deserves a fair trial and that she wasn't getting one without having a lawyer.

The judge told her that she has 30 days to get a lawyer and because she even attempted this he told her from this point forward all court costs would be hers.

She then asked her if and her new husband could take the kids to Texas until then. We have a message that she put on Facebook saying once they had the kids it would be so easy to just disappear. Her ex's lawyer showed this to the judge and he told her no way and the kids would remain in the custody of her ex-husbands.

She then asked the judge what were to happen if she didn't show up for the court day and he said the court would consider her a no show and it would be declared abandonment of the kids and her ex would get full custody. She just shrugged her shoulders, rolled her eyes and left.

In the parking lot she announced to everyone that she was having a purse party at her hotel for anyone that was interested that they will have to buy them now because her and her new husband were leaving for Texas in the morning.

I doubt we will ever see her again and for the girls sake I hope we don't.

Wow, what a mess. Sounds like the only thing she cares about is her new husband. Sad for her children that she just doesn't care, but they're best in someone elses care anyway.

Sounds to me like the kids are way better off without this loser in their lives. Too bad they got cheated in the mom dept, but better to live with Dad/Stepdad than to be mistreated by her.

A purse party? I could only HOPE she invited the judge, too. I mean, how rude not to! *heavy on the sarcasm*

Thanks Carla. I just wish we could edit our posts. Even this last one, I wish I could, but I will not ask Garden Web to do it again for me. Of course the above post is a close copy of the last one that I had posted here on the subject. I copied it from the one I posted to my friends on our B&B board. I should have edited it first I guess. I did have one reply from Florence on this particular post, but as I said, it was pulled. Anyway our grandson did come at Christmas to us and we had a great time with him, as well as some good visits with our Daugher Louise and Ryan's cousins. It was a great Christmas. His dad, our son also got permission to have a visit with him at our house. It went very well. Neither Ryan or us had seen him for a few years. We keep in touch with him (Ryan) by phone and a couple of weeks ago visited the foster parents in Victoria who had come to the island for a short vacation. Anyway, after my first posts on this subject, which was received with encouragement and kindness, I just wanted to update you. Will tell more aftr the JDR in Edmonton on 13th March. Pauline

People can be quite shell shocked by this and perhaps a little in denial, if there is any 'upside' to this, it's that most people accept it's a real, definable illness although it's often mis/undiagnosed. Otherwise be prepared for a lot of homespun advice about how all he needs is a haircut and a good stint in the army. My daughter is bipolar. I knew she was several years before I knew officially, because I saw the signs. She was being treated for depression, but other things were going on. This was all coming to a head whilst her mother and I were divorcing etc, I do believe emotional circumstances/changes etc can bring about the onset. The biggest challenge is getting an older (teen/adult) sufferer to continue to take their meds. There are side-effects and other downsides to them, and when it's all working normally, they don't feel the need to take them. When they are manic, they feel great and bulletproof and don't feel like they need them. Knowing what the issue is, can be helpful to you because it should help you be a little more patient, as you know then it's not personal, the nasty thing said/done is not really how they feel etc. It's still hard but it can help you to keep the bad stuff at arms length. The best thing you can do for SO and family, especially those not coping, is to get whatever books and literature you can, and attend a support group. That might help things along. My own daughter at the moment is off her meds, I am overseas so can't really 'supervise' if that's the word, directly, I lie awake a lot worrying about her. At the moment she's fine although she's complaining about some vision problems....but can get very depressed when things go bad, sees bad or persecution where there's none there, and becomes very irritable and defensive. It's hard to get them back onto the meds in this situation, but she was so much better on them. She's a musician, and like so many creative bipolar types (and there are a lot) I think she believes or fears the mood stabiliser affects her creativity. I had not heard of early onset bipolar, you have my best wishes. Arm yourself with as much knowledge and support, including counselling for yourself, that you can get.

I thought all custody cases are sealed. Is this only where I live? I thought the idea was to protect the children. If the judge had showed bias in the past, I would have thought there would have been complaints. My guess is this is very difficult to prove, and where I live it is very hard to find out info on unproven complaints. Where I live, my understanding is that Judge will only speak to child alone where child has reprsentation (eg GAL). I could be wrong, and my guess is different everywhere. In any event, this is just a status meeting. If I were the mom, and I wanted to keep custody, I would insist on evaluations, GAL, etc. All this takes time. Time is on the mothers side. Even if child says she wants to move, my guess is judge is going to be a little nervous about moving child from school where she is doing well. He certainly wont want to see another hearing a year from now with child with Cs and Ds from Michigan school. If I were dad wanting custody, as difficult as it is, I would concentrate on what I can control. I would have a writtten plan in place as to child seeing mom over summers etc. I would try to reach some compromise re CS. I would consider presenting to her before everyone goes to referee. The referee can not make anyone compromise. He/she can only tell each party the weaknesses of their case, and suggest they compromise. The problem is mom may feel that she can not receive less than what dad is asking for, and that there no point in not dragging out proceedings.

Ashley, Thank you. I need all the prayers I can get right now. My DIL is too much.. like having a room full of crazy BM's! I am wondering if she has multiple personalities. On Saturday, she accused me of wanting to take DGS so I can have a baby of my own... and when I point blank asked her if she wants him back full time, she said no. She says she can't have a baby full time "at this point" in her life. I mean she flipped from me stealing the baby to saying she can't possibly handle him full time. I was at work and while I was with a customer, she walked out taking DGS with her. By the agreement, she is supposed to have Saturday & Sunday. Well, Sunday she didn't call or bring him back. On Monday, I talked to my son and he told me what she said to him... everything was twisted. He is upset & does not need to be bothered with worrying about this. He has a job to do over there, he should not have to have her telling him to tell me anything. She can tell me herself, but she tells him & he is frustrated because he is over there and can't do anything. So, Tuesday she calls my daughter to ask for diapers. My daughter takes her diapers & DGS had been taken back to the doctor. I called the doctor's office & was told DGS has an ear infection, but is otherwise okay. So, Tuesday evening, I ask her if she is going to stick to the agreement... she says no, he is staying with her. So, I tell her that I still want a drug test & I had talked to my attorney about guardianship. She told me to bring it on and she would pass a drug test. I told her if she takes a drug test and passes, I will drop everything and she can keep DGS full time. (lol, even though she ranted for ten minutes on Saturday on how that was impossible!) She didn't answer me. Then today (Wed) she sent me a text at 5pm, telling me my son wanted us to talk. (my son told me on Monday that he told her to have a talk with me) but I did not write back. Less than an hour later, she called me at work & said she had DGS outside & I need to get him. I wasn't shocked but I was in the middle of working... it's a very busy weekend coming up & normally I leave work at 5, it was 6 & I had planned to stay til about 8. I hesitated and she says "well you do want him don't you.. this is what you want, right?" And, I could not say no to taking him. She said she was going to go ahead & stick to our prior agreement. I went outside & there he was... dried boogers on his face, gunk dried on his eye, his little eyes were red and he looked pathetic. She handed him to me without a word & huffed back to her car. She was visibly angry, like I just forced her to give up her child. I took him inside & then noticed he had a fever. I called her and asked when he had last taken medicine. In a very friendly tone, tells me oops I forgot to give you his medicine, I'll be right there. She came inside & this time (mind you, this was about fifteen minutes after she huffed off) she was being sweet & bubbly.. like we were besties. She said she took a video of him taking a few steps and she couldn't wait to show me but she forgot it at home. It was WEIRD. Like a totally different person. So, I cleaned up and brought DGS home, gave him fever reducer & a bottle. He took a nap and woke up in the evening... we played, he ate, and he went back to sleep. I may finally sleep easier knowing he is here. But, I know she only did this because she wanted to go somewhere tonight. I have to take it one day at a time, because the next time I see or hear from her, I don't know what I'll get.

to become a parent. She is a piece of garbage. I hope she
doesn't come back.

I don't know , but when I became a mother I found my love for my husband changed somewhat. I felt more a part of a community, the community of families where parents looked out for their kids. I remember thinking I would die for my child if I had to.The one thing is I do hope your cousin will get a lawyer. I am ver intimidated with Courts. No way would I represent myself. That's for lunatics, like Charles Manson.

I don't understand, why do you say it didn't go as well as you hoped? I thought you were opposed to her taking the kids. Sounds to me like it couldn't have gone better except perhaps if the Judge gave full custody to him now and issued restraining orders but that was not going to happen.

There are times when representing yourself can be good. But you need to know what you're doing. The Judge will often help out the pro se party when the other is represented by a lawyer. In the past two years I've been sued twice and threatened with a third. I decided it would cost way more for a lawyer than what I'd stand to lose so I might as well handle it myself and hope that the judge at worst would at least reduce the request. I won both cases handily. I could have and probably should have gone for sanctions and penalties but decided not to bother. I was threatened with a third one and I called up his lawyer and made it clear that I'd make a fool out of both him and his client and I *would* be going for costs, sanctions and more if they proceed but to go ahead if they want. I also "let it slip" that I had been recording phone calls so I have proof to prove they lied in the affidavits. They dropped it. Plus I made him put it in writing that they were dropping all actions and have it notarized. Not sure if he noticed the recorder when we met to transfer the agreement. So I take pride that I have "never lost a case in court"! But then again, some people think I'm a lunatic like Charlie Manson! LOL

The only time one should be intimidated in Court is if you're going to lie, but so many people do. And with the number of incompetent lawyers out there... sheesh. Just having a lawyer is different than having a competent, good or great lawyer.

My guess: She will leave, not appear in court and not pay any costs. Good riddance. And if it happens, it would be the best for all concerned in the big picture.

cynic i'm sure they'd hoped the dad would have been given custody asap...

this lady will never realize anymore than my bil did when he not only gave custody away, he relinquished parental rights and allowed the girls to be adopted by their step-dad...he was the one who took pix of the proms, attended the games they were on poms team, and walked both down the isle...

We wanted the dad to get custody and not have to put the girls through anymore of the drama they get from their mom.
She left for Texas the next morning. Hopefully we will NEVER see her again. She called the girls that night and told them this big huge story about their dad and his lawyer keeping her from them. The kids don't understand what's going on and don't need her messing them up anymore.
