Termites in DH's house...WWYD

The termite inspector found evidence of former termites (tunnels) but no active termites in DH's house. He also found evidence of carpenter bees. His price quote to treat was very high, so our wonderful real estate agent decided she would get another estimate and brought over another estimator today. He found EXTENSIVE damage throughout parts of the house from termites and said some of the under flooring is rotting and now it is 2x the amount to treat.

She said DH has to fix it all now because now he knows about it. My thinking is that the purchasers' inspector, which they hired, didn't find this so that's on him. Her argument is that the buyers could come back and sue us later if they have termite damage. My argument is: their inspector didn't find it, DH didn't even know about it, so how can they sue him? Wouldn't they sue the termite inspector? Plus, if she kept her trap shut to us no one would know.

God, this is ridiculous!!
