Pool fences and HOA's question.

Question for those with pools and HOA's:

In my townships, pools are really popular. I'd guess 25% - 30% of the houses have pools...so getting a permit for a traditional pool is no problem. And of course, per code, they require a 4ft fence. This is allowed my HOA.

But the rules also state that the fence can't go past the front wall of the house. So it has to sort of wrap around the lot, but can't go past front wall. (I've attached a pic) For most lots this is no problem because the front wall of the house is the closest part to the road.

But on my lot, my side yard extends another 100ft past the house to the front road. So for me, it's the ideal place for a pool. *Assuming* I can't get approval for the fence from the HOA, but can get a permit for the pool, would the fence requirement override the HOA rule?

p.s. not to scale --- my place isn't the size of a pallet =)
