Remember My Friend That Tree Limb Fell On?

April 28th will be 2 years since the accident happened. He is really doing good! It has been a slow, life changing journey for this young family. Everything the Dr's. told them in the beginning had to have been based on medical information. His wife refused to accept that, because everything SHE believed was based on something Higher. Looks like she was right!! This is a pic of him taken a few weeks ago.

Hopefully they will be rolling that wheelchair into the woods in a few weeks. His balance has been off..preventing him from walking. A scan a few weeks ago revealed he had 4 "pockets" of fluid around his brain that was causing him to be off balance. The ONE Dr. that never gave them reason to lose hope put a shunt n yesterday morning and everything went perfect!! He starts rehab in the morning.

He looks like he is doing great, and what wonderful news!! I hope that he is up and about quickly now! His wife must be quite a gal and he looks like a determined young man.

Brandon7 The tree was planted in an old farm field that become part of my yard and the site of my orchard. No other tree had died in this location. The rootstock is whatever Stark Bros. used back in 2001 when the company was changing hands. They were and probably still are tough to get information from in regards to rootstock. I do not believe there is any indication of girdling roots. This tree broke inches below the soil line. However, when time permits I will examine the soil, as well as cut into the tree trunk looking for anything that might indicate what happened. Here is a photo of the trunk where the break occured.

Thanks for the responses, I am going to do some research and find an arborist as you have suggested. That car in the picture is my neighbor's. When I bought this house a year ago, I mentioned that the tree that is closest to the house made me very nervous and my neighbor totally dismissed my concern and acted as if I was silly for mentioning it ("That tree has been there 100 years..."). Even after yesterday, I highly doubt that they would have someone come to inspect the trees to see if there is actually something wrong with the Ashes. I know they will not pay to have it removed unless I can document for them that it has to be. I can at least have the limbs over my yard removed though. I also live in an area where the Emerald Ash Borer has started to appear. I don't know that this is the problem, but of course you are all correct... it has to be looked into.

Hi Angie, There's a good possibility that it is related to the weather, but even though summer branch drop or summer limb failure has long been known to occur, tree experts still have not reached a concensus on exactly why it occurs. One school of thought is that it is the high flow of moisture through the limb that weakens it....not necessarily a lack of moisture. Rather than resulting from a lack of moisture, it results from all the work the tree's vascular system does to transport enough water throughout the tree to equal the amount of moisture lost to transpiration. Another possible cause is that prior root damage from years before may ultimately lead to summer branch failure, or that it is related to cellulose tissue problems within the limb. Summer branch failure is most common on large, strongly horizontal limbs, but has been observed on vertical limbs as well. It is observed on some types of trees more than others. A few of the trees we have here in Oklahoma that exhibit summer branch failure more than others include oaks, sycamores, maples and ornamental pears. There's really nothing you can do about it. Asssuming for the moment that you were to take this case to small claims court, let us review the evidence. 1. In your complaint you stated that there was a dead limb clearly visible just below the limb that fell- yet you chose to ignore the potential danger and park there anyway so you have placed your car in a position of assumed risk. 2.By your testimony the limb that fell was a live limb, altough some prior damage was discovered after it fell- even assuming that the property owner had inspected the tree, what is the likelyhood of seeing that potential problem from the ground? Now you could argue that there is a dead limb present, but the dead limb was still there after the incident and has nothing to do with your case. You testified that it was a clear & sunny day with no wind so even if there is a dead limb, the likelyhood of it falling on that particular day was slim. By your testimony the total property damage to your car was in excess of $2500 and you filed a claim with your insurance company which covered all but your deductable. No doubt your insurance company settled on the grounds that the incident was an "Act of God". The acceptance of the $1500+ from your insurance company sets a legal precident that you also accepted it as an "Act of God". Given that you accepted monies from your insurance company as an Act of God, you cannot later claim that the incident was a result of negligence on the part of the property owner.

I remember your friend's accident. My brother fell and hit his head on pavement about a month after your friend did. My brother is still in a coma. Your friend is very lucky, indeed. It makes me very happy. Thanks for the up date.
